Dad jailed 45 months for sexual abuse of step-daughter during her growing-up years

A 50-year-old site supervisor was found guilty of seven charges of sexually abusing his step-daughter when she was aged between 11 and 15 years old.

SINGAPORE - A 50-year-old site supervisor was found guilty of seven charges of sexually abusing his step-daughter when she was aged between 11 and 15 years old.

District Judge Lee-Khoo Poh Choo sentenced him to 15 months' jail for each charge. The jail terms for the first three charges are to run consecutively for a total of 45 months.

The offences were committed between September 2005 and March 2010 at the family's Bukit Batok flat.

He first got to know the California-born girl in 1999 when she was five years old. He was introduced to her unwed mother the preceding year in Singapore.

The man, a Malaysian and a permanent resident here, married the girl's mother in 2002 and moved in to her flat. The couple have two daughters from the marriage.

In her evidence, the victim, now aged 22, said she did not inform anyone initially of the sexual abuse until March 29, 2010, when she disclosed the matter to the school counsellor.

She wanted to protect her younger sisters and did not want her stepfather to abuse them too.

But she was reluctant to make a police report until she was convinced by the school principal because she did not want her stepfather to go to jail.

The defence argued the victim had fabricated the allegations because she was angry with her stepfather who had punished her for the high phone bill in September 2009.

The judge, in decision grounds issued on Wednesday (Nov 23), found the victim to be forthright, credible and consistent having observed her over six days of testimony and having heard the evidence of several persons who interacted with her, including doctors, counsellors and her mother.

The stepfather is currently on bail pending his appeal against the conviction and sentence.


 

Maid who punched employer's son jailed 4 months

After her employer scolded her, an Indonesian domestic worker punched the woman's two-year-old son.

She punched his head three times and hit it once with a wooden toilet brush.

Yesterday, Ayunda Lestari Dayuki, 24, was jailed for four months after admitting to ill-treating the child at a Bukit Batok flat by wilfully doing an act which caused unnecessary injury.

A district court heard that Ayunda started working for the family in September last year, helping with household chores and also taking care of the victim and two other children.

On Sept 21, her 36-year-old employer checked the closed-circuit television footage of the flat when she was at work. She caught Ayunda sleeping in the living room when she was supposed to be taking care of the boy. She then called the helper and scolded her .

The next day, her husband discovered a reddish mark and swelling on the back of the boy's head.

Investigations showed that on Sept 22, Ayunda hit the boy when he refused to bathe and started to cry. She punched the back of his head three times and used a toilet brush to hit it too.

A doctor's examination found a swelling on the back of his head.

Deputy Public Prosecutor Kumaresan Gohulabalan said the victim was hit on a vulnerable part of his body. He said the offence was not easy to detect as Ayunda had committed it outside the view of the closed-circuit television camera. He asked for a sentence of at least three months' jail to be imposed.

When Ayunda urged District Judge Salina Ishak to impose a light sentence, the judge asked: "You are not even remorseful for what you have done?''

Ayunda replied through an Indonesian interpreter that she was remorseful for her "silly acts''.

Her sentence was backdated to Sept 26. She could have been fined up to $4,000 and/or jailed for up to four years.

Prosecution has not proven its case beyond a reasonable doubt, says judge

A senior executive with Bloomberg was acquitted yesterday of molesting his former Filipino maid after an 11-day trial.

Indian national Nitin Jaiswal, 44, had claimed trial to using criminal force on his 43-year-old domestic worker by kissing her on the lips and touching her breast at Casuarina Cove condominium in Tanjong Rhu Road at about 8am on Feb 18 last year.

District Judge Salina Ishak said there were inconsistencies and gaps in the cases put forth by both the prosecution and defence.

But in clearing Mr Jaiswal of the charge, she said she was not satisfied the prosecution had proven its case beyond a reasonable doubt.

"While I am not fully convinced that the accused was wholly truthful... what matters is that ample doubt, which has crossed the threshold of 'reasonable doubt', has been raised," she added.

The judge said she did not find the victim's evidence "unusually convincing" in view of inconsistencies in her testimony.

The court heard that Mr Jaiswal had returned to Singapore from Mumbai, India, on Feb 18. He was due to fly off to Melbourne, Australia, the same day to join his wife and two children.

He took a taxi home. The maid, who had been working for the family for three years, was alone. She served him tea in the living room.

The maid alleged that Mr Jaiswal molested her after she gave him a massage. She told a neighbour about the incident before Mr Jaiswal returned home with his family from Australia, and also told Mrs Jaiswal one day after the family returned home on Feb 24 that year.

The maid left the apartment three days later with her work permit and her passport while the family was not at home. She lodged a police report on Feb 28, stating that she was molested on Feb 19.

The defence case was one of bare denial and that the maid, motivated by money, had made false allegations against Mr Jaiswal.

She had owed Mrs Jaiswal the advance salary of $1,100 she received before the family left for Australia and she had planned to extract more money from him with this allegation, said the defence.

The prosecution submitted that the victim was a forthright and candid witness who gave a consistent account of the massage and molestation, and maintained it under cross-examination, and that, unlike the victim, the regional head of sales' evidence was evasive and inconsistent.

Mr Jaiswal said through his lawyer Christopher de Souza that he and his family were fully vindicated.



 

Man fined $2,500 for hurting another


Afendoulis last month pleaded guilty to an amended charge of grabbing the victim’s neck and pushing him against a wall. Besides being fined, he had to compensate the victim for his medical fees.

While he was engrossed with reading the e-mails on his phone, New Zealander Stefan Paul Afendoulis, 48, got into a collision with Mr Toh Peng Hwee, a teacher, causing a "tangling of legs".

Afendoulis, a Singapore permanent resident, grabbed Mr Toh's neck and pinned him against a wall at Safra Yishun McDonald's in Yishun Avenue 4 at about 8am on Aug 12, 2014.

He stopped only when other parties, including his wife, shouted at him.

Yesterday, the company director was fined $2,500 and ordered to pay $57 compensation to Mr Toh, now 43, for his medical expenses.

Afendoulis had initially claimed trial after being originally accused of grabbing Mr Toh's neck and knocking his head against the wall repeatedly.

After a seven-day trial, District Judge Luke Tan amended the charge to that of grabbing the victim's neck and pushing him against a wall.

Afendoulis then pleaded guilty to the amended charge last month.

The court had heard that a commotion broke out after the two men bumped into each other.

Afendoulis claimed that Mr Toh tried to grab his arm while he was walking away.

He then grabbed Mr Toh's neck.

Deputy Public Prosecutor Michael Quilindo said although the victim's injuries were not particularly severe, Mr Toh was "throttled", causing him to have difficulty breathing.

He was attacked at a vulnerable part of the body with no chance of retaliation.

He added that Afendoulis showed no remorse immediately after the incident and flaunted his wealth to the victim, saying he was able to hire a lawyer.

The prosecution witnesses had testified that Afendoulis said this with an arrogant tone.

The DPP said there was no reason for Afendoulis to have behaved in the way he did with a complete stranger.

"His actions were disproportionate to any perceived threat and the prosecution submits that the accused's claims of acting 'defensively' should be wholly rejected," he said.

Afendoulis' lawyer Shashi Nathan said his client, a father of two, would have been willing at the outset to plead guilty to the present amended charge.

He was forced to claim trial because the original charge had stated that he repeatedly knocked the victim's head against the wall.

Afendoulis' lawyer said his client grabbed the victim's neck and pushed him against the wall to hold him there as he believed the victim was about to assault him.

The maximum penalty for causing hurt is two years' jail and a $5,000 fine.

A 23-year-old Malaysian was charged yesterday with the murder of a cleaning supervisor at Tanah Merah Ferry Terminal last month.

Ahmad Muin Yaacob is alleged to have committed murder by causing the death of his colleague, Madam Maimunah Awang, 54, at the ferry terminal in Tanah Merah Ferry Road between 9am and 1pm on Nov 24.

Muin was arrested by the Malaysian police on Sunday following a warrant of arrest issued by the State Courts. He was handed over to the Singapore police the next day. Madam Maimunah's body was found in a 2m-deep drain at the terminal, behind a substation near her rest area. The gold jewellery she usually wore was missing.

She had injuries on her neck and bruises on her abdominal area.

Muin, who was unrepresented, said through a Malay interpreter: "If I cooperate with the authorities, can I not face the death penalty?" District Judge Christopher Goh told Muin that it was not up to him to decide.

Muin will be remanded for a week for investigation. The case will be mentioned on Dec 28.

If convicted of murder, he faces the death penalty.


 
MMA instructor jailed for child porn, having sex with underage girls in Singapore

SINGAPORE: An American mixed martial arts instructor was jailed for four years by a Singapore court Thursday for having sex with underage girls and possession of child pornography.


Joshua Robinson met two Singaporean girls online, court documents showed, and pressured them into having sex with him.

“There is no doubt in my mind that in doing what he did, the accused was a sexual predator,” district judge Crystal Ong said in handing down the sentence.


“The law must come down hard on such individuals so as to specifically deter them from re-offending and also to deter others from committing such acts against vulnerable young persons.”


Both victims were only 15 years old at the time of the offences, which occurred between 2013 and 2015. The age of consent in Singapore is 16.
In both cases, Robinson filmed himself performing sex acts on the girls before having unprotected sexual intercourse, the court documents said.


One of the victims had a “mental breakdown” shortly after their encounter in June 2015 – three months after she first started chatting with Robinson – and told her parents, who made a police report.


Robinson pleaded guilty last month.


Detectives who raided Robinson’s Singapore apartment found close to 6,000 obscene films in his possession. More than 300 of the films featured children.


Robinson is also accused of showing an obscene video to a six-year-old child whose father attended his gym. The girl later told her mother about the incident and a separate police report was filed.--AFP

Five Indian nationals, who were part of a syndicate, were jailed on Monday (April 24) for making fraudulent goods and services tax (GST) refund claims involving up to $167,253.53 between January 2015 and May last year.

To date, only $5,434.95 worth of tax refunds made to the five men have been recovered.

Foreigner in sg caught taking nude videos of pinay flatmate

A Filipino, Villalobos Ruel Salazar, 39, was jailed 4 months for taking nude videos of a Pinay flatmate while she was showering. He had taken a total of 10 videos during the time he was living with her and 3 other Pinays in a flat at Telok Blangah.
Salazar also admitted that it first started when he took a upskirt video of the victim from under the table while they were eating dinner with their Philippines countrymen. Salazar said he did this because the woman did not wear a bra and that caused him to become aroused. This motivated him to take more upskirt videos of her and he also recorded her showering. He would then upload the videos onto his company laptop for private viewing.

Salazar ended up paying the victim over $28,000 in compensation and sent her a letter apologizing for his actions. He was also sentenced to 4 months in jail.
