The doubt is that the father is not convinced from the video that Benjamin touched the girl 's buttock.

He only can see that the boy brush the skirt of the girl.

I believe it is possible that the boy brushed the skirt while the girl perceived that he touched her body.

This is a possibility. Unless the video can show it clearly and the father cannot deny the truth of it, then it is not a credible piece of evidence to incriminate the boy. For all we know, it may be an accidental brush with the skirt which the girl thinks that the boy touches her buttock because the skirt feels different with the tug. The girl is 11 years old. It is possible that she cannot tell the difference between a tug on the skirt and a touch on the buttock, is it not ?

If the video is able to show very clearly that the boy touches the girl's buttocks, the father cannot , I repeat cannot, even say that his son touches her school bag only. You understand ? It is a perjury of court when you deny the clear evidence presented in court. But if it not, and the video lends itself to different interpretation, it cannot be submitted as a credible piece of evidence.
