高雄鳳山區龔姓男子沉迷賭博電玩及線上遊戲，導致經濟拮据，無法支付中風的母親和哥哥106年5月在養護中心費用，執意將母兄接回鳳山區住處，自106年6月2日起未供應任何飲水和食物給母兄，造成2人陸續於6月6日和9日死亡。高雄高分院二審今年6月依殺害直系血親尊親屬等罪判龔嫌無期徒刑。全案經上訴，最高法院今天駁回，維持無期徒刑判決，全案定讞。
判決書指出，51歲龔男照料分別於民國98年與106年3月中風的母親和胞兄，2人因生活無法自理需人照料住進養護中心，看護費用由高雄市社會局補助，不足部分則由家屬自行負擔。因龔男沉迷賭博電玩，無法養護中心費用，執意將母兄接回住處，但又未供應任何飲水食物給母兄，造成2人陸續死亡。龔嫌餓死母兄後將2人屍體放在床上，並在房門撒上鹽、蘇打粉及樟腦丸等掩蓋腐敗臭味，再用藍色膠帶將房間的門縫、窗戶及鑰匙孔封死，並在家中伴屍及焚香祭拜。
由於龔男接獲高雄市環保局通知要噴灑登革熱藥劑，他擔心東窗事發，在106年6月28日離家，直到他的胞姊聯繫不上龔男及擔心母兄無人照顧報警，高雄市警察局鳳山分局上門赫然發現2人死亡多時，客廳並留有龔男的遺書，但人已不知去向。高雄地方檢察署指揮警方在鳳山區一家網咖將龔男拘捕到案，依殺害血親尊親屬罪嫌起訴，並求處極刑，高雄地方法院今年4月判處無期徒刑。
台灣高等法院高雄分院二審認為龔姓男子餓死母親與胞兄，犯罪情節重大，但考量他沒有前科，並非習於犯罪或冥頑不靈之人，且其他家屬表示希望給他機會，審酌龔男仍有悔悟之心等一切情狀，維持無期徒刑。最高法院認為，原判決認事用法及量刑並無違誤，龔男上訴無理由，駁回定讞。
