Yes, only police case can send you to jail. Police cannot collect court costs and the PP lawyer is paid by tax payers money.
But breaching the injunction is police case. Her adversary is using injuction as a double-edged sword to turn it into a police case to send her to jail. Be wary. Using injunction is like laying mine bombs for her to step on. Once breached she goes to jail.
Best thing for her is to take her mother to court, the KP, and her other siblings will have to think twice of putting her on the witness stand and if she lied underoath is committing crime of Perjury (Sec 3 of the Crime Act). Put the duress back to the other siblings. Their lawyer have to think twice of putting an old lady for committing crime of perjury and loses his practice license if he proceed. Lawyers will be forewarn by the court anyway.
Go for the jugular of the lawyer too. These crooks are often breaching their code of practice and conduct and OB markers as a trained lawyer. Time to tell these crooks to behave well and not put adversaries under duress. Can get back at the lawyers for fraudulent misrepresentation of their case, report them to tax office for tax purposes if they overcharge. End of the day they are in business and must pay tax too like anyone else.
Complaint them to AG office for fraud, misleading, duty of care and OB markers and give them load of shits and busy facing their own fraudulent business dealing with their clients.
It is like taking a paid bus ride to the city. The bus driver is a license holder to drive a big trasnsport vehicle to carry >100 passengers on brhalf of the bus owner. He has to drive with duty of care and trained on his role as a bus driver and only take specific innstruction from the owner and the authority. If he breached his role he will have his licence rovked by the authority. He will be suspended and a bad track record on his name.
Dear Wendychan,
The Courts do NOT grant INJUNCTIONS that easily. It has to go through the points raised and rebutted in the affidavits.
You need not worry at all.
This is a CIVIL suit.
NO ONE HAS THE POWER TO SEND YOU TO JAIL.
Our Judges are Fair.
You will get JUSTICE.
