The Online Citizen stands in Solidarity with Dr. Pj Thum and The New Naratif - The Online Citizen Asia
Historian and Managing tor of the New Naratif, Dr. PJ Thum has been summoned again for questioning by the Singapore Police yet again over New Naratif’s alleged illegal conduct under s83(2) of the Parliamentary Elections Act (PEA) during the 2020 General Election. The police are interrogating Dr. Thum over five election-related Facebook posts boosted by New Naratif in July 2020.

This is the second time in less than six months that Dr. Thum has been interrogated and The Online Citizen stands in solidarity with Dr. Thum and the New Naratif over this seeming continued harassment of Dr. Thum.

In August last year, this publication highlighted at least 10 violations of election rules that the Elections Department (ELD) had then not yet addressed. This included, among others, a two and a half minute political campaign video introducing PAP MP’s Sun Xueling who contested in the Punggol West SMC. The video included multiple scenes of children who were of preschool and primary school age.

In September, last year, this publication pointed out that if the ELD wanted to investigate Dr. Thum and the New Naratif for breaking out election rules, why was it not also investigating the ruling Peoples’ Action Party (PAP) for also seemingly breaking rules? In the same month, Dr. Thum had pointed out the “double standard” when his house was “ransacked” by four police officers and his belongings confiscated, while no actions were taken against Transport Minister Ong Ye Kung as he posted up a video that involved a child during the elections, displaying propaganda and explicitly breaking the law. Dr. Thum also questioned the need for four police officers to escort the New Naratif founder back to his home to confiscate his laptop when all they did was to seal the device.

These would appear to be acts of intimidation and a form of harassment that is similar to what the Editor of this publication, Mr Terry Xu, had to endure when he was himself subjected to interrogation.

Furthermore in Dr. Thum’s second interview with the Police, he was interrogated for three hours during which the police asked him questions regarding the internal structure of New Naratif, the decision-making and content creation processes, and funding. In particular, police were interested in the duties and responsibilities of the managing director, and who else in the organisation had the authority to make decisions.

“The questions were framed around the boosted posts, but they were completely irrelevant to the actual case, because the wording of Parliamentary Elections Act explicitly makes clear that intention is irrelevant as to whether something is elections advertising, and that the Elections Department (Prime Minister’s Office) has fully discretion to decide whether something is elections advertising or not. I declined to answer those questions as they were not relevant to the investigation”, Dr. Thum said to International Press Institute (IPI).

“I believe the questions to be an attempt to fish for information regarding the internal workings of New Naratif, in order to incorporate the information into the proposed law against ’foreign intervention´. Minister for Law K Shanmugam, in a speech in August 2019, made clear that this law is aimed squarely at two independent media outlets: Online Citizen Asia and New Naratif”, Dr. Thum said.

“Minister for Manpower Josephine Teo just this week in Parliament reiterated the PAP government’s intention to pass such a law. Online Citizen Asia Editor-in-Chief Terry Xu, when he was questioned by the police in March 2020, also got questions about the internal workings of his organisation, and he too refused to answer these questions.”

Civil society has come together to express their support for Dr. Thum with Amnesty International, Article 19, ASEAN Parliamentarians for Human Rights, CIVICUS, FORUM-ASIA, International Press Institute (IPI), Human Rights Watch, and Scholars at Risk releasing a joint statement to reiterate their call for the Singapore government to drop the investigation of New Naratif. They also called on the authorities to repeal or substantially amend all laws that curtail the rights to freedom of expression, association, and peaceful assembly to bring them into line with international standards.

“It is disingenuous for the PAP government to be carrying out such acts of harassments against members of the press via the use of the civil service. It is also hypocritical for the PAP government to be commencing investigations into Dr. Thum over alleged offences of Parliamentary Elections Act (PEA) when the Election Department had closed its eyes towards various violations of the Act in the recent General Election by members of the public and TOC Asia”. said Mr Xu.

The Online Citizen stands alongside this statement and calls on all politically motivated harassment and investigations to come to a stop once and for all.

Background of the police report

On 18 September 2020, the ELD released a press statement in which it stated that it had filed a police report against the independent online media outlet New Naratif for “illegal conduct of election activity” for alleged publication of five paid advertisements on Facebook, without the written authorisation of a candidate or his election agent during the General Election of July 2020.

On the same day, Dr. Thum was notified that he would need to report to the police for questioning. Three days later (21 Sep), he reported to Clementi Police Station, where he was subjected to questioning for four and a half hours. The police also accompanied him to his home, and seized his laptop.

While the Elections Department’s statement does not specify which Facebook posts were allegedly illegally advertised, it issued a statement on 3 July in which it directed Facebook to “remove unauthorised paid Internet Election Advertising”.

Following the statement, New Naratif received pro-forma emails from Facebook stating that the following posts did not comply with their advertising policy:

a satirical video advertising a perfume called “Discretion” to denounce the abuse of broadly-worded laws by Singapore’s Prime Minister;
a post compiling articles critical of the ruling People’s Action Party (PAP);
a post compiling articles about the lack of transparency and accountability in Singapore’s government;
a video explaining how the use of the Protection from Online Falsehoods and Manipulation Act (POFMA) can “have devastating consequences” in times of elections; and
a post compiling articles about racial discrimination in Singapore.
The posts remain online, but according to New Naratif, they did not re-boost them.

The International Press Institute (IPI), a global network of editors, media executives and leading journalists for press freedom, today (5 March) reiterated its call on Singapore authorities to stop their harassment of Dr. PJ Thum, an IPI member and managing director of New Naratif, and drop the police case against him.

The summons relates to a police investigation against news website for boosting several electionrated stories on Facebook in the run-up to Singapore’s July 2020 general election. Authorities claim the publication amounted to the illegal conduct of election activity.

“This is a clear attempt by Singapore authorities to harass New Naratif and PJ Thum, who is a member of IPI’s global network of editors and journalists”, IPI Deputy Director Scott Griffen said.
“It is absurd to accuse New Naratif, which is a respected independent news website, of violating election law by boosting its content on Facebook, which is a common practice by media organizations. This investigation should be dropped without further delay, and Singapore should stop all efforts to hinder the work of independent media.”
In an earlier statement, New Naratif had described the action of the Elections Department as harassment, and a testimony to the government’s track record of arresting, abusing and intimidating critics.
“The PAP (People’s Action Party) lost the argument at the ballot box, and Prime Minister Lee promised humility. Instead, the Prime Minister’s Office is taking revenge against leading critics and independent media. They are repeating tired old tactics by abusing the Parliamentary Elections Act, just like after both the 2015 and 2016 elections when investigations were launched against critics”, New Naratif said in the statement.

It was some years ago that Dr Thum Ping Tjin (PJ Thum) told me that he could not understand how I could live as a sort of “marked person” (this phrase is mine). I said I just live normally as we only live once and disregard the remarks of the government, though I must say that I get worked up when some childish People’s Action Party (PAP) MPs try to score brownie points by making irrelevant comments about me.
I felt really sad listening to PJ Thum in this interview. It was recorded after he was interrogated by the police at the Clementi Police Station for the second time concerning a satirical and creative video called “Discretion” which was aired some time before the last general election. This investigation is, I suspect a continuation of the harassment he had faced and will have to face for as long as he lives in Singapore.
I don’t understand why the police is spending so much time investigating the case. It is a petty matter, as petty as the postings I made on Cooling Off Day of GE 2015 and for which I paid a price beyond my imagination. I never thought that the Cooling Off Day “offence” was an “arrestable offence” (meaning the police can seize my properties) until I was shown the law in the interrogation room. The police had demanded that I hand over my mobile phone or be sent to the lock up. What followed that demand was then turned into “violence” when I was escorted to the police car and driven to my home where another team of plain clothes police officers who introduced themselves as the “forensic team” was waiting for me.
At my flat, they seized my computers and mobile phone.
Reading the post by PJ Thum, I am compelled to write this note.
Singapore is a first world democratic country. I do not think a first world government treats its citizens in the way Singapore does. What crime did P J Thum commit? He did not steal or cause personal injuries to anyone.
PJ Thum’s troubles started with his research paper on the role the communists played in the history of Singapore. His conclusion that they were no longer a force in the 1950s did not please the government. Instead of instructing a team of researchers to rebut that finding, it decided to use other methods to tame him.
I recall that when the POFMA Bill was sent for review by a parliamentary select committee, I was not impressed. My own experience at the Select Committee for the Amendment to the Legal Profession Act has left an indelible impression of what such hearings are all about. It was to me, a time for government officials to ridicule and belittle earnest and honest citizens.
When the committee called for representations from the public, the young activists were all excited and hopeful that at last the government was going to listen to their views. Function 8 decided that it should not dampen their spirit but to go along with them. We submitted a paper and indicated that we would be prepared to be examined by the committee if called upon to do so. We were not summoned.
I attended the first day of the hearing but left for Malaysia the next day. I did not expect any drama to be unfurled. But when I received news that P J Thum was grilled for 6.5 hours by Minister Shanmugam, I was shocked. What was happening?
The select committee hearing was a total farce, a replay of the select committee hearing of the Legal Profession Amendment Act in 1986 when PM Lee Kuan Yew took his revenge on some members of the profession. I was one of his targets. He failed to demolish “his enemies”. Similarly, Minister Shanmugam failed to demolish PJ Thum.
I recall that after the select committee hearing, I was advised by senior lawyers “to lie low”. I did but that did not help. What followed was the mass arrests in 1987 when 22 so called Marxists were arrested and detained under the ISA. Three of the 22 were students of the polytechnic who issued a statement in support of the so called “Marxists”. They were just kids of 17 or 18 years of age.
Watching the televised hearing after my return to Singapore, I knew that P J Thum and the activists who gave gave testimonies were targeted by the government and have become enemies of the state. History has a tendency to repeat itself.
Today we see multiple criminal and civil actions being taken against those who appeared before the POFMA select committee – P J Thum, Kirsten Han, Terry Xu, Jolovan Wham, Han Hui Hui etc. They and their friends have been hauled up before police stations to be interrogated for hours and days. Their electronic devices have been seized. Luckily the ISA is no longer a favourite tool of oppression. It is today reserved for so called “terrorists”, just to remind the public that it is an indispensable law as Singapore is under constant threat of being attacked by citizens and foreigners. Incidentally, the government has its unique and secret way of defining who is a “terrorist”. If P J Thum etc had lived in the 1970s and 1980s, they would have been thrown into prison under the ISA.
I am depressed that in this day and age, the PAP government is still practising its old tactic of harassing people who love Singapore but who do not agree with its policies. Why harass them? Why deprive them of employment and their contributions to our country. Why ruin their lives? Why misuse and abuse our police force?
Leaders must be humble and listen to the people. When there is disagreement, thrash it out. Do not use our police force to eradicate dissent. The police are employed to take care of the people and solve real crimes. As several of the police officers who interrogated me told me, they do not enjoy investigating activists. They prefer to solve murders and real crimes.
t is time our leaders grow up and treasure people who do not share their views and policies. There is no guarantee that they will always be in power. We won’t know if in another ten or fifteen years they may have to leave their posts. But perhaps, this is the fear they have for cracking down on dissent.

You should have seen this coming when the POFMA 'debates' were quickly concluded and POFMA became law. :wink:

In a totalitarian shithole, dissent is treason. But I'm sure the crackdown is worth it as long as you get 'stability', eh? :cool:
