MH370 crash: Chinese families maintain hostile attitude toward Malaysian delegation

BEIJING: The aggressive attitude by the families of Chinese passengers aboard MH370 towards the high-level Malaysian delegation continued during a four-hour meeting on Wednesday afternoon.

The family members were aggrieved over the absence of caregivers from Lido Hotel here over the past two days, which was a decision made based on the advice of Chinese government officials, who advised the team from showing up following the tense situation on the night Najib announced MH370's flight path had ended in the southern Indian Ocean.

"We have a Chinese commander here with us and every action we take is based on his advice.

"It was on the Chinese authority's advice that we did not report to Lido Hotel. But we felt that the situation is much calmer today and our team will begin their work again after this meeting," the MAS representative explained.

However, his reply was perceived by Chinese family members as an attempt by the Malaysian team to redirect blame towards the Chinese government.

Wednesday's meeting was originally opened to Chinese and Malaysian media according to a previous agreement, but the family members demanded the presence of foreign press as well.

The family representative made clear to the reporters that they were to agree not to air certain contents of the briefing whenever requested by the families, or else the family members "reserve the rights to take legal actions."


One such incident happened later when a family member made a comment on the delegation's appearance as he criticised their "technical and academic levels".

"Apart from pushing the responsibility to the English gentlemen, what else can you tell us other than showing us these bloody slides?" he added, referring to the presentation on the analysis by Inmarsat and UK Air Accidents Investigation Branch (AAIB).

During the meeting, most of the family members were hostile and sarcastic when posting their queries to the team.


They questioned the accuracy of the AAIB analysis, commenting that it was done based on assumption.

"How could you reach the conclusion that there are no survivals when no aircraft debris and passengers have been found?" one asked.

Another was interested to know how much has Malaysia paid for the AAIB report. "I think you didn't pay enough. If not they won't give you such a report. You have been cheated." His comments drew laughter and applause from the crowd.

Some family members vented their anger at the photographers and video cameramen by shoving forcefully and lashing out at those who were pointing their equipment at the grief-stricken next-of-kin.

China Daily also reported that several men "threw chairs at the screen" and "at least 10 family members fought with the police" after watching Najib's announcement.

The high-level delegation that met the families Wednesday comprised Malaysian ambassador to China Datuk Iskandar Sarudin, RMAF air operations commander Lt-Jeneral Datuk Seri Ackbal Abdul Samad and Department of Civil Aviation air traffic services director Ahmad Nizar Zolfakar and representatives from Malaysia Airlines.

Missing Malaysian Flight MH370: The £450m question – Why are Western lives worth more than Chinese aboard the stricken jet?

Search for debris suspended due to bad weather - yet families already being urged to consider potential pay-outs

As Chinese life insurance companies started paying out to the families of those on board Malaysia Airlines flight MH370, relatives of passengers from different countries faced the prospect of wide discrepancies in the compensation from the airline.

According to the Chinese state news agency Xinhua, the country’s largest insurance company China Life had 32 clients on board the flight when it disappeared into the southern Indian Ocean.

The families of seven passengers have already received pay-outs, and it is estimated that the company will pay out a total of 9 million yuan (£875,000), an average of less than £30,000 per person.

Meanwhile, experts have warned that Malaysian Airlines could face compensation costs of up to $750 million (£450 million).

Though no debris has been found from the missing Boeing 777 and Chinese families continue to protest that they have not been told “ the whole truth” by Malaysian authorities, a US-based law firm has also already come forward to say it is preparing to bring lawsuits against the airline and plane manufacturer.

Under the terms of the Montreal Convention, which was drawn up to deal with the multinational issue of aircraft disasters, a lawsuit can be brought in any one of five possible courts – the country of origin for the flight (Malaysia), the country where the flight was headed (Beijing), the country where the airline is based, the country where the tickets were bought or the home country of the individual passenger.

This raises the possibility of some passengers’ families receiving far smaller pay-outs than those from other countries.

Malaysia Airlines Flight MH370 is thought to have crashed on 8 March with the loss of all 239 people aboard after flying thousands of miles off course. More than 150 of the passengers were Chinese.

A US-based aviation crash attorney, Floyd Wisner, told CNBC: “ For the majority of passengers on this flight, this [the country where the lawsuit can be brought] is either China or Malaysia and these countries have very limited views of damages as opposed to America.

“They could evaluate these cases and say a Chinese life is (of) less value than an American life. That's unfair and that's going to cause problems.”

Wisner said that the airline could pay out between $500 and $750 million (£300-£450 million) in total compensation to the families, and was likely to have liability insurance to value of around $1 billion.

Chicago-based Ribbeck Law said it expects to represent families of more than half of the passengers on board the missing Malaysian Airlines flight in a lawsuit against the carriers and Boeing, alleging the plane had crashed due to mechanical failure.

The firm has filed a petition for discovery against the manufacturer and Malaysian Airlines in a Cook County, Illinois Circuit Court. The petition is meant to secure evidence of possible design and manufacturing defects that may have contributed to the disaster, the law firm said.

Though both Boeing and Malaysian Airlines were named in the filing, the focus of the case will be on Boeing, Ribbeck's lawyers told reporters, as they believe that the incident was caused by mechanical failure.

“Our theory of the case is that there was a failure of the equipment in the cockpit that may have caused a fire that rendered the crew unconscious, or perhaps because of the defects in the fuselage which had been reported before there was some loss in the cabin pressure that also made the pilot and co-pilot unconscious,” said Monica Kelly, head of Global Aviation Litigation at Ribbeck Law.

“That plane was actually a ghost plane for several hours until it ran out of fuel.”

Kelly said the conclusion was made based on experience on previous incidents, dismissing the possibilities of hijacking or pilot suicide.

The lawsuit, soon to be filed, would seek millions of dollars of compensation for each passenger and ask Boeing to repair its entire 777 fleet.

Popular anger in China against Malaysia's perceived mishandling of the MH370 crisis continues to boil, as several top online travel agencies announced boycotts against Malaysia Airlines until it "gets to the bottom of the truth on Flight MH370.”

Agencies including eLong, LY.com, Qunar, and Mango, which are among the largest online ticket and travel vendors, said they had banned sales of Malaysia Airlines' tickets due to public anger against the carrier and the Malaysian government.

However, Ctrip.com, the country's largest online travel agency, had not put a similar ban in place as of Friday "due to objections raised by the sales department," one Ctrip employee told the South China Morning Post on the condition of anonymity.

“We will continue the ban indefinitely until the Malaysian government and Malaysia Airlines release every piece of information they have in order to find out the truth about the missing flight as soon as possible, ” reads a statement eLong published on its official Weibo page.

Two passengers on the missing fight MH370 had booked their tickets via eLong, the agency said in its statement, and that it would pay each family 100,000 yuan (HK$125,873) “as a consolation.”

In its online statement LY.com said it would offer a full refund to clients wishing to cancel bookings of the airline's tickets and would carry on the ban until the company “sorts out the truth and offers a satisfactory explanation to all the victims and the Chinese people”.

The announcements seemed to have pleased some net users. The eLong statement had received over 7,000 comments and more than 10,000 reposts as of Friday.

“eLong has proved it has a conscience, and I will book from them in the future,” read a comment by one microblogger.

Others said they were displeased with the fact that Ctrip didn’t join its competitors in banning Malaysia Airlines ticket sales.

Ctrip, Qunar and LY.com ranked among the top three most influential online travel agencies in China, according to a 2013 research conducted by China IT Research Centre.

As of the third quarter of 2013, Ctrip led the market with 48.9 per cent of the total sales of China’s online travel booking market, followed by eLong (9.5 per cent) and LY.com (6.3 per cent), according to statistics released by iResearch, a market research firm in China.

NASDAQ-listed Ctrip posted a total revenue of 5.4 billion yuan in the 2013 fiscal year, according to its financial statement.

Amid growing calls on China's social media to boycott Malaysian tourism and products this week, some bloggers and columnists have warned against stoking further tension between the two countries and urged for calm and help for the passengers' families.

While search crews scramble to find wreckage from flight MH370, two virtually indestructible devices are likely sitting on the ocean floor emitting "pings".

The plane's flight data recorder and cockpit recorder can hold the keys to unlocking the cause of a crash. The boxes - in reality coloured orange so they can be seen - can withstand an hour in a blazing inferno, the pressure of 6,000 metres of water, or a high impact that would obliterate most other plane parts.

But once they hit water, the battery-powered signal they send out can transmit for only a month. And search teams have to be within about four kilometres to pick up the signals.

If search crews can confirm that satellite images of floating debris in the southern Indian Ocean is from the Boeing 777, they will calculate where the bulk of the plane may have come to rest on the seabed and head there to listen for the pings.

What does the black box record?

The data recorder logs performance and other metrics, including speed, altitude and direction. It can give investigators a cache of information of the 25 hours prior to a crash. The voice recorder captures two hours of sound from microphones in the cockpit. It runs on a loop, so audio from the critical moments during which the plane diverted west from its Malaysia-China route - about seven hours before it is believed to have crashed - would have been erased.

How long will it transmit a signal?

Each recorder has a beacon bolted to the box's exterior, which once activated by water emits a chirp every second that requires special equipment to detect. A beacon's battery is designed to last 30 days. Experts say another five days' useful pinging is possible as the batteries fade. The Malaysia Airlines flight is believed to have crashed on March 8. Time is running out.

Why only a month?

After the 2009 crash of an Air France flight in the Atlantic Ocean, search teams did not find the black boxes for nearly two years. Aviation regulators began a push to extend battery life, and the European Aviation Safety Agency will require a 90-day pinger starting next year. Several years later, a second regulatory change kicks in. A much larger pinger must be added to the structure of the airframe that would give searchers a second signal to track, detectable up to 13 kilometers away.

MAS avionics workshop in Subang caught fire recently and nobody reported the incident. Something sinister going on. there was a union conflict with management recently due to planned layoffs. Maybe MAS keeping the lid. Maybe sabotage on aircraft like what happened several years ago when similar management -union conflict occured.
This could be a man slaughter case.

A plane has spotted 'multiple objects' in the search for the stricken Malaysian airliner, Australian officials confirmed, after the hunt for missing Flight MH370 moved to a new part of the Indian Ocean, 700 miles north-east of the previous area.

Five out of 10 aircraft hunting for the stricken jetliner found objects of various colors floating in the ocean, the Australian Maritime Safety Authority (AMSA) said. It said it was not clear whether the objects were from the plane, and photos of them would be analysed overnight.

The AMSA said the objects included two that were blue and grey - among the colours of the missing airplane. A Chinese patrol ship in the area will attempt to locate the objects on Saturday, it said.

The search for the Malaysia Airlines jet was switched after a “new credible lead” from radar analysis suggested the plane flew faster and so ran out of fuel quicker than had been previously estimated, reducing the possible distance it travelled.

It means that the hundreds of floating objects detected over the last week by Japanese, Thai and French satellites, thought to be wreckage of the lost MH370 flight, were not in fact from the plane. No physical objects were located in searches and so no part of the aircraft has yet been discovered ...

Don't worry, this time should be correct. How can it be wrong when someone, somewhere actually knows where the plane goes down. Due to that knowledge, they can't play the lead role in locating the plane. They let others go round in circles and provide clues along the way to lead the searcher to the actual site. This time sure correct.

There are many conspiracy theories in the internet. However, from the info surfacing day by day, I find this one having the best match to the info available. :
1. pilot hijack plane, divert plane,
2. negotiation, threaten to made twin tower become world trade centre,
3. pilot lose control of plane's flight direction to remote control,
4. cannot allow plane to fly over land in case pilot crash plane
5. Direct plane into open ocean till fuel finish.

There is only 1 word to describe this incident, "unprecedented".

1. It is unprecedented that an aircraft enters a country's airspace and no alarm was raised.
2. It is unprecedented that a commercial plane flies in a zig-z manner to nowhere.
3. It is unprecedented that "Doppler" effect is used to determine the flight path of a plane.
4. It is unprecedented that 200 over people are declared dead without any recovery of wreckage nor bodies but through expert's determination of the possible flight path using an unprecedented method.
5. It is unprecedented that insurance company disburse compensation, accepting the declaration of death, without any question to the way the certification of death is made.

It is so confusing. However, the events point to the following :
A. During the initial phase, authorities do know that the plane was not in S China sea but allow others to waste their resources.
B. There is a deliberate effort to close the case by confirming the crash quickly.
C. There have been many cover ups resulting in many discrepancies.

It is frustrating, amusing and incredulous at times. However, it is definitely a good story for the next Hollywood disaster movie
