If a female Sporean is involved in a divorce, a prenup agreement is not enforceable in Spore. The womens charter would apply.
that's not altogether correct. it's a half-truth. there are pre-nups in marriage cases in sg. they will not be upheld by the court only if any term in it "contravenes any express provision or legislative policy embodied within the women's charter." in other words, the women's charter does not totally render a pre-nup ineffective or void it. they can co-exist if terms in the pre-nup stay clear of the women's charter express provisions and policies. there are several terms and conditions that can protect the man without contravening the women's charter. in fact, the sg court of appeal upheld a pre-nup agreement in the landmark decision of tq vs. tr (2009) sgca6.
the advice on pre-nup is provided by the sg legal community as follows:
"Prenuptial agreements refer to the agreements entered into between spouses before a marriage. Some couples view prenuptials as practical solutions to determine with certainty their respective rights over property, maintenance, and custody matters, as a form of insurance against the possibility of divorce. The Singapore Court of Appeal (the highest court of the land) upheld a particular prenuptial agreement in the landmark decision of TQ v TR [2009] SGCA 6. Nevertheless, the Court of Appeal was quick to warn that not all prenuptial agreements will necessarily be upheld and enforced upon the parties.
What are prenuptial agreements?
Prenuptial agreements are contracts entered into between spouses prior to marriage. Given their contractual nature, they must also satisfy the requirements of any basic legal contract. This means that prenuptial agreements must be supported by consideration, and must not be obtained through misrepresentation, fraud, duress, unconscionability, or undue influence.
Are prenuptial agreements valid and enforceable by the courts?
A prenuptial agreement (or term thereof) which contravenes any express provision or legislative policy embodied within the Women’s Charter will not be upheld. In divorce proceedings, the court is entitled to scrutinise the prenuptial agreement and decline to uphold the agreement if it contradicts the requirements of the Women’s Charter."
