The skills rest in the ability to tailor your answer according to the question asked, not regurgitate whatever you know about the question, however remote.

You are asked: "Did you know [before the ruling was handed down] that the President does not have discretion to grant pardon ?"

You are NOT asked: "Write everything you know about the power of the President."

We all know a broad answer on everything about the power of the President will somehow touch on the discretion of the President in granting pardon. That is not tailoring your answer to the question asked.

I asked for a drop of water, you don't have to give me the entire reservoir. If anything, it shows you didn't understand the question enough to be able to sift the pebbles from the sand. Or if you did understand the question, you didn't have the honesty to admit that you didn't have the answer.

He maybe an out-and-out ceremonial figure head with no real powers (incl. clemency pleas) but it doesn't mean his pay should also be a figurehead pay, i.e. a token. That will be a huge insult to a national icon!
His salary is astronomical by any yardstick. It may be raised yet again.:D:D
 
read about Singapore president powers in wikipedia long ago ( not saying article is 100% correct ) but it states that SG President cannot grant pardons for death sentences or any offenses at personal discretion but must act on cabinet advice.

SG president role in constitution is to listen and exercise his powers on cabinet advice on most matters. This should be same for all parliamentary system.

think Mr Ravi know but is just trying to find a "loophole" in our constitutional framework for his client.
 
Yes, you are right. This is pretty much the norm everywhere and there will be constitutional crisis if the President acted differently. It also applies to all duties relating to nominal heads of state.

Well done M Ravi for the JR taken on our DP & Presidency.

But my main point here is regarding our Elected President & National Reserve.

Since the High Court had found that Elected President had no power to pardon, and that power is only with the famiLEE LEEgime's cabinet, a much BIGGER and more IMPORTANT question arose on our National Reserve which is supposed to be under the Presidential control.

Is that yet another Huge White Elephant that president can not make independent decision on the use of reserve, or is he again just acting like a robot manipulated by the famiLEE LEEgime cabinet?

This is not anything less crucial than death penalty.

Had Singaporeans been deceived again that the Elected President is REALLY the 2nd Key in control of our National Reserve? I say it is absolutely necessary to have another Judicial Review to determine the exact power the Elected President have in this important function besides pardons.

I have been reading his many comments for some time now. He has some knowledge, I would dare say more than that of the average person. But he has no wisdom and absolutely no humility. This much is obvious from his postings. Sadly, many Sinkies are also like him, they know a little and suddenly, they think they are far better than everyone else. That is why many Sinkies are a laughing stock when they venture overseas.

Besides, if they don't pay the President $3.8M, how to justify paying the other symbolic MM, SMs their many millions too?
 
I am amazed how blur you are. Heads of State is a figure head unless it is Presidential System. Its the same all over the world. Why you think that no good people are interested in running for the office as it is a rubber stamp. The Queen of England has absolutely no power . Where the head of state acted differently as in Australia, it led to a constitutional crisis. Laws were subsequently introduced to fix it.

People like Ravi have must realised that there are enough ignorant people that he could use the "caught off guard" trick.

What however is true is that clemency is pretty much a treasured mechanism which must be used in extreme cases. It should not reside with the Executive but with an independent clemency board. In that way, it exercise as check against any abuse or unusual circumstances. Clemency board however would not take into consideration on attributes such as youth, changed to a living monk bullshit.

I do hope you realise that people are using Ravi to line their pockets from NGO funds. This is not the first time that this lawyer has been used by others in this manner. The late Senior Counsel Palakrishnan was asked by the legal fraternity to counsel and guidehim when they became aware of him. That has gone with Pala's death. He is now being used again. They are providing funds to him but they are keeping the bulk of the funds. Before his last admission to IMH, he sent a distressing email to these leeches to leave him alone as he his practice was disintegrating.

I have no love for this despotic govt and the idiot and philandering Shanmugam but I also have no time for idiots and ignorant people who have no idea what is the issue. I am stunned that people have no clue that the Head of State is a figurehead.




This matter had been fermenting for quite some time, and now after Stevie Jong has spoken you seem to offer everyone of us the impression that you "knew the law" even before the pronouncement was made. You knew the law better than many lawyers, including M[ental] Ravi, who apparently were "caught off guard" by Stevie Jong's decision.
