20/07/2009: DAP political aide Teoh Beng Hock was finally laid to rest, buried at the Nirwana Memorial Park at Semenyih, Selangor on Monday afternoon. Thousands had attended his funeral which began early this morning at his family home in Alor Gajah, Malacca. Escorted by his siblings, fiancee, relatives, friends and well-wishers, his coffin was driven to his final resting place. And there, may he rest in peace and be with God always.

BENG HOCK’S FAMILY WANT JUSTICE; NOT PRETTY WORDS FROM NAJIB





Sooner or later, hypocrites get found out. And it was no different for Najib Razak, who has been playing a two-faced game the past few days. While sending his political secretary Oh Ei Sun to commiserate with the Teoh family, his editors at the Utusan and Mingguan dailies were busily criticizing those who insisted on an inquiry against the Malaysian Anti-Corruption Commission – widely blamed for the sudden and violent death of their son Beng Hock.

But gone are the days when Malaysians are so easily duped. No longer are Malaysians so stupid that they will bow and scrape and say “Oh wow, condolences from the PM. Thank you. Thank you.”

And true enough, Beng Hock’s parents – both mother and father – minced no words on Sunday, when Oh dropped by at their family home in Alor Gajah. They demanded justice for their dead son, insisting on a Royal Commission of Inquiry into the suspicious circumstances of his death.

They told him in clear-cut language they would hold the PM responsible if no independent investigation was conducted on how their son could have gone into the MACC office for questioning and then be found dead the next day – his twisted and broken body sprawled nine floors below the graft-buster’s premises.

Beng Hock’s younger sister, who clearly adored her brother, was no less insistent. “What are you going to do about this?” she asked repeatedly. The Teoh family also told Oh to tell Najib they decided against a second autopsy not because they accepted the first report, but because they did not want to delay the burial proceedings.

Said Oh: “I received a phone call from the prime minister last night. He told me to come here and offer his personal condolences to the family.” Pretty words. But once the mask has been torn off, it is actually an ugly, ugly sight. For racism not only ruins lives, it also kills.

High time for Najib to drop the communal politicking that he has been busily pushing behind the empty facade of his 1Malaysia slogan. The people can see through it and they have!

Death in Custody: Address Human Rights Obligation Now

Amnesty International Malaysia views with great concern the recent deaths in custody of Teoh Beng Hock and P. Gunasekaran and the issues surrounding their deaths.
These are not isolated incidents as recently there have been many reported cases of death while in the custody of the police, immigration department and prisons authorities. It raises a serious concern in terms of gap in human rights protection observed by the law enforcement authorities and accountability mechanism to address death in custody. Therefore, there is an urgent and critical need to address human rights obligation in terms of law enforcement work in Malaysia.



Law enforcement agencies and initiatives must exercise a high degree of human rights responsibility, and prioritise and internalise procedures in ensuring a person’s personal security and rights at all times. They are duty bound to ensure that a suspect or witness is provided with protection of their personal security and rights including their right to legal access and medical attention during the entire period of custody and investigation. This fundamental right has somehow remained discretionary, ad hoc and secondary in the nature of law enforcement work in Malaysia. That failure to prioritise and dutifully ensure human rights protection in law enforcement is the major contributing factor of deaths in custody in Malaysia.



Amnesty International Malaysia is concerned that the reported cases of death in custody will further negatively affect the public’s confidence in public agencies legislated to protect its rights and interests. The United Nations Code of Conduct for Law Enforcement Officials clearly states that law enforcement agencies are accountable to the people they serve. People approach these agencies with issues of concern and wanting to live in a safe and equitable environment. Obviously these contacts will only be made when the public has trust in the agencies and is confident in their work. The current incidents have undermined public confidence in these agencies and it is critical for the government to strictly uphold human rights and professionalism in law enforcement initiatives in order to restore the public confidence.



Cases of death in custody are illustrative of wider patterns of breakdowns in procedural and supervisory safeguards ensuring adequate health care and the prevention of ill-treatment or torture. In 2006, the Parliamentary Select Committee on The Penal Code and Criminal Procedure Code recommended the establishment of the Coroners Act in Malaysia to enable better procedures for investigation and inquest into death in custody, and for a Coroner’s Court to be established. It has become critical for the government to implement the Coroners Act to provide an accountability mechanism to ensure human rights compliance by law enforcement agencies.



Amnesty International Malaysia also calls for a Royal Commission to investigate all other cases of death in custody including the recent death of Teoh Beng Hock and to address gaps in the current law enforcement system in view of providing critical reform and change in our system. Amnesty International Malaysia further calls on the Malaysian government to enforce strict human rights compliance in all public service and law enforcement initiatives in a transparent and credible manner.

Expressing concern that the recent death of Teoh Beng Hock is a sign that the Malaysian Anti-Corruption Commission (MACC) has gone “rogue”, senior Umno leader Tengku Razaleigh Hamzah said that nothing should be spared in the effort to find out the reason behind the death of the DAP political aide.

Tengku Razaleigh also hit out at the MACC for investigating minor cases while ignoring major examples of graft.

He said that Malaysians no longer feel safe or secure if mere witnesses called in to give evidence to a graft busting agency could be found dead the next day. "I feel it is very bad for a country like this. We have been independent for 50 years. Must people called up for queries end up in a coffin?" he told The Malaysian Insider.

Teoh was the political aide to DAP state assemblyman Ean Yong Hian Wah.

Teoh was called in last Wednesday to assist the MACC in its investigations into alleged misuse of funds by his boss. He was found dead the next day, sprawled on the roof of the adjacent building to the MACC headquarters in Shah Alam.

Police are now probing his death and the Cabinet is expected to discuss widespread calls for a Royal Commission of Inquiry into the tragedy.

Tengku Razaleigh said calls for a Royal Commission of Inquiry into Teoh's suspicious death would be of no use if the government does not follow through on its suggestions, pointing out that the government had ignored the recommendations of previous royal commissions such as the one that investigated the V.K. Lingam case of alleged judge fixing and on improving the police force.

He even likened the sidelining of previous royal commissions to "insulting the King."

The former finance minister also spoke out against the performance of the MACC, pointing out that it has not been as effective as its counterpart in Hong Kong at wiping out the corruption scourge.

He hit out at the commission for allegedly going after potentially minor offences but ignoring the major ones, saying that the current MACC model needs to be reviewed.

"This is a question of death you know. People want to know. I want to know. How could it happen? To a witness, who is going to give evidence and he is not even a suspect over the spending of RM2,400. Some people with millions of dollars, they get away with it and are not called for investigation."
