SINGAPORE: Laws will have to keep pace with changes in societal views and it is up to Singapore's society to decide which direction it wants to take when it comes to legislation on gay sex, said Law and Home Affairs Minister K Shanmugam on Friday (Sep 7).
His comments follow the landmark ruling by India's Supreme Court on Thursday repealing a British colonial-era ban on gay sex.

Under section 377A of Singapore's Penal Code, a man found to have committed an act of "gross indecency" with another man could be jailed for up to two years.
Mr Shanmugam said that while there is a growing minority who want 377A to be repealed, Singaporeans remain "deeply split" on the matter.
“Singapore ... on this issue, it is a deeply split society. The majority oppose to any change to section 377A - they are opposed to removing it.
“A minority - I have to say, a growing minority - want it to be repealed. The Government is in the middle,” he added.

“This issue relates to social mores, values - so can you impose viewpoints on a majority when it so closely relates to a social value system?”
Those comments echo those previously made by Prime Minister Lee Hsien Loong, who had said most Singaporeans would want to keep the statute, and that Singapore society "is not that liberal on these matters".


Mr Shanmugam also recalled how founding Prime Minister Lee Kuan Yew had been “sympathetic” and “expressed his understanding for those who are gay”.
"The law is there but generally there have been no prosecutions for private conduct," said Mr Shanmugam.
"People openly express themselves as gay, you got the gay parade. Police even approved a licensing for it, no-one gets prosecuted for declaring themselves as gay," he noted.
“So really when was the last time someone was prosecuted?”
As for his own personal views on the matter, Mr Shanmugam said: “Speaking for myself, if you ask me, in a personal capacity, personal view - people's lifestyles, sexual attitudes, (we) really should be careful about treating them as criminals or criminalising that.
“But again it will be wrong for me to impose my personal views on society or as a policymaker,” he qualified.
“We live our lives, live and let live. If one side pushes, you will expect a substantial push back.”
Earlier, veteran diplomat Tommy Koh, who is Ambassador-at-Large at the Ministry of Foreign Affairs, had responded to the Indian ruling by encouraging Singapore's gay community to “try again” to challenge 377A. Previous legal challenges in 2014 had failed.

Actually the law is repealed or not is a joke, because what is the point of having the law if it is not enforced? Look at that faggot dot event every year,,,if the law is enforced,,,how come the cops dont arrest the whole lot of them and throw them in jail or have them flogged? But this does not happen,,,and basically faggots dont get caught and thrown into jail. So basically the law has already been repealed. If not Vincent Vijaysingha already thrown into jail

I suspect that PAP can't hold the line anymore with regards to gay issue. They need someone like Pastor Khong from FCBC to spearhead the issue, fronting the issue of NOT repealing the law. It looks good and very legitimate. Why ? Pastor Khong is a consistent throughout with this message of not repealing the law. 2nd, he is a Christian Pastor. Sounds good and legitimate.

2nd thing i want to talk about his PAP leadership. Seems to me Pinky is not quite a leader. His father will have some heads to roll if MRT is not performing. But heck, the Desmond Kuek is being paid millions and finally removed after so many help and resources poured in. Now Tommy koh crosses the line and openly tell the gay community to launch a law suit and assault section through 377. Yes, it is within the legal right of any citizen.

But this shows also the weakness of Pinky leadership ,someone cross the line without seeking permission with the PAP leadership. Has Tommy Koh transfer all his asset to his son and to overseas ? Is Tommy Koh ready or if PAP is ready ?

'Antiquated' law 377A should be repealed: Tommy Koh

SINGAPORE: Veteran diplomat Tommy Koh called again for the repeal of Section 377A of the Penal Code, which criminalises gay sex, in an opinion piece published by The Straits Times on Monday (Sep 24).

The Ambassador-at-Large at the Ministry of Foreign Affairs is one of the prominent personalities to have spoken out against the 80-year-old legislation after India's Supreme Court struck down a similar law early in September.

In Dr Koh's commentary published on Monday - Section 377A: There is a difference between a sin and a crime - he delved into the history of the legislation and scientific studies on homosexuality.

On the scientific evidence for repealing the law, Dr Koh wrote: "Scientific research has shown that homosexuality is a normal and natural variation in human sexuality and is not in itself a source of negative psychological effects."

He cited a World Health Organisation decision in 1973 to delete homosexuality from the Diagnostic and Statistical Manual of Mental Disorders.

"This decision was endorsed by the general assembly of WHO in 1990 when it agreed to delete homosexuality from its list of mental disorders. In WHO's view, being LGBT (lesbian, gay, bisexual and transgender) is not a disease," he added.

He also pointed out that of the 196 states in the United Nations, the majority - 124 states - do not criminalise sodomy. Singapore is among the minority of 72 states which do.

While all the developed, Western countries do not criminalise sodomy, a notable number of Asian territories also fall into this category, including China, Japan, South Korea, Hong Kong, Taiwan, the Philippines and Thailand, he said.

Meanwhile, many of the countries who have a similar law in place were former British colonies.

"Singapore is part of the minority mainly because it inherited from the British a penal code which criminalises sodomy. For a country which embraces science and technology, it is surprising that, on this one aspect, the law has not been updated, in the light of the scientific evidence," he wrote in The Straits Times.

SEPARATION BETWEEN RELIGION AND STATE

In making his argument, he also elaborated on the difference between a sin and a crime: While adultery and fornication are regarded as sinful, they are not "criminal behaviour".

Former attorney-general Walter Woon was "unhappy" with the compromise of "retaining 377A and not enforcing it because it brings the law into disrepute", Dr Koh said.

Addressing the calls of Christian and Muslim religious groups to retain Section 377A, he said: "It is not the business of the state to enforce the dogmas of those religions. In Singapore, there is a separation between religion and the state. Church leaders and Islamic leaders should respect that separation."

He called on Christian and Muslim leaders to refrain from "pressuring the Government to criminalise conduct which they consider sinful".

Laying out court decisions in the US and India which had ruled that laws criminalising sodomy were unconstitutional, he wrote: "In most cases, the antiquated sodomy laws were repealed by the legislatures of the respective states or countries. However, in a few cases, the laws were declared unconstitutional by the courts."

Summarising his arguments, Dr Koh said: "Section 377A is an antiquated law, not supported by science, and should be repealed."
He concluded that the Singapore Court of Appeal should overturn a 2014 decision and declare Section 377A to be unconstitutional.
