公文中提到，「本局函請該醫師（指柯）說明表示確實親自診治該病患，於接受媒體採訪時所述病情，亦皆透過親自審查且親自詳閱病歷得知」；但公文又指「該醫師擔任該名病患民間醫療小組召集人，非職業登記醫院指派，無診治紀錄，經查衛福部系醫事管理系統，該醫師於電視媒體公開討論病人病情時之執業狀態為歇業」。
換言之，北市衛生局雖稱柯文哲有親自診治扁，卻又強調當時「非執業狀態」，且擔任扁醫療小組召集人時是以個人名義擔任，非醫院指派，外界認為是意圖在為柯卸責。
衛福部今年3月回函指出，依據最高行政法院100年度判字第2155號判決理由釋疑，認定醫師應遵守醫師倫理規範，要求衛生局依個案事實本於權責認定辦理。但最後，今年6月，北市衛生局輕罰柯最低的2萬元，也未送醫師懲戒委員會或相關公會審議。
北市衛生局副局長陳正誠回應，過去案件只要有疑慮就會請衛福部解釋，並非此案才特別詢問；另外，調查過程中都有諮詢專家，認定柯並未在「執行業務」時違反醫學倫理，因此未送懲戒。針對下級機關罰長官的問題，陳則強調：「我們是罰柯文哲而非罰市長」。
對此，北市府回應，市府各機關依法行政，絕無「找理由脫罪」，市長也依規定繳交罰鍰。
