exactly. it appears ridiculous that a GRC team needs a minority race member and yet when she resigned, the PM doesnt see the need for a BE. It is clear from our Constitution that a GRC Team is null and void when the minority race member is out of the team

until it changes the law, the present law requires a minority race MP in a GRC Team. With Halimah out, there is no minority race member in Marsiling GRC.

So SDP is right to void the team an sue LHL if he doesnt call for a by-election withing three months of halimah's resignation.

The problem with LHL is he messes around with the Constitution and SG Laws but he is not a lawyer and he is not very intelligent. So his messing around creates more mess for himself. So he is firefighting and is getting stressed. That's not good for his health

The Judges will give the government the benefit of every possible doubt. I think this is true of most countries. Else the government can be tied down by frivolous suits to the detriment of the country. However when the issues are crystal clear the Judges have to follow the law. To me if it is necessary to call a by-election for a SMC when the incumbent MP departs, it is doubly so when a minority candidate in a GRC leaves. The GRC is focused on minority representation. To claim no bye-election is necessary is to call the GRC scheme as a sham. The likes of CCS not addressing this point exposes the intellectual vacuum at the top of the adminstration.

I agree with your views. That's why I also said that SDP has valid case against LHL. Since LHL has ignored SDP's demand, I hope SDP has today taken steps to bring LHL to Court.

For Marsiling BE, the primary issue is to bring LHL to court and get a judgment to force him to have a BE.

LHL does not have unfettered discretion whether to hold a by-election at Marsiling as Halimah has resigned. SDP has a valid case to bring LHL to court as Halimah is a minority but essential part of the GRC. Halimah is a key member of the GRC team. Without a minority member, the marsiling GRC team does not fulfil the spirit of the Constitution.

I hope SDP take up the case against LHL with SG Court as soon as possible.
