TWO brothers were sentenced to hang for murder on Tuesday, capping a long-running trial that was heard for nearly 100 days spanning three years, marked by many twists and turns. The High Court found both Ismil Kadar, 40, and Muhamad Kadar, 33, guilty of killing Madam Tham Weng Kuen at her Boon Lay flat on May 6, 2005, while they were trying to rob her. Madam Tham died from more than 110 stab wounds. According to their statements to the police, Ismil was the one who stabbed Madam Tham while his younger brother looked on. In court, their lawyers challenged the admissibility of these incriminating statements. But Justice Woo Bih Li ruled that they were admissible as evidence.
When Muhammad took the stand, he did a dramatic turnaround and exonerated his older brother, saying he was the only who committed the crime. He said he had lied to the police in blaming his brother. Ismil had maintained that he was not at the scene. But on Tuesday, Justice Woo found that both men were at the crime scene at the time. Although he could not conclude who had dealt the fatal blows, both men were liable under the law. He said that Muhammad's statements to the police were damning against his brother.
