警方表示,前日(15日)收到路政署轉介關於港鐵剪短鋼筋事件,已交由西九龍總區重案組接手調查,目前沒有任何補充,強調警方會盡力全方位、多角度地調查,不會等待政府獨立調查委員會的調查。

中科興業昨發表聲明,指港府應按規管工務工程承建商的《承建商管理手冊(修訂版B)》中第五點一三條,第十、十三、十四、十五及十六款的條文,就涉事承建商就蓮塘/香園圍口岸工程的傷亡事件被粉嶺裁判法院定罪,以及紅磡月台「剪筋」事件,執行手冊中的行政措施,「作為執行者,不應漠視其條文上的責任,亦不應借轉移沒有結果的調查而置身事外!」
根據發展局網頁資料,該份手冊列明當承建商涉及因違犯勞工法例被法庭定罪、事件涉及公眾利益和公眾安全、於公共或私家工程中涉及嚴重差劣表現,及對工人、分判商等欠缺誠信,發展局局長有權將涉事承建商剔出「認可公共工程承建商名冊」或「供應商及專門承造商名冊」,亦可暫停資格、降級等處分。發展局在處分前須給予足夠警告,解釋原因,並讓涉事承辦商申辯。
翻查資料,粉嶺裁判法院今年五月初,就二○一六年十一月蓮塘/香園圍口岸工程中工作台倒塌導致一死三傷事件,判處工程承建商禮頓罰款十萬元。

港鐵昨午將沙中線紅磡站擴建月台鋼筋接駁造假初步調查報告,上傳至沙中線工程網頁。報告以英文撰寫,全長四十六頁,但無法解答誰剪短鋼筋。報告指,港鐵會見十九名現職及前港鐵員工、三位總承建商禮頓人員,以及二判商「泛迅建築」及「中科興業」的代表,據所有被訪港鐵員工憶述,無人曾目睹「剪筋」,但有兩位駐地盤職員稱自己曾看見、或有人向他們匯報剪短鋼筋的證據,例如鋼筋螺絲頭與連接器的接駁位有縫隙、或鋼筋螺絲頭部分末端被剪短。

報告指,禮頓代表稱不知道「剪筋」及鋼筋不能扭入螺絲帽的事情,但泛迅代表說所有鋼筋修正皆按照禮頓及港鐵程序,鋼筋難扭入螺絲帽,他們會向禮頓報告,並要求禮頓解決,某情況下禮頓會要求將鋼筋剪短以扭入螺絲帽。據了解,禮頓派出三名負責項目的非外籍職員與港鐵會面,態度「不算合作,亦不算不合作」,當中兩人稱收到「中科興業」電郵才知道有人「剪筋」,另一人稱是看報道才知。

港鐵亦將被剪短鋼筋數目修訂至不多於十七條,又稱禮頓再三確定工程符合法定要求,並有全日及持續監督鋼筋接駁工序,港鐵則按規定檢查其中兩成接駁組件。消息指,港鐵對「關鍵檢查點」制度有信心,強調工程肯定無問題才簽名;對於未能查出「剪筋元兇」,消息稱現時未能對任何人士有指控,「唔可以評論禮頓叫二判商剪」,但估計是「工人貪方便先咁做」,強調不是偷工減料,「因為冇人有錢落袋。」
馬時亨承認通報機制有問題
港鐵主席馬時亨承認事件反映通報機制有問題,已責成管理層及項目負責人檢視及改善,港鐵亦已委任獨立顧問測試紅磡站月台擴建工程,亦會全力配合港府獨立調查委員會,若有任何違規違法會送官究辦。
據悉,港鐵檢討通報機制將包括沙中線土瓜灣站「削筋」事件,事件沒有人報告給工程總監黃唯銘,「削筋」牆厚八吋屬分隔牆,削走的鋼筋並不受力,「但都係漏招,所以要徹查。」
禮頓建築於一九六二年成立,七五年起涉足亞洲,業務包括建築、土木工程等,禮頓亞洲總部設於香港,禮頓與UGL同屬一個集團,而UGL亦捲入梁振英被指收款事件。禮頓在港負責多項重要基建工程,由早年的輕鐵,到現時的港珠澳大橋、中環灣仔繞道、蓮塘香園圍口岸、高鐵、東九文化中心、將軍澳藍田隧道等也有份參與。

港鐵昨提交沙中線紅磡站擴建月台「剪筋」事件初步調查報告,但抽走了工程二判中科興業所作的口供;路政署前日收到港鐵提交相關口供後認為事件或涉及刑事,於是報警。

警方表示,前日(15日)收到路政署轉介關於港鐵剪短鋼筋事件,已交由西九龍總區重案組接手調查,目前沒有任何補充,強調警方會盡力全方位、多角度地調查,不會等待政府獨立調查委員會的調查。
指另涉蓮塘口岸工傷遭定罪
中科興業昨發表聲明,指港府應按規管工務工程承建商的《承建商管理手冊(修訂版B)》中第五點一三條,第十、十三、十四、十五及十六款的條文,就涉事承建商就蓮塘/香園圍口岸工程的傷亡事件被粉嶺裁判法院定罪,以及紅磡月台「剪筋」事件,執行手冊中的行政措施,「作為執行者,不應漠視其條文上的責任,亦不應借轉移沒有結果的調查而置身事外!」
根據發展局網頁資料,該份手冊列明當承建商涉及因違犯勞工法例被法庭定罪、事件涉及公眾利益和公眾安全、於公共或私家工程中涉及嚴重差劣表現,及對工人、分判商等欠缺誠信,發展局局長有權將涉事承建商剔出「認可公共工程承建商名冊」或「供應商及專門承造商名冊」,亦可暫停資格、降級等處分。發展局在處分前須給予足夠警告,解釋原因,並讓涉事承辦商申辯。
翻查資料,粉嶺裁判法院今年五月初,就二○一六年十一月蓮塘/香園圍口岸工程中工作台倒塌導致一死三傷事件,判處工程承建商禮頓罰款十萬元。
質疑路署拖延時間令證據流失
中科興業又指,港鐵報告列明工程大判禮頓就工程發出合格完工證明書,而負責紮鐵及層板鋼筋接合的二判泛迅,更指控禮頓指示其剪鋼筋,反映事件中有人涉嫌全局知情,而且是涉嫌元兇,更涉嫌一再欺騙港鐵。中科興業質疑路政署為何不以上述內容報警,反選擇該公司被港鐵拒絕採納的口供報案,中科興業認為其口供被港鐵拒絕採納後,已淪為法律上的「傳聞證供」,不會被刑事調查接納,因此批評路政署報警是「行政上的嚴重疏忽和失誤」,並懷疑署方保護個別責任方,並以顯然沒有結果的調查拖延時間,期間可能令大量證據隨時間流失。
律師:倘找到目擊證人有力起訴
律師黃國桐表示,所謂「傳聞證供」只是法庭不會採納,並不影響警方調查,他認為只要警方找到「剪筋」目擊證人,而證人亦理解「剪筋」的目的,再輔以專家證人口供,便有足夠證據可考慮提出起訴。
