This is an interesting news for TR to comment about the irresponsible and traitorous PAP's Department Ministry Of Manpower (MOM) which should be charge in court for treason (for siding with a foreign crook)...

Blacklisting companies shouldn't be so easy

WE SACKED an employee who was an S-Pass holder after she was caught stealing money from our shop. Subsequently, the Ministry of Manpower notified our company that it was under investigation for a possible breach of the Employment Act, as the sacked employee had filed a complaint against us.

We met the investigating officer and furnished the information required. But subsequent attempts to contact that officer again were unsuccessful and there was no follow-up.

On Oct 1, while processing the renewal of an S-Pass for another worker, we were told that our company had been blacklisted, the officer involved in our case had resigned and that there was no replacement yet.

In the meantime, the worker seeking a renewal of her pass had to leave the country, pending the resolution of the previous case and the appeal on the renewal.

On Oct 7, we wrote again to the ministry, asking for a clear and early resolution of the case, as well as to find out who we could liaise with on the matter.

We are still waiting.

It is surprising how easily a company can get blacklisted because of a complaint from an errant worker. The ministry has also been unsympathetic and unhelpful.

Shouldn't there be a quicker way to resolve such problems?

Who ask the company to employ foreigners in the first place? If the worker is Singaporeans, the company won't end up in such dilemma.

I have witnessed many such incidents involving foreign workers. They always tell you they wanted to go home to pay sick parents a visit or having ailing siblings or wife suddently pregnant or any damning reasons trying to leave Singapore, after milking enough, and left behind shit for others to clean up. Thereafter they just dissappeared without a trace and nobody knows if he is dead or alive. We even caught one of them returning to Singapore with fake particulars, name, and eventually caught by MOM and blacklisted. Now that Singapore has 1.5 millions of them, it will certainly bring many companies down who tried to employ them. It is a matter of time only and many local bosses were bitten by foreigners and regretted now.

What the employer did wrong is, did he report this employee to police when they discovered her stealing money? If they had a police report, MOM would not blacklist them like this.

You ever hear companies sack foreign workers and deduct their pay near their payday because they don't want to pay them? All kinds of stories, so we must see what happened before we give our judgement.

It's the worker's words against them now. And the worker may also complain to their Embassy. So next time, mercy put 1 side, cover own backside.

Who knows maybe there wasn't any theft at all and that's why no police report made. If there was a police report, the writer would have stated in this letter to ST forum.

Also the gist to this letter is S-pass holder really get the S-pass salary boh? This S-pass holder could have complained that she only get $1200 per month and MOM really went in to check and investigate.

Sometimes if do wrong, don't keep digging, if not the tables will be turned back.
 
When you found out your FT pet making silly mistake like stealing money, catch him , make him or her sign a understaking that she is being made to resign because she has made a grave mistake , if she or he is unwilling to sign, you can report to police and proceed for a criminal prosceution. Cancel the S pass as soon as possible. See this FT will be able to stay in Singapore for another fewmonths pending investigation. They will be issued a special white card for them to stay in Singapore pending investigation. The employer never learn from the case where a whereby the Investigation officer is being reported by the FW or FT for taking bribe from her. THe officer got the sack and the FW continue working. Send the money back.

Last but not least, if you are a employer employing a S pass holder paying them less then 1800, you must be prepare submit paper work saying that he is indeed paid 1800. Never let your FT pet hold on to any important document pertaining to your company. If MOM has to black list your company, MOM must have some documents to show for it.

Used them , but u must know how to protect yourself. They come frrom different land and culture. Their life is much less valuable then you.

1. When the co sacked the employee, did they pay her the last month salary + OT if any (usually co don't pay OT to S-Pass holders).
2. Did the company pay her all unconsumed annual leaves
3. Did the company pay her back all her claims - Medical / transport etc..

MOM will not be interested in hearing the Co's story about the employee stealing from the Co. If they had any evidence at all, they would have gone to the police and the whole matter will be so much easier.

MOM is only interested about the above 3 items as they listen to crap stories by rogue employers every damn day..

How do I know all these, once upon a time it happened to the co I worked for too, the boss ask the HR manager (whom is my lunch kaki) to file a fictitious police report on a foreign worker for theft, lack of evidence the HR manager did not want do it and he was subsequently being sacked..:confused:

So the real question is, what is MOM going to do these rogue companies instead??:rolleyes:

I had no wish to be judgmental, the fact here is in all fairness the least the ministry could do is to respond and not avoid subsequent follow up. The officer involved had resigned is hardly an excuse in the first place.

Sometimes its better to have no response than to have someone responding with all the dirt being digged out.

Anyway for this issue, I would think there are certain things being withheld that we do not know, and who knows maybe before they respond, they are doing all the relevant checks with all the govt depts 1st. CPF, ICA, Bank checks.

This particular employer is seeking a response, he doesnt seem to have any qualms on what that is to follow.

The ministry should have the decency to provide and not deny him a satisfactory answer. If investigation is not concluded then on what basis is the company blacklisted for.
