London bus driver who knocked down S'porean cleared of all charges

SINGAPORE - The London bus driver who knocked down Singapore student Tan Mingwei in a hit-and-run accident was cleared of all charges on Wednesday.

Bus driver thought he had hit a fox
Student killed in London after hit-and-run accident
Tan, 20, was found with serious injuries at around 2am, after being dragged for about a kilometre by the bus, driven by Iranian-born Shahriar Firouzian.

She was hit while crossing from Fleet Street to Pond Street in Hampstead, north-west London on September 30, 2010.

Firouzian was subsequently arrested and charged with causing Tan's death by careless driving. The prosecution alleged that Firouzian failed to keep a proper lookout for pedestrians who could have been crossing in front of his bus.

However, the prosecution later said there was not enough evidence to convict the 52-year-old bus driver, and has declared that they will not seek to take the trial further.

At the time of her death, Tan was a third-year medical student at Cambridge University.

The judge has also stated that there is no realistic prospect of a conviction, and issued a verdict of not guilty today.

Firouzian has argued that he did not cause her death by careless driving, and thought that he had run over a fox that night.

CCTV camera footage also shows that he was driving at only three kilometres per hour when he hit her.

Singaporean student's death: London driver acquitted

The prosecution on Wednesday withdrew its case against Mr Shahriar Firouzian (left), who had been on trial for causing the death of Miss Tan Mingwei after his bus struck her on Sept 30, 2010. -- PHOTOS: COURTESY OF TAN TARN HOW, JNVISUALS

LONDON - The trial of bus driver Shahriar Firouzian came to an abrupt end on Wednesday when the prosecution withdrew its case and he was acquitted of causing the death of Singaporean Tan Mingwei by careless driving.

'After reviewing the evidence on Wednesday, the CPS (Crown Prosecution Service) is satisfied that there is no longer a realistic prospect of conviction and it no longer seeks to take the proceedings further,' said prosecution counsel Hamish Reid.

Mr Firouzian, 52, sighed but was expressionless when Judge John Hillen directed that a 'not guilty' verdict be entered and discharged him from the dock.

His lawyer Chandrakant Solanki said: 'My client is very relieved that this case is now over. It's taken almost two years to be resolved. He's very conscious of the loss suffered by Miss Tan's family and friends. This whole matter has been a tragedy for all parties concerned.'

Firouzian is on trial accused of causing death by careless driving
Prosecution: 'He should have anticipated pedestrians might be in the road'

A Cambridge University student died after being dragged for nearly a kilometre under a double-decker bus - and even stopped to pick up passengers with her lifeless body underneath.
Mingwei Tan, 20, suffered massive injuries after being hit by a N5 night bus in Hampstead, northwest London, driven by 52-year-old Shahriar Firouzian.
But Firouzian was oblivious to the tragedy and only found out about the tragedy when he arrived for work the next day, and told police he thought he had hit a fox.

The medical student's body was found lying in the road in Haverstock Hill after the crash, around 825m from where her shoe came off in Pond Street when first hit by the bus.
Iranian-born Firouzian, who has worked for bus firm Metroline since 2003, is standing trial accused of causing Ms Tan's death by careless driving.

Hamish Reid, prosecuting, told a jury at Blackfriars Crown Court Firouzian should have spotted Ms Tan when he turned sharply into Pond Street from Hampstead Road.
'He should have anticipated that pedestrians might be present in the road in front of him', he said.

'Essentially by failing to ensure that he had a clear view in front of him, he fell below the standard to be expected by a competent and careful driver and was driving without due care and attention.
'It is by this failure on his part that he collided with Ms Tan and this caused her death.'
Ms Tan, a medical student at Peterhouse College, Cambridge, and president of the university's karate club, had returned from a holiday with friends to Cyprus late on September 29, 2010.
Friends at university have described her as joyful, talented and enthusiastic.

She took the N24 bus from Victoria Station to Hampstead to pick up luggage from a family friend's house where she was staying, planning to head off on another trip to Rome later that day.
But the third year student was knocked down and died shortly after getting off the N24, at around 1.45am.

Bus driver Shahriar Firouzian, 52, is accused of careless driving after running over 20-year-old Cambridge medical student Ming Wei Tan in London
The court was shown CCTV footage from both the N24 and Firouzian's bus in the moments before Ms Tan was hit.
Mr Reid said: 'Ms Tan is seen walking up Hampstead Road towards the junction with Pond Street, and she crosses Pond Street from the south to the north on the west side of the junction.
'This is at the time when Mr Firouzian is turning right into Pond Street, therefore she is crossing the road directly in front of him.
'He totally fails to see her.
'She is caught by the bus and dragged underneath it towards the offside.'
Firouzian stops to pick up a passenger in Pond Street and then carries on driving up the road, unaware of having hit a pedestrian.
Mr Reid said: 'All this while, Ms Tan is underneath the bus.
'Her body only comes free from the underside of the bus just south of the junction with Belsize Grove, 825m after the point of the original collision.'
Passers-by soon spotted her body lying in the road and called for help, but she was declared dead at the scene.
Firouzian finished his shift and only realised what had happened when he showed up for work the next day, the court was told.
He was immediately suspended and later arrested and charged.

Tragic loss: Miss Tan was a brilliant student at Peterhouse College, Cambridge (pictured), where friends described her as joyful, talented and enthusiastic
In a statement to police, he said he thought he may have hit a fox that night near Belsize Park tube station.
Mr Reid said Firouzian was not breath tested after the crash, but is not suspected of being unfit to drive, on his phone, or under the influence of drink or drugs when the crash happened.
However, he suggested Firouzian may have been looking to his right rather than straight ahead at the exact moment of hitting Ms Tan.
Firouzian, of Harrow Way, Watford, Hertfordshire, denies causing death by careless driving.
The trial continues.

Bus driver Shahriar Firouzian ‘mistook dead body for fox’
A bus driver thought a body trapped under his vehicle was a fox or a bottle, jurors heard.

Shahriar Firouzian did not realise he dragged the body of Mingwei Tan for about 800m (0.5 miles) after his vehicle struck her, it was claimed.
Firouzian knew only the next day that Miss Tan, 20, died when he was suspended by employer Metroline.
Miss Tan, a Cambridge University medical student, was said to have been hit by the double-decker night bus while crossing the road after returning from holiday.
Firouzain, 52, is said to have stopped to collect an elderly woman outside a hospital after the collision in Hampstead, north London.
‘I think it was a bottle left behind the hospital when I picked up an old black lady,’ he told police. ‘I think it was a fox just after Belsize Park rail station.’
Hamish Reid, for the prosecution, said there was no suggestion the bus driver had intended to kill Singapore-born Miss Tan, who was living in north London.
Firouzain, from Watford, denies causing death by careless driving in the incident on September 30, 2010.
The trial at London’s Blackfriars crown court continues.

Jury discharged in bus death trial

The jury in the trial of a bus driver from Watford accused of killing a Cambridge University medical student and dragging her body under his vehicle for more than half a mile in London has been discharged.
Shahriar Firouzian, 52, was charged with causing the death of Mingwei Tan by careless driving.
Blackfriars Crown Court in south London was told there was no realistic prospect of a conviction and a verdict of not guilty was formally entered by Judge John Hillen.
Miss Tan, 20, was hit by a night bus as she crossed the road in Hampstead, north London, in the early hours of September 30, 2010.
Firouzian, of Harrow Way, Watford, denied the charge, saying he thought he had run over a bottle initially and then a fox.
The court had been due to hear evidence from Firouzian, but prosecutor Hamish Reid told the six male and six female jurors that the Crown Prosecution Service (CPS) had conducted a review and decided not to proceed with the case.
The judge told the jury that "no doubt there will be a review" into the case by the CPS.
Miss Tan, who was from Singapore and lived in north London, had arrived at Gatwick airport at 11pm on September 29 2010 after a holiday in Cyprus with friends.
She was then travelling to west Hampstead to collect luggage from a family friend and was due to catch another flight later to Rome, Italy, the court was told.
Miss Tan was found beneath the bus some 825m along from where she had been crossing the road at Pond Street. She died of multiple injuries, a post-mortem examination revealed.

it is early in the morning, bus are extremely loud, no one jaywalk in front of bus, especially when they can hear it coming from a mile.

when he felt he hit something, even a fox, he did not stop to check under the bus.

the muslim loving metropolitan police are too busy with queen jubilee and olympic to properly investigate the matter, the family should sue him and his bus company.

Family of Tan Mingwei accepts London court ruling

SINGAPORE - The family of a Singaporean student killed in a hit-and-run accident has accepted the ruling of the London court, which cleared the bus driver of all charges.

According to media reports, Tan's father, playwright Tan Tarn How, said in a statement that the matter had run its course and what happened was an accident.

Mr Tan added that the family does not bear any ill feelings towards Mr Firouzian or anyone else, and he thanked the many people who have helped the family for their support.

Tan was hit while crossing from Fleet Street to Pond Street in Hampstead, north-west London two years ago.

At the time of her death, Tan was a third-year medical student at Cambridge.
