Police yesterday said Ms Bailey could be charged with offensive conduct.
Jade Marr was taking her children and nephews, aged between four and ten, home from a musical in Sydney when Ms Bailey ordered them out of their chairs.

“I was in shock at the time. I’m probably more angry today that someone could be that low and attack a child or anyone else,” Ms Marr said.
“She called the police and her goal was to get my children removed from the train because they were sitting on a seat.
“They were frightened that the police were coming to get them.”
Who is this little jerk off he can only get a gook, he can’t even get a regular girlfriend — it is so sad
Ms Bailey was filmed turning to a passenger of Asian heritage and referring to her as a “gook” while she took to a nearby male passenger who was unrelated to the woman.
“Who is this little jerk off he can only get a gook, he can’t even get a regular girlfriend — it is so sad,” she said.
“Is it really that small that you can’t get an Aussie girl? Poor man. Look at this bogan he has got a gook — look at it. She probably thinks he is rich.”
Ms Bailey later cited her own poor dating history, claiming she had been ripped off $100,000 by a Dutch man she met on RSVP, in relation to her outburst.

She also told The Daily Telegraph she was returning from visiting her husband in a nursing home in Sydney and had been angry at a nurse of Asian heritage.
“Everyone’s playing the race card. It wasn’t purely the Asian lady. It was Australians too. It was basically anybody that looked at me they were a target,” she said.
“It was a combination of things. It was just frustration. I’ve been trying to get a job for over a year and I had my hopes pinned on this one job.
“I made a comment to the mother about her children sitting on the seats and she totally disagreed. I thought it was a horrid example to set for these children. I found it mind-numbing that everyone was agreeing with her.
“Then everything escalated and the guys started filming me.”
She said she wanted to offer a “public apology” but added: “I was called white trash earlier in the week so I know it’s not nice. But it’s only names. It’s not like I’m murdering anyone.”

Witness Zachary Harrison, 18, offered to give up his seat for Ms Bailey to calm the situation without success.
He said ms Bailey had attempted to hit him.
“It was disgusting. I am in disbelief people still hold these views so strongly and express them in public,” he said.
