The Islamic party’s spiritual leader, Hashim Jasin, says the punishment is neither cruel nor humiliating.

PETALING JAYA: All states should follow Terengganu’s lead in publicly caning a man convicted by the shariah court for khalwat, says PAS spiritual leader Hashim Jasin.

Hashim said public caning “is not cruel or humiliating” and should be emulated to “uphold and honour Islamic law”, Utusan Malaysia reported.

“(Public caning) serves to raise awareness not only among the offenders, but also among those who witness the punishment,” he was quoted as saying.

“By witnessing the caning, the public will not commit the same offence.

“I believe not only states governed by PAS, but all states should prepare for this (public caning).”

In addition to Terengganu, the other states governed by Perikatan Nasional are Kelantan, Kedah and Perlis.

Yesterday, the Kelantan government said it was considering the possibility of carrying out public caning for shariah criminal offences.

Executive councillor Asri Mat Daud said the state’s shariah criminal enactment that was amended in 2017 already allowed public whipping for certain offences.

Affendi Awang, 42, was caned six times in front of 90 witnesses at the Al-Muktafi Billah Shah Mosque in Kuala Terengganu yesterday afternoon.

The father of five is the first person in Terengganu to be caned in public.

The widower was examined by a medical officer before the caning, after which he was transported back to Marang prison.

The public caning was criticised by groups such as the Human Rights Commission of Malaysia (Suhakam), which accused the Terengganu shariah court of overstepping its jurisdiction.

G25, a group of prominent retired civil servants, also said that public caning contravenes both federal and shariah laws.

Perlis mufti Asri Zainul Abidin said it is feared that public caning for being in close proximity contradicts the intent of shariah law, which encourages concealing the personal shame of individuals.


PETALING JAYA: Perlis mufti Asri Zainul Abidin says it is not unIslamic for Muslims to oppose public caning for those convicted of being in close proximity (khalwat).


Asri said there is no specific rule in shariah law requiring those found to be in close proximity to be publicly caned.


He said it is feared that public caning for such offences contradicts the intent of shariah law, which encourages concealing the personal shame of individuals.

“Therefore, caning someone for khalwat in public is not the law of Allah and His Messenger, but rather a choice of the ruler,” he said in a Facebook post today.


“It falls under ta’zir, which is the discretionary punishment of the ruler and may be right or wrong.

“Thus, opposing this punishment means opposing the ruler’s decision, not the teachings of Islam.

“No one should mistakenly assume that those who disagree with this punishment oppose Islam.”

Asri said while the punishment of caning, without causing injury, for adultery is mentioned in the Quran and Sunnah (way or manner of life relating to the traditions and practices of Prophet Muhammad), it comes with strict conditions and regulations

Hope he can try it first.....as an adult and in Public some more. Then should the one being punished should feel shiok instead?
Even a slap on a 6 yr old kid can induce shaking. Cant imagine if parents were to use a cane.
 
islam bagus. Hashim I believe he is educated from pure islamic school. Malaysia needs more leaders like him to bring the country forward.
