由華航與長榮航空機師組成的桃園市機師職業工會正式取得罷工權,最快中秋節就會發動罷工,即使外界普遍認為機師是高薪族,工會仍認為台灣機師的工作條件並不理想,希望能提升機師的工作權,讓更多人願意加入及留下來,避免人才外流;但熟悉航空業的人士則認為,罷工訴求表面上是為飛安反過勞,實際是針對長榮「降低機師服務年限」,想避免跳槽賠償,尤其未來台灣即將有新航空公司成立,時機更為敏感。對業者來說,一旦讓步,恐怕就是人才大量流失的開始,將直接影響業者生存。
根據航空業內部人士透露,罷工遠因是全球鬧機師荒,想藉這次罷工談判,降低機師服務年限,避免跳槽後要負擔巨額賠償,近因則是台灣即將有另一家航空公司成立,國內航空公司都將受衝擊。

航空業內人士分析,尤其是長榮遭遇的威脅最嚴重,罷工訴求中「縮短服務年限」及「提供可申請符合其他航空認可的飛時證明」,都被解讀與跳槽有關,長榮也知道「退此一步即無死所」,絕不可能放任機師藉口罷工大出走,去投效未來的競爭者。

不滿勞資協商破局,桃園市機師工會昨天取得合法罷工權,若無法與中華航空、長榮航空達成協商,將於本月廿日宣布罷工期程,甚至不排除在中秋連假發動罷工。但工會訴求與華航、長榮仍有不小歧見,交通部昨天表示,航空公司已準備應變計畫,但「希望不會用到」。
國內航空界面臨史上第一場機師罷工壓力,華航、長榮內部全面警戒,持續爭取跟桃園市機師職業工會協調,不希望發生罷工事件,否則恐影響到民眾及貨運,一旦航班大亂,經濟將受到衝擊。據了解,華航與長榮已兵分多路檢討協商,並且悄悄準備啟動簽轉機制,以降低旅客不便為優先。
目前華航、長榮航機師總人數,大約一千三百人,長榮航空加入工會的機師約五百多人,華航則有八百多人。雖然還有非工會的機師,但一旦罷工航班的調度,勢必會有很大困難,也會導致其他非工會機師的工作權益受影響,航空業者都不樂見。
華航機隊共八十五架、長榮航七十六架,如果真的罷工,而且天期拉長,台灣的停機空間恐怕不足,桃園機場恐將塞滿飛機,台灣天空將出現人員出不去、也進不來,造成航空公司、全民雙輸。
其實,為因應桃園機師職業工會近期抗爭行為,華航已向桃園地方法院提起「民事聲請定暫時狀態處分及緊急處置狀」,希望尋求合理法律行動,降低對公眾運輸的衝擊。不過,因為時間緊迫,加上法院安排開庭等,可能緩不濟急,因此,華航不放棄與機師工會協商的機會。
桃園市機師職業工會華航分會、長榮分會都提出多項訴求,內容包含提升機師薪資與福利、提升行政管理等,若是能達成共識,就能避免罷工。只是專家認為,這部分涉及到營運成本,航空公司勢必會仔細研議,且機師調高薪資福利後,將涉及空服、地勤是否須一併調整,恐增加全公司成本負擔。
航空界人士分析,雙方若可各退一步,例如機師不堅持全面調高,而是隨著物價水準波動、逐年調整,在這種情況下,談判協商才較可能完成。

航空機師也爭合法罷工,保險業者表示,一般罷工都列入不保事項,不少產險旅行不便險均不賠因罷工所造成的航班延誤,不過,也有產險有條件理賠。
桃園市機師職業工會從上月16日起發動罷工投票,在昨(7)日經過機師工會高投票率之後取得合法罷工權,如果勞資雙方仍無法達成共識,機師工會強調不排除中秋連假發動罷工。產險業者表示,針對罷工所造成之行程延誤損失,產險業之旅遊不便商品大部分皆列為除外不保事項,建議民眾留意相關條款內容。
國泰產險說,針對罷工造成的班機延誤,仍符合該公司的理賠條件,原則上有理賠,但在宣布罷工後才來投保則屬於班機延誤不保事項,無法理賠。
所謂「宣布罷工」是指機師公會正式宣布才算,如果擔心機師工會和航空公司無法達成共識而突然宣布罷工,即可以先行向產險公司投保旅行不便險將此一不確定性轉嫁給保險公司。
除了國泰產險明確表示,只要在罷工宣布前投保有理賠班機延誤事項外,多數產險公司都將罷工列入「不保事項」。因此,針對機師、空姐罷工造成班機延誤是否有理賠,產險公司表示,投保前還是得細看各保單內容。
富邦產險即表示,因「罷工、暴動、民眾騷擾」造成的「行程延誤」持續時間較無法預知,且影響層面較廣大,保險公司所承受之風險較難估算,故旅遊不便險中「行程延誤」的不保事項多數都包含了「罷工、暴動、民眾騷擾」。但若是因「罷工、暴動、民眾騷擾」而造成「行李延誤」或「行李毀損或丟失」,只要取得航空公司或機場開立的相關證明,損失都有機會獲賠。
