一名任職於台北富邦銀行的陳姓女副理,日前在複核客戶的匯款資料時,不小心看錯數字,把1千萬匯成1億元;隨然隔天客戶就把多出的9千萬匯回,但陳女仍遭公司懲戒,年度考績打成乙等。她不服處分並自認遭到羞辱,向公司提出求償100萬並撤銷懲處;但法官認為陳女是資深主管,分辨存提款單的數字是銀行員的基本能力,因此駁回上訴。

陳女主張,她本來是松南分行的副理,表現也十分良好,2010年調到南港分行,但考績卻被打成甲等,年終獎金少領了25萬元。

另外陳女還表示,南港分行業務量大,2013年5月她在處理一間企業客戶的匯款單時,當時客戶填單要取款「1千萬元」,她的部屬黃姓專員拆寫成2張各「500萬元」的匯款委託單時,不小心寫錯變成「5000萬元」。她依內部流程複核時,卻沒發現客戶的取款憑條比取款金額少1個0,導致多匯給客戶9千萬。客戶隔天隨即退回溢領的金額,她自認沒造成公司形象和實質財務上的損失。

陳女還聲稱,公司為了要逼她離職,不但將她2013年度考績打成乙等,除了影響晉升還無法領到50萬元的年終獎金,因此提告請求撤銷懲處外,另請求50萬元的精神撫慰金。

對於陳女的控訴,台北富邦則認為,陳女當時的確並未確實複核客戶的匯款內容,導致出現溢匯9千萬的重大疏失,公司按照員工獎懲辦法進行懲處,實屬正當行使懲戒權而非刻意羞辱打壓。

法院一審時判決陳女敗訴,她不服上訴高院,但法官認為難以認定陳女遭到不當打壓或侮辱;另外溢匯一事,1億元和1千萬元的阿拉伯數字中有幾個「0」,對於行員而言是辨別的基礎能力,陳女作為資深主管,卻發生重大誤判,屬於不可原諒的重大疏失,她卻還稱說情節不嚴重,更推卸責任是「工作負荷過重」不應懲處,高院因此駁回上訴。
