Americk Sidhu Helped Prepare Two SDs. Both Were Investigated By Police And Neither Was Proven False.
Police have list of witnesses to question
allegations by Azilah that Najib masterminded killing of Altantuya
Police will wait for specific instructions from AG's Chambers
we already have our own SOP, Hamid Bador told reporters
he refused to state whether Najib would be summoned
“Dozens will be called. The process is underway,” he said.
Azilah said order to kill Altantuya came from Najib
and that Razak Baginda and Musa Safri were aware of plan
My comments : Lets go back in history a little. Here is news about lawyer Americk Sidhu and the two SDs he helped to draft - one for PI Bala (the 1st SD) and another one for Charles Morais - the brother of the murdered Kevin Morais.
Here is a snip from FMT :
https://www.freemalaysiatoday.com/c...take-in-accusing-najib-of-murder-says-lawyer/
- lawyer (Americk Sidhu) helped prepare SDs involving P Bala, DPP Kevin Morais
- Americk prepared first SD of P Balasubramaniam, better known as PI Bala
- Bala’s first SD was read during a news conference on July 3, 2008
- Americk also prepared an SD in 2015 for Charles Morais
- who claimed that murder of Kevin linked to charge sheet
- Kevin confided preparing charge sheet in AG's Chambers
- On both occasions, Americk said, he was harassed
- police recorded his statements on both SDs
- neither statement was proven false, he added
Americk Sidhu prepared both Statutory Declarations (SDs) for PI Bala and Charles Morais - the brother of murdered Kevin Motais.
(The Charles Morais story is a little bit disappointing because he said he had some thumb drive or something with much information in it. Charles is safely back in the US but till todate he has not divulged any extra information that he may have.)
Anyway the point to note is that Americk Sidhu says the Police investigated both the SDs that he helped to draft. Neither of the two SDs was proven false, says Americk.
If there was nothing wrong with the two SDs it means the SDs were correct.
If the SDs were correct (or they were not wrong) logically the Police should have taken further action on the allegations in those two SDs.
Sadly that was during the era of the Najib kleptocracy.
There is no way those two SDs would have been acted upon.
So the Police (at that time) just did not pursue the PI Bala and Morais SDs.
The question is this particular SD is now under the Pakatan government.
This is no more Najib kleptocracy.
IGP Hamid Bador says that a long list of witnesses has already been prepared.
This is a good sign. It means that Azilah's SD has also not been proven false.
If the Police can sense that Azilah's SD was false they would not have prepared a long list of witnesses to be questioned. Why pursue a false story too far?
If Azilah Hadri's SD is true then the Police should advance to the next course of action - recommend that the AG prosecute the case in Court. Then the ball will be at the AG's feet.
I have a question - what about those two SDs by PI Bala (his 1st SD) and the SD by Charles Morais?
Why haven't the Police re-opened (or revived) the investigation into those two SDs?
Takut apa lagi?
The Najib kleptocracy has been thrown out of office.
Those cases must be revived immediately.
And if Azilah Hadri's SD is not false (meaning it is true) then the Police / AG must progress to opening a prosecution.
Time is of the essence.
Justice delayed is justice denied.
The trial of the six or seven fellows charged in the murder of Kevin Morais has been sort of permanently suspended.
Sarawak Report says all of them are being held in prison with no continuation of their trial.
What type of legal system is this?
Waiting for what?
And waiting for how long?
Their trial (the Kevin Morais murder) has already begun.
Now in limbo. Please conclude the trials.
Tan Sri AG - what are you doing?
Now coming back to Azilah Hadri's SD the Police must wrap up their investigations quickly and make a recommendation to the AG.
Either there is no basis in Azilah's AD in which case just drop the matter.
Or if the SD is true (not false) then a prosecution should be recommended to the AG.
Granted a person cannot be tried for the same charge twice.
But if there was wilful obstruction of justice by any parties in the first trial(s) (by the Police, AG's Chambers, government) then there is basis for a new trial to be started all over again.
