SINGAPORE - Mr Lee Hsien Yang said Home Affairs and Law Minister K. Shanmugam and Foreign Minister Vivian Balakrishnan are wrong to accuse him of making false allegations.

In his first public comments since the two ministers sent him a lawyer’s letter, Mr Lee – the younger son of former prime minister Lee Kuan Yew and brother of Prime Minister Lee Hsien Loong – said in a Facebook post on Saturday that he was simply stating the facts.

Mr Shanmugam and Dr Balakrishnan on Thursday said they will sue Mr Lee Hsien Yang for defamation if he does not apologise for having made false allegations.

On July 23, in a Facebook post commenting on how recent political affairs had shattered trust in the People’s Action Party, Mr Lee said the two ministers had leased state-owned mansions from an agency that one of them controlled, felled trees and received state-sponsored renovations.

He was referring to the Singapore Land Authority (SLA), which is a statutory board that comes under the Ministry of Law that Mr Shanmugam oversees.

On Saturday, Mr Lee said: “My post did not assert that Shanmugam and V. Balakrishnan acted corruptly or for personal gain by having SLA give them preferential treatment by illegally felling trees without approval and also having SLA pay for renovations for them.

“My post simply stated facts that were already widely published in the Singapore and international media.”

Mr Shanmugam said in a Facebook post on Thursday evening that he and Dr Balakrishnan sent lawyers’ letters to Mr Lee on Thursday.

Said Mr Shanmugam: “Lee Hsien Yang has accused us of acting corruptly and for personal gain by having Singapore Land Authority give us preferential treatment by illegally felling trees without approval, and also having SLA pay for renovations to 26 and 31 Ridout Road. These allegations are false.”

He added that the two ministers have asked Mr Lee to apologise, withdraw his allegations and pay damages, which will be donated to charity.

“If he does not do so, we will sue him,” Mr Shanmugam said.

Mr Lee said he put up his latest Facebook post while in the United Kingdom.

He added: “If K. Shanmugam and V. Balakrishnan believe that they have a real case, then they should sue me in the UK.”

On Tuesday, Mr Lee was given a correction direction under the Protection from Online Falsehoods and Manipulation Act (Pofma).

The Law Ministry, in a statement issued on the same day, said Mr Lee’s Facebook post on the Ridout Road saga had made three untrue statements.

These included the assertion that the state had paid for the renovations to 26 and 31 Ridout Road because the properties were leased by the two ministers, and that trees at the two properties were allowed to be felled because the properties were leased by them. The third statement was about SPH Media Trust.

Mr Lee put up the correction notice on Tuesday night, but put up a new post calling the Pofma notice misleading and saying he stood by what he had said.

Singapore has an extradition treaty with UK, with regards to criminals whom committed crimes, even as minor as not paying parking ticket fines. A criminal is a criminal, in lands that are RULED by LAWS.

For Mr LSY, he had made presumably false accusations to that of no less than ELECTED legislators by majority citizens vote & are thoughtfully selected Cabinet Ministers to administer to our Country. Regardless if he is residing in Austria or Zimbabwe, he STILLS hold Singapore CITIZENSHIP, a PRIVILEDGED status as one of us common citizens & are expected to be courageous to uphold our comments, especially over political matters of National State.

May the UK govt extradite him back to Singapore. Singapore still follows the established Common Laws of UK, where no citizen is denied of a fair trial & legal representation.

Let him, who is a son of one of our great Founders of Singapore, explain his position as a fellow citizen, without fear or favor, his comments that he thought free to expressed, & then let our trusted Judiciary & citizens decide if he had defamed, or mistakenly/deliberately made mistakes of presumption, to exonerate himself & uphold his standing amongst peers & citizens.

SG libel/defamation/POFMA laws are not recognised overseas. The fact that LHY is backed up by no less than The Economist which is on the daily-read list of the world's most powerful and richest individuals, not to mention many Western advanced economies, shows exactly what the SG gov is going up against. SG won't dare to try and sue LHY in the UK; it won't even meet the minimum standards for a case to be justified there and any sane judge will laugh it straight out of court.

Not to mention UK is bringing in legislation to make it harder for foreigners and foreign governments to abuse the UK justice system by initiating what is called "strategic lawsuits against public participation" AKA SLAPPs.

Last like is crucial. "The onus will be on the complainants to prove that their case has merit, rather than on the defendant". If Viv and Shan try to sue LHY in a UK court, they will self-snook because in order to prove that what LHY has said is libel and defamation against them and SG, they will have to show hand and disclose EVERYTHING regarding Ridoutgate.

I was thinking Ridout Shan and Vivian can try first to obtain judgement against LSH locally and try to enforce it in UK , as its easier for them this way.
Any legal mind can advise on this?

How do you expect foreign courts to agree and enforce a SG law-defined judgement that has no equivalent in foreign jurisdictions?

Foreign courts will just throw out any such applications for Mareva-like enforcement and say "your laws don't apply in my house".

See LKY losing out in his libel suit against Devan Nair in Canada for a good example.

If like that,
then No case for Bro Yang
to answer as it took place
in the UK.
That’s right. He’s basically shaming the law minister without telling the world the latter doesn’t quite know the difference between civil and criminal. Interested parties can go read up on the defamation case of Stocker vs Stocker in the UK about the impact of social media on jurisdiction in the age of the internet
