The point that I am making is that prosecution does not have to prove gratification is linked to soemthing. The law requires that Ng, the accused to prove that it is not gratification and that it is not linked.

That is why I stated that people do struggle when money is given or a paid holiday but struggle with sex.

Teh Cheng Wan's case involved a very good long time family friend. Teh must have had solid legal advice on his probability of conviction. Excuses like family friends, custom, tradition, love cannot fly when you are in position of conflict. If he was a bus driver she can such his dick to kingdom come for all to know.

The key question is what constitutes gratification. Is having feeling for the other party, with or without sex, so important as far as gratification is concerned? The "gratification" has to be linked to the other side of the bargain, the award of a contract. I guess the defendant lawyer will argue on the existence of gratification, tender influence and the logicality of the award as a last resort. If in throwing a random dart, you hit the awarded product 70% of the time, it can be argued that the award is just a pure coincidence. it has more to do with code of conduct, but what they need to prove first is conflict of interest by linking simultaneity of loose sordid love affair and strict buyer-supplier business protocol clashing with each other, despite whether or not need to blow groin has direct influence on the selection and purchasing decision. conflict of interest, though a code of conduct issue, can lead to corruption, and that the prosecution has to prove. the juicy details and lies are there for shaming effect, nothing more.

if nbg is already in an affair with cs, and a bid process is outstanding between a prospective supplier and the buyer organizations in which these two lovebirds work in, not just as lowly clerks and cleaners but as director and account executive respectively, the right thing to do is for either one, especially nbg, to recuse oneself from any possibility of impropriety, direct and indirect influence, and conflict of interest. that declaration should be made by nbg to his boss prior to any bid process. it's a code of conduct issue but not a criminal offense. however, by not recusing himself and declaring possible conflict of issue to his superior, it can lead to corruption, which in sg, is a criminal offense. the prosecution has to prove that corruption arises as a result of conflict of interest. that, imo, is hard to prove unless there's evidence of impropriety such as nbg's signature on the final contract after the bid.

His position matters a lot...even in usa, one turd had to go when he screwed a subordinate...consent is not an issue here...you can question why but law as stated by the DPP should be accurate. Which also makes me wonder why prosecution try turn this into almost a rape case...to me that is bad because if they prove then people ask why not rape charge, if they lose that aspect the whole testimony is suspect...mind you he never deny affair...


May be cs demand that right to save face...and convince husband...had she denied whole thing case would collapse...

How much of a gratification would a BJ give you? Maybe someone should set up a School where CPIB officers can learn the finer points of obtaining a statement from accused or witnesses.

They admit affair even publicly in opening statement....so no point of DPP focusing on molest , no of encounters , exact act performed etc that is just theatrics....case hinge on whether this argument that there is no corruption is true or not...law presumes guilt but allows you to prove otherwise...

He can do that if he can show to things...one is the affair started much earlier so nothing to do with this job and secondly he was no way involved in vendor selection.

But now that element of force is brought out by cs, he also had to show consent....i think he easily can do that. But that does not help in main case it help him avoid much more serious charge, even caning for assault.
