Auditor-General finds 'major lapses' in Workers' Party-run town council accounts

That's because the dumb voters didn't realise at the time just how fucked up they really are. The truth is now in the process of being revealed. The incompetence of the WP has been laid bare for all to see.

Well it still happened. Voters also gave PAP lower percentages in other wards.

I asked for payment for work done, I certified work was completed satisfactory, I approved payment to myself. How Weng Fan's company, FMSS & FMSI, provide a service to AHPETC and then send invoice to the TC.

At the TC end, she herself certifies that the job is fully completed and confirms payment, and then gets her husband, Danny Loh, to co-sign the cheque.

Note that the AGO only audited the management process. Checking for corrupt practices or misappropriation was not within its ambit.

"The Auditor-General's Office (AGO) found that AHPETC did not have the necessary checks and balances in payment to related parties. PwC observed 84 invoices amounting to $6.61 million from FMSS and FMSI which were issued and signed by the General Manager and Secretary of AHPETC in their roles as director of FMSS and owner of FMSI respectively. Of these, 11 invoices amounting to $1.69 million were certified (for work done) by the General Manager on behalf of AHPETC and 9 invoices amounting to $264,000 were verified by the Deputy General Manager who is a shareholder of FMSS. For these invoices, the General Manager also approved the payment vouchers and / or the cheques before the cheques were handed over to the cheque signatories for signing. The Secretary was also one of the signatories for some of the cheques."

INTERESTING HISTORY OF AIM PTE LTD

The $2 company, Action Information Management Pte Ltd (AIM), was today (24 Dec) confirmed by Dr Teo Ho Pin, Coordinating Chairman of 14 PAP TCs, as the company which won the open tender to buy the software system, Town Councils Management System (TCMS), developed by NCS for the town councils.

Dr Teo said that AIM was the sole bidder. The software was sold to AIM for $140,000 and AIM in turn, leased it back to each TC for $785 per month. With 14 PAP TCs, the total leasing fee would be $10,990 per month.

AIM was formed on 22 Jul 1991, about 21 years ago [Link].

From this document [Link], we know that Ng Pock Too was the original director of the company. He was appointed the director on the same day that AIM was formed.

Ng Pock Too was the PAP’s candidate for Anson constituency in the 1984 GE. Then, JBJ (WP) beat Ng Pock Too to retain his seat in Anson. JBJ had earlier won in Anson in a 1981 by-election when Devan Nair relinquished his Anson’s seat to become the President of Singapore.

In 1988 GE, Ng Pock Too won in Nee Soon Central and became a Member of Parliament (MP). However, in the 1991 GE, he lost his seat in Nee Soon Central to SDP. Thereafter, he did not stand for election anymore. GE was held on 31 Aug in 1991. So, it appears that about a month before the 1991 GE, AIM was formed with the involvement of Ng Pock Too.

It is likely that Ng Pock Too was also a shareholder ($1) of AIM when the company started in 1991.

On 20 Dec 1991, about 5 months after the incorporation of AIM, John Wong Weng Foo was appointed director of AIM.

John Wong was a prominent IT figure in the 70s and 80s. He was in fact the top IBM person in Singapore then. He left IBM in 1990 to join Hong Leong Group. The following is the detail bio-data of John Wong from Businessweek research [Link]:

Mr. Weng Foo Wong, John serves as General Partner of General Atlantic Partners LLC since 1999. Mr. Wong served as the Group Managing Director of Hong Leong Asia Corporation from 1990 to May 1999. Subsequently, he was a special adviser of General Atlantic Partners. He served as the President of China Yuchai Ltd. and Managing Director of IBM in charge of operations in Singapore, Sri Lanka and Brunei. He has extensive experience in the computer business having held various positions in IBM Singapore Pte Ltd (IBM) from 1970 to 1990. Mr. Wong served as Vice Chairman of China Yuchai Ltd. He has been an Independent Director of Goodpack Ltd since February 28, 2002. He serves as a Director of PSB Corporation, TSH Corp., Singapore Management University, Goodpack System Pte Ltd., Patni Computer Systems. Mr. Wong has been a Non Executive Director of MMI Holdings Limited since November 1, 1999. He has served on various boards including National Computer Board, Singapore Institute of Standards and Industrial Research, Institute of Policy Studies, Institute of Systems Science, Science Centre, American Business Council and the Singapore International Chambers of Commerce, the Singapore Productivity and Standards Board and Singapore Institute of Management. He served as an Independent and Non-executive Director of Asia Dekor Holdings Ltd. since November 1999. Mr. Wong holds a Master of Business Administration degree from Brunel University, United Kingdom and completed Advanced Management Program at University of Hawaii.

So, after John Wong left IBM in 1990, he was appointed a director of AIM the following year.

Then about 7 years later on 1 Jan 1998, Lau Ping Sum was appointed director of AIM.

Lau Ping Sum first contested in 1980 GE as a PAP candidate. He became Yio Chu Kang MP after winning the election. Subsequently he won the 1984 and 1988 elections and continued to be the Yio Chu Kang MP. In 1991, he was part of the PAP’s Ang Mo Kio GRC team and won through a walkover. Thereafter, he stepped down in 1997 and did not contest anymore.

Hence, we can see that not long after the 1997 GE when he stepped down, he became a director of AIM in Jan 1998.

It was not known when Lau became a shareholder of AIM but by 2008, the ACRA data clearly shown that the 2 shareholders of AIM were:

Lau Ping Sum $1
On 30 Jun 2008, AIM changed its auditor to its current C M Leong & Co. It was revealed that prior to this, AIM was audited by Ee Peng Liang & Company, from 20 Jan 1992 to 30 Jun 2008 [Link]. Ee Peng Liang & Company was, of course, an auditing firm founded by Ee Peng Liang, Gerald Ee’s father.

In Mar 2010, for reasons unknown, Ng Pock Too transferred his $1 share to Chandra Das. Also, Ng Pock Too and John Wong resigned from AIM as directors on 1 Mar 2010. Replacing them were Chandra Das and Chew Heng Ching [Link][Link].

Chandra Das became a PAP MP for Chong Boon constituency in 1980 through a walkover. In 1984 GE, he beat an opposition challenge to retain his seat in Chong Boon. In 1988, he was part of the PAP’s Cheng San GRC team and won through a walkover. In 1991, Cheng San was challenged by NSP but PAP was able to win then (Cheng San was now a much bigger constituency than the one in 1988). In 1997, Chandra Das decided to step down.

Chew Heng Ching first won in Kaki Bukit in 1984 GE. In 1988 GE, he contested in Eunos GRC and the PAP’s team barely scrapped through with a 50.9% winning. The opposition team was WP’s Dr Lee Siew Choh, Mohd Khalit and Francis Seow. In 1991, he again was part of PAP’s team in Eunos GRC and won the election again. In 1997 and 2001, he became part of the PAP’s East Coast GRC team and won through walkovers. In 2006, he stepped down from politics.

So, currently, AIM’s 3 directors are (all former PAP MPs):

Mr Lau Ping Sum
Mr Chandra Das
Mr Chew Heng Ching
The shareholders are:

Mr Lau Ping Sum, holding $1 share
Mr Chandra Das, holding $1 share

As disclosed by Action Information Management (AIM) Chairman, ex-PAP MP Chandra Das, AIM is a PAP company. He disclosed this in a statement on 2 Jan [Link]:
“AIM participated in the tender not knowing other companies would not do so. The sums involved in the transactions are modest. But as a PAP company, we wanted to be helpful to the PAP Town Councils. So we were ready to take on the task and submitted the proposals to help the PAP Town Councils achieve their goals.”
Of course, one can surmise that as a PAP company, AIM, likewise, would not want to be that “helpful” to Opposition Town Councils too.
In the termination notice sent by AIM to Aljunied-Hougang Town Council which was duly produced by Ms Sylvia Lim on AHTC’s website [Copy of Termination Notice by AIM], the address of AIM was listed as:

which is also the address of KCS Corporate Services Pte Ltd, a company that provides corporate services to companies [Link].

Also, thanks to another reader who managed to retrieve an archival copy of the Memorandum and Articles of Association of AIM, it can be seen that AIM was originally not founded by Chandra Das or Lau Ping Sum but Ng Pock Too and Lim Boon Heng back in 1991 (see also ‘Interesting history of AIM Pte Ltd‘):


Hence, we can safely say that the termination notice was sent from PAP HQ (PCF Building) through AIM under the instructions of PAP.
And by virtue of Chandra Das’ admission, we can also conclude that both Chandra Das and Lau Ping Sum, each holding $1 share of AIM, are both acting in proxy for PAP.

Did the AG find out why the contract was given to this firm? Why didn't the AG put the reason down in the report?
Secondly, did the contractor overcharge? Did they perform the job within the contractual requirement? The AG didn't delve into that because the report was intended to skewer WP, instead of ascertaining the truth.

What is not mentioned is the 'management fee' charged by AIM. The PAP TCs are losing money on this leasing arrangement.
 
Chandra Das is one lucky guy. If not for Woody, he would have been charged for corruption.

3rd Party related transactions amounting to 25.9M. While independence has to be declared, organizations ensure that those with independence issues do not sign payments or award tenders, to avoid conflict of interest. They will say PAP TCs may have some of these guys who also own companies or Party members. Maybe, but they declare and are excluded from any decisions or signing of transactions or award contracts.

The Auditor-General's report into the AHPETC found that one of the areas of concern was that there appeared to be a mismanagement of conflicts of interests.

In particular, the AGO pointed out that there was a $25.9 million contract between the town council and its managing agent.

However 4 senior town council officers held positions in that managing agent, SM Solutions & Services (FMSS).

In some instances, these four had approved and verified work done by FMSS for AHPTEC.

While the AGO raised this as a concern, it has been pointed out that such practices is not uncommon.

For example, it is common for supporters or members of political parties such as PAP and WP to be appointed to town council postilions or work closely with managing agents.

A PAP example is MR Ho Thian Poh who is the secretary of the Jurong Town Council but also the managing director of the managing agent Esmaco Township Management.






The only difference between this and the WP conflict of interest is that WP did not properly disclose this conflict of interest or have checks in place to manage it.

This means that at WP, some individuals in charge of both AHPTEC and FMSS operations could issue an invoice from one company and approve payment for it from the other company.

There was no need in some instances for a second oversight and this was a point of concern despite there not being any evidence of wrongdoing yet.

In fact, the mere relationship has already been discussed as not a problem as MND minister Khaw Boon Wan explained during the debate on the relationship between AIM and the PAP:

“The [Town Councils] Act by design does not prohibit transactions between the TC and party-related entities or persons… TCs run by MPs from all political parties have at one time or another appointed party supporters or former candidates to provide services to the TCs they run.” – Khaw Boon Wan, 13 May 2013.

Background story: Auditor-General Finds “Major Lapses” in Workers' Party Accounts

The Auditor General's Office has released its report into the Aljunied Hougang Punggol East Town Council (AHPETC) and found that the accounts for FY 2012-2013 have some major lapses.

However, the report has also shown no evidence of wrongdoing, corruption or deliberate misuse of funds.

Instead, AHPETC highlighted that it only shows some lapses or lack of reporting which needs to be fixed.

Sylvia Lim, the town council's Chairman said that they would discuss the report in detail in Parliament when it is filed for a motion.

Responding to media queries in general, AHPETC explained that “The past months since the commencement of the audit by the Auditor-General’s Office (AGO) have been very challenging, as the Town Council (TC) dedicated its limited resources to facilitating the audit, including searching for voluminous information, some collated before the current management took over. This onerous task was undertaken concurrently with running a live operation.”







The AHPETC also shared that the report has been useful in highlighting areas they need to improve on. They also pointed out that the report also showed some mistakes on other bodies including other TCs and HDB.

It agreed that it needed improvements in reporting standards and they said that they are currently working on this issue. In fact, they said that they had already implemented some changes before the audit started.

Overall, AHPETC highlighted that there has been no money found missing and only uncovered mistakes and omission due to "inadvertence, human error, IT system constraints and a lack of experience in dealing with certain scenarios".

I applaude the auditor general for doing an outstanding job.
All must be put in perspective as the high standards are difficult to meet for a newly formed entity like AHPETC but Sylvia Lim will address all issues in parliament.

I believe PAP run town councils have never been subject to auditor general ....they should to help them improve.
