When a six-month-old infant’s cries in the wee hours of the morning woke him up, the frustrated father smacked the baby once on the head.

The force of the blow caused the infant’s skull to fracture in multiple places. It also resulted in trauma to the brain that has caused permanent physical and intellectual disabilities.

On Thursday (8 November) in the State Courts, the father, 30, admitted to one count of voluntarily causing grievous hurt to his biological son, now two years and eight months old.

As a result of the incident, the toddler and his older brother, aged three years and nine months, have been placed under foster care.

The younger boy is unable to perform simple functions independently and cannot form speech. Due to his injuries, his developmental age is now that of a four-month-old.

A baby girl, the boys’ younger sister, is still in the care of her 26-year-old mother.

None of the parties involved can be named to protect the toddler’s identity.

The facts of the case
The court heard that on 26 August 2016, between 1am and 3am, the mother was awakened by her son’s crying. She fed the baby and carried him, but he did not stop crying. The noise eventually woke the father.

In frustration, the man shouted, “Shut up la, shut up la. Later I have work, you make noise, I cannot sleep.” He then hit the baby, who was seated on his mother’s lap, on the head with his right hand.

The force of the blow pushed the baby aside but the mother managed to hold onto him to prevent him from falling.

The father eventually calmed down and sat the baby on his lap. The baby vomited on the floor a short while later. His father patted him to sleep before going back to bed.

The baby woke up again at about 8am and behaved normally. He played with his elder brother until his mother fed him at about 11am.

But when the mother checked on the baby about two hours later, she found that he looked semi-conscious and weak, according to the prosecution. She called an ambulance which conveyed the baby to the hospital.

The baby was admitted to KK Women’s and Children’s Hospital while barely conscious. A CT scan of his head showed that he had multiple skull fractures and a haemorrhage, along with excess fluid in his brain. He also sustained a haemorrhage in both eyes along with bleeding in the right eye amongst other injuries.

The baby underwent an operation. After he was discharged from intensive care to the general ward, he developed symptoms of vomiting, lethargy, irritability and other neurological movement disorders due to brain injuries.

The baby was discharged on 2 March last year – nearly seven months after the incident – and placed under foster care.

Permanent disabilities
A medical report dated 12 October this year stated that the baby still suffered from disabilities. His foster parents observed that he is unable to sit up, move, turn or flip on his own. He is unable to move his limbs voluntarily and cannot react to a blanket which covered his face.

The baby is also unable to do anything independently and can only cry when he is in pain. He needs to be constantly watched to ensure that he is not in danger, and has to be fed through a feeding tube. Due to these conditions, the baby often has sleepless, crying nights and is unable to lie flat on his back.

The baby has been diagnosed with dystonic cerebral palsy, a condition where the muscles spasm painfully. He also has other conditions such as epilepsy, left hip dislocation and obstructive sleep apnea.

The medical report noted that the baby will likely continue to require assistance for daily living and mobility.

Deputy Public Prosecutor (DPP) Kumerasan Gohulabalan said that this was a case of a caregiver who “abused the trust placed in him and with a single act of violence, changed the outlook of the victim’s life”.

Even though the child was already two years and eight months old, the incident halted his cognitive and physical development, added the DPP. The child remains unable to react to dangerous situations and is at risk of increased injury to himself due to the developmental delays.

The prosecution sought a jail term of five and a half years, and six strokes of the cane for the man.

Lawyer Shehzhadee Abdul Rahman, who represented the father, called for a jail term of four years and six strokes of the cane.

Public outrage has followed a police decision not to press charges against a father who was filmed kissing and caressing his young daughter on a train in southeastern China.

In a video, which went viral this week, the 30-year-old man is seen fondling a young girl sitting in his lap. The man lifts the child's shirt, strokes her back and tries to kiss her on the mouth. The girl appears to be trying to push the man away.

"The father then put his hands under her pants. The girl then said, 'father, you are touching my buttocks again, it's painful.' She continued to struggle," a female passenger who filmed the video told the Hangzhou-based newspaper City Express, adding that she had not filmed this part because her phone ran out of battery.

On Wednesday, the Nanchang Railway Police in the southeastern province of Jiangxi said on the Twitter-like platform Weibo that the father's behavior did not constitute molestation, and could not be deemed illegal.



The public response was overwhelmingly negative. Many were convinced that what the father did should be regarded as child sexual abuse.

In China, sex is a taboo subject. Since women's chastity is valued, victims of sexual abuse often carry deep shame.

Abuse of minors is considered even more taboo. But in recent years, there's growing awareness of sexual abuse, leading to more open discussions, especially online.

"It was obvious that the girl tried to resist her father's caresses and kisses, both verbally and trying to push him away. But even this didn't constitute molestation?" asked Weibo user bilibili Yue Ban Ji.

Another Weibo user said: "The lives of many children have been ruined because people like you are tasked with protecting them!"

Wang Zhenyu, a lawyer at Beijing-based Yipai Law Firm, said that under Chinese law, that it may have been difficult for police to charge the father because of the currently accepted legal definition of molestation.

An act is legally defined as molestation when it is judged to have been performed with sexual intent.

"The police may have concluded that because it was a father and daughter, the act did not constitute molestation. If that's so, it's illogical. Fathers can molest or even rape their daughters," he said.

"However, they might mean that, while investigating, they found because they are father and daughter, the action did not involve sexual desire."

In response to the police's statement, Beijing-based NGO Girls' Protection said there should be a "boundary" between father and daughter, and parents should be careful with how they express love and intimacy to children.

Molestation of adults carries a maximum sentence of five years in prison. But offenders who commit the crime in public face a harsher punishment, with a minimum penalty of five years in jail.

Chinese law recommends that the penalty meted out to child molesters should generally be more severe than abusers of adults. In this context, children are defined as people under the age of 14.

Following 12 days of trial between August 2016 and July last year, the man was found guilty of two counts of attempted rape, one count of sexual assault by digital penetration and one count of outraging the girl’s modesty. He was sentenced to 13 years’ jail and 15 strokes of the cane on Monday (5 March).

The girl’s father died in December 2010 and her mother entered into a relationship with the man in 2011. According to the prosecution, the girl had looked up to the man as her mother’s boyfriend and an elder.

A few months into the relationship, the man began sleeping over at the mother’s flat, where he shared the master bedroom with the girl and her mother. The girl’s sister slept in a separate bedroom.

The man would stay over up to five times a week and wore only his boxers around the flat, which made the girl and her sister feel uncomfortable.

In the early hours of 11 March 2012, the girl and the man were left alone in the unit as the mother had gone out to celebrate a friend’s birthday.

The girl was sleeping on her bed when she woke up in pain. She realised that the man had sexually assaulted her after slipping his hand into her shorts.

Feeling scared, the girl turned over to lie on her stomach. The man then attempted to rape her. The girl tried to move away but he pulled her back and attempted to rape her a second time.

The girl struggled and pushed the man away, although the man continued to molest her. The girl then bit the man on his left arm, causing the man to laugh and return to his own bed.

The girl then pretended to be asleep but the man returned after a while and molested the girl once more. He only stopped after he heard the sound of keys at the flat’s front door.

The girl did not tell her mother about the incident as she feared damaging her mother’s relationship with the man.

Two days later, the girl’s mother instructed her to assist the man on his delivery rounds. Later that day, the man asked the girl to accompany him to a hotel, claiming that he wanted to shower and rest.

The girl declined and the man drove to a nearby multi-storey carpark where he asked the girl to get into the back of the van. The man drove the girl home after she repeatedly refused to obey him.

That night, the girl was lying on her bed watching television when the man once again made advances on her. After a brief period of struggling, the man rubbed his privates against the girl, who repeatedly kicked him in the groin. Instead of being deterred, this caused the man to laugh.

He then bit the girl’s breast and tried to kiss her. The girl turned her head and noticed her sister standing at the door. Upon seeing the sister, the man went back to his bed while smiling at the girl.

The sister later contacted her then-boyfriend and her mother, who scolded her for leaving the girl in the house with the man. The girl’s cousins, who were notified of the incident, called the police.

One of the girl’s cousins testified that on the night of the second incident, the girl’s mother had confronted the man and prevented him from leaving the flat, saying to him, “I was so nice to you, why did you do that to me?”

In reply, the man had said in Hokkien, “Your daughter is going to lose her virginity one day, so might as well I do it now.”

The cousin testified that the man had used a Hokkien phrase which was understood to mean, “breaking (the victim’s) virginity”.

In a separate hearing held after the man was convicted, psychiatrist Francis Ngui testified that the girl suffered from post-traumatic stress disorder and major depressive disorder in relation to the incidents.

The psychiatrist also testified that the girl was “possibly devastated” after her mother got back together with the man after the incident. “It was like a wound that had not healed had been opened again when her mother reunited with the (man),” said Ngui.

The girl’s mother is no longer with the man, who was represented by lawyers R S Bajwa and Kertar Singh. The prosecution had sought a sentence of at least 14 years’ jail and 15 strokes of the cane.

this abang can relax one corner (to himself) without baby to bug him and perhaps abang should ask for no remission in the sentence for a full 6years of peaceful tidak apa relax one korner sleep and rest !!!! BESTEST !! isnt this what abang had always wanted ? maybe ask for 20years jailtime instead...no need to look after the very kid he bashed to a vegetative state.

Friday (Nov 9), the 30-year-old driver was sentenced to six years' jail and six strokes of the cane after pleading guilty a day before to causing grievous hurt to his biological son, who now has permanent disabilities and has to be fed through a tube.
