Posting this on behalf of my buddy -

Hi guys, my friend's motorcycle was invovled in an accident with a Taxi today.

The way he told me, the accident went something like this - he was travelling (with a pillion) when a taxi abruptly cut into his lane (in all probability, trying to reach the U Turn Filter lane), he braked and tried to avoid the taxi but unfortunately, the front left side of his bike hit the right rear bumper of the taxi.

The TP and ambulance were contacted and his pillion and him were conveyed to a hospital. They suffered abrasions on their arms and knees plus an ankle sprain.

The front left side of the bike, where the headlights are, is destroyed. The rest of the bike is fine. As for the taxi, the right rear bumper is slightly dislodged and scratched. The rear lights at that area are also broken.

A police report has been made and the TP IO will get in touch with them soon. However, what they would want to know is will they be able to claim damages from the taxi and will the taxi be able to seek compensation? If so, how much?

They are also interested in seeking legal recourse as the dangerous action of the taxi driver has put their lives at risk. (Have you guys had any similar incidents where a taxi suddenly decided to cut into your lane?)

Nobody died or got seriously injured. Consult accident claim lawyers and insurance companies, and get on with it.
 
It might seem like no big deal, but what if the taxi driver decides to play punk and pull something funny? How do you avoid that?

Simple traffic accident rule:

You hit the bumper = it's your fault.

Doesn't matter if the vehicle in front of you suddenly braked for no reason, or your brakes not working yada yada.

You hit the backside = you are to blame. You can't argue against this in traffic court.

Yeah, always avoid taxi drivers on the road.

But you bump into the taxi. Traffic law is very simple, you lose, you pay as you bump into the taxi.

But depends on the details. Did you take photos?

If you did, upload here. Can analyse for you.

For example, if the dent is a bit sideways and not direct hit into the back, then you got chance.

Your insurance and the taxi insurance companies will nego and you can push for a 50/50, meaning
both share cost. In either case, the taxi's repair cost most likely much more than the bike's repair cost.

Meaning, you claim against your own and the taxi claim against his own insurance.

This is the best result. If your insurance company cannot nego, then call the bluff. Tell your insurance company
you will take the case to court. Sure settle one, I've gone through this before.

Never fear, but next time, stay far away from the taxi or any vehicle in front. Most vehicles cannot see a bike
clearly from the rear view or side view, too big a blind spot as the bike is difficult to see as it's narrow and shorter
than a car.

If you drive a truck or bus, you're the king on the road besides the TP. TP is king of kings on the road. :D

Hope he took many photographs of the scene from different angles. It may help the tough taxi bumper case.

Simple and easy. Motorbike hit the taxi. Motorbike wrong even if the taxi fault unless have video as a proof.
Since there is injury - U need to made police report(no way u can escape because u ride on ambulance event you dont want to make report).
What you can do
1. Police report- because injury
2. Make insurance report(IDAC) attach with police report- claim insurance 1st party because is motorbike fault.
3. Let insurance company settle with the taxi(you dont have to get involve)-taxi will claim u insurance

After that insurance will repair u bike(if you buy comprehensive/1st party insurance), insurance will repair taxi claim against u insurance.
After repair they will ask you to collect bike and sign that all and pay certain amount base on insurance policy(normally $300~$1000).
Insurance premium for next year will be up because no more NCB.

Based on the above highlighted in bold and if they're true, both the rider and the pillion will have a strong case to take up a civil suit against the taxi driver. That's because the damages sustained (left side of bike and the right side of rear bumper of taxi) clearly indicated that it was a side-swipe collision, not a front-rear collision. However, it's adamant that photos of the damage areas on both the taxi and motorcycle, as well as all injuries sustained are well taken as evidence. I encountered a similar case like your friend's before (but against a saloon car and it even occurred on the expressway) and I managed to claim for the full repair of my bike (my bike was insured only for 3rd party, fire & theft), the injury compensation for both my pillion and myself amounting additionally to over S$8,000 and also the full legal fees being borne by them. The defendant's (driver's) insurance company had accepted 90% liability. PM me if you want the contacts of the lawyer whom I'd engaged. He specializes in accident claims. However, I must warn you that the process of claim may take between 10 months to 1 year.

As for legal recourse, our Traffic Poodles are very bias towards motorcyclists as we are deemed as poor man's transportation. So, don't expect too much. In my case, even when I had an independent and willing 3rd party witness (being the driver of the vehicle just behind me), the bloody IO had only issued a warning to the accident driver, not even a fine nor demerit points, even after my appeal. WTFF? And they took 1 year to come to the verdict. He even had the cheek to apologize to me for taking so long in their investigation WITHOUT even conducting an interview with either party nor the witness. What fucking investigation had they done I asked? It's simply that they "cold storaged" the case and then bring it up again after almost 1 year later to give a simple verdict to conclude it. I wrote to him that if they are ever so reluctant to enforce their penalty against errant drivers, there will be even more accidents on our roads and expressways in the future as these recalcitrant drivers will think that they'll get away easily if ever involved in an accident, hence becoming even bolder and reckless than before. And it turns out to be true because nowadays, I'll hear more and more accident reports on our roads every day over the radio. I had even told him that he'll only regret and realizes his consequences upon encountering a death of his relative or next-of-kin whom is riding a bike and gets involved in a road accident.

Taxi drivers are the WORST drivers in Singapore!!!

They dont signal in advance to warn you of their intention,

they only know one signal Hazard Lights when picking up fares!

They will abrutly cut into your lane without signal, when tehy signal they

will just cut into your irregardless of whether you will give way or not!

They cut into your path you knock their rear bumper you're wrong by Traffic rule!!

Taxi driver will claim hell against you! if hey are wrong they will bring few dollars to pay

you expect to settle on the spots!!!

This means two things (assuming) :

1. the cabs aren't theirs (not privately owned) - they rented it from the taxi companies. So, 'bo chup'.

2. taxi companies have their own lawyers and garages to claim high repair charges. So, they can open their mouths wide to swallow you up.
