There was another TBT at Toa Payoh Center on May Day 2008 1.May.2008.
There was a TODAY news clip given by CSJ to court which reported that TBT event, which also said that reporter asked the police about this event and police replied that the event was investigated and found that CSJ was merely selling books and T-shirts so that did not fall under mata but NEA aka Yaacob. That mata found this event was not an unlawful assembly without permit but was hawking without permit. This was reported by TODAY.
Deep Singh was questioned by CSJ today, he said his engagement team was activated on 1.May.2008 to Toa Payoh NPC but did not engaged, as Deep Singh decided to throw the that ball to Yaacob's NEA 地牛。(Tee Guu)
Then I have tons of video & photo for both the TBT events on 1.May.2008 as well as 9.Aug.2008, which some had been on my blog since 2008. I can prove that both events are the same in nature and action, and the conducts of the persons involved were the same.
How can one TBT be iLEEgal Assembly while the other is LEEgal?

Since mata Public Affairs Spokesman told media that May Day 2008 TBT was not an unlawful assembly, CSJ did nothing wrong on 9.Aug.2008 (3 months later) by not obtaining any mata permit, because the public statement of SPF mata already (mis)led him to believe so.

Deep Singh admitted on the witness stand today, that he ordered on 1.May.208 no engagement and directed the Tanglin Division Ops Room to inform NEA (Yaacob) and take no further action. He also admitted later that mata's Public Affairs had received query from media and he was being asked by Public Affairs regarding that May Day event, and that was what he told the mata's Public Affairs.

Since mata said so for TBT May Day it was not an assembly but hawking, then TBT NDP2008 is no different because CSJ had wanted to organize identical TBT, so mata had (mis)led him to believe that no mata permit needs to be applied.
For TBT May Day 2008 he did applied by was rejected.
His omission of obtaining a mata permit - if was a violation of law as charged, would be in Good Faith believed to be justified by law in full accordance with Penal Code General Exceptions Sec 79 for TBT NDP2008.
