SINGAPORE — A 31-year-old man on Wednesday (Dec 15) became the first to be dealt with for his role in a sex-themed chat group on messaging application Telegram.
Lincoln Anthony Fernandez was jailed eight weeks and fined S$20,000, after pleading guilty in a district court to two counts of transmitting obscene material and one count of possessing obscene films.
Three other charges of transmitting obscene material were taken into consideration for sentencing.
The court heard that he had joined the chat group “Sam’s lots of CB collection” in late 2017, which is linked to the sex-themed online forum Sammyboy. The forum contained hyperlinks allowing users to join the group.
Fernandez eventually became an administrator of the group, which had more than 25,000 members at one point. He shared lewd photos of women that he had either gotten from other Telegram group chats or downloaded from the Internet.
When Fernandez and three other men were charged in court, the police said that the material circulated on it included leaked sexual videos and images of women.

These also included nude photos, those of women dressed scantily or in compromising positions, and videos of sexual acts that were exploitative of the women because they circulated the materials in the group without their consent, the police added.
On Oct 24, 2019, the authorities received a report against the group and arrested the four men on Nov 6 that year.
Thousands of video files and pictures were found in their electronic devices, with Fernandez specifically having 406 obscene photos and 118 video files in his Oppo mobile phone.
The police then consulted the Attorney-General’s Chambers, which concurred in mid-July this year to charge the men.
On Wednesday, Deputy Public Prosecutor Bryont Chin sought eight to 10 weeks’ jail and a S$20,000 fine, saying that Fernandez had sent “extremely obscene” material to a large number of people.
Fernandez's lawyer, Mr Riko Isaac from Tembusu Law, asked for a similar sentence. The defence counsel told the court that his client was remorseful and unlikely to reoffend, and that he was not the mastermind of the group.

“He didn’t apply his mind to the consequences of his actions and involvement in the group until much later. In hindsight, he deeply regrets his involvement and he has thoroughly learned his lesson going through these proceedings,” Mr Isaac said.
The lawyer added that Fernandez, who is unemployed and cannot afford to pay the fine, will spend an additional month in jail.
District Judge Chay Yuen Fatt allowed him to begin serving his sentence on Jan 3, after he asked to spend Christmas with his family.
Those convicted of possessing obscene films can be jailed for up to six months or fined up to S$20,000, or both, for each charge.
Those convicted of transmitting obscene materials can be jailed for up to three months or fined, or given both penalties.
