The case raised racial tensions in Johor as the driver was a young ethnic Chinese woman and the victims were all Malay boys.

Similar scenario to the actual accident (except the actual accident had 30+ malay boys racing brakeless at high speed) :

Update : April 2022 prosecution appealed twice and won : she is now re-sentenced to 6 years jail, and now starts serving her jail term immediately.

JOHOR BARU, April 13 — Sam Ke Ting was today sentenced to six years in prison by the High Court for crashing into eight teenagers riding their bicycles on a road here about five years ago.
The decision was made by High Court Judge Datuk Abu Bakar Katar after the prosecution succeeded in their second appeal against the Magistrate’s Court decision to acquit and discharge the 27-year-old woman last October last year.
Sam had been charged with reckless or dangerous driving, resulting in the death of eight cyclists on Jalan Lingkaran Dalam, Johor Baru on February 18, 2017.
Sam, a clerk, was also ordered to serve six months in prison if she did not pay a RM6,000 fine, apart from being disqualified from driving for three years effective after the completion of her prison sentence.

In his judgment, Abu Bakar said the Magistrate’s Court has erred in failing to decide the respondent’s defence without being under oath.
“The respondent, in her defence, stated that she did not see the group of cyclists at the scene of incident and there were other vehicle that hit the deceased bicycles and drove away. This version had never been raised by the respondent during the prosecution case.
“The Magistrate’s Court made a mistake when it accepted the respondent’s defence for not knowing there would be ‘basikal lajak’ activity during the time of the incident as an excuse to drive dangerously, which resulted in the victims’ deaths.
“The respondent should have drove carefully instead driving fast, causing the incident and she should have realised that the area’s lighting was not bright at around 3.20am,” he said before sentencing.
Sam had earlier appeared at the Johor Baru High Court compound at about 9am wearing a white striped shirt and brown long pants. She looked calm after the sentence was handed down.
Defence counsel Muhammad Faizal Mokhtar urged the High Court to grant a stay of execution on Sam as they would be appealing the case at the Court of Appeal.
However, Abu Bakar rejected Sam’s appeal for stay of execution as they have yet to receive approval from the Court of Appeal.
Johor prosecution director Tengku Amir Zaki Tengku Abd Rahman and deputy public prosecutor Muhammad Syafiq Mohd Ghazali prosecuted the case.
On October 10 last year, the Johor Baru Magistrate’s Court upheld the decision of the accused to be acquitted and acquitted of the charges which occurred on February 18, 2017.
Based on the charge sheet, Sam who at the time of the incident was 22-years-old, was accused of driving a car with registration number JQB 9984 along Jalan Lingkaran Dalam recklessly or dangerously resulting in the death of eight cyclists at 3.20am.
The eight victims involved were Mohamad Azrie Danish Zulkefli, 14 (at the time of the incident); Muhamad Shahrul Izzwan Azzuraimie, 14; Muhammad Firdauz Danish Mohd Azhar, 16; Fauzan Halmijan, 13; Mohamad Azhar Amir, 16; Muhammad Harith Iskandar Abdullah, 14; Muhammad Shahrul Nizam Marudin, 14 and Haizad Kasrin, 16.

Malaysians were outraged at the situation as to why young kids aged 8 to 16 were out at 3am in the morning and cycling very dangerously on a highway.
A policeman, who wishes to remain anonymous, recently decided to share his side of the story regarding these kids.

Zulhazri Abu Bakar shared two videos and his policeman friend’s message on his own Facebook. He wrote,
“The truth behind the story.”

“These kids aren’t only around JB area. In fact, they are from Plentong, Pasir Putih, Masai, Tampoi, Kempas, Skudai, Tiram, and even from Kota. The group of them go to JB not only once or twice.
“You can say that they go there every weekend.

“It is not that we (the police) didn’t scold them or try to stop them. We always do that and sometimes even using the loudspeaker (to do so).”

In the 1st video, children can be seen riding their bicycles dangerously on the main road. Despite the police bike’s siren going off, it doesn’t phase them as they continue to ride.

“Some of us lost our patience and threw those bicycles away. It is not that we are trying to be malicious, but we just want to remind them so that they’ll be scared and stop doing it.

“But it was all in vain because these kids are free from their parents’ supervision.

@glockman
“When you head towards them, they will shout and taunt the police by raising their bikes by the road side. That’s how it always is.

“These children don’t ride their bikes on the road shoulder but actually in the MIDDLE of the road. Which is where their lives are taken away. They love to play in the middle of the road without any care for their own safety.

“Each and every one of our warnings have been ignored.”

In the 2nd video, you can see the youngsters on their bicycles doing dangerous stunts. But not only that, there are guys who look to be in their late teenage years and probably young 20’s too.

“When something like this accident happens, who is to be blamed?”

“Of course, 50% of the blame is on the police for not taking appropriate actions, but in fact, where are the parents’ or guardians’ role in this?

“Children who are in the midst of growing up definitely want freedom and to have fun until they are willing to lie to their parents with excuses and promises as long as they get to go out.

“But why some are allowed to go out for days, and some can go out in the morning and only go home the next morning? Where are the parents when these happen?

“Most of these kids are as young as 10 years old and up to the early 20’s.”

Completely saddened by the accident, the policeman could only wish that nothing else would happen.

“Regardless of what has happened, may nothing else happen to us and to those who have brains to think properly.”

Even another traffic policeman added in the comments section, “We are tired. It’s difficult to talk to them. They are still like that.”

Truly, children have become rampant these days where they can be seen out and about in the middle of the night – as though they have no parents’ supervision at all.

And to think that our dear prime minister recently sectioned RM30 million just to build a race track for mat rempits!

Sam Ke Ting was charged with causing the death of eight cyclists at Jalan Lingkaran Dalam in Johor Bahru at 3.20am on Feb 18, 2017. (Bernama pic)
PETALING JAYA: Bukit Gelugor MP Ramkarpal Singh has urged Sam Ke Ting to appeal the six-year jail sentence and RM6,000 fine imposed by the Johor Bahru High Court for reckless driving in connection with the death of eight teenagers on modified bicycles.
In a statement today, Ramkarpal, a lawyer, said Sam should file an application for leave to appeal against the decision to the Court of Appeal as she had been acquitted twice before by the magistrates’ court.

“Every effort should be made to appeal the High Court’s decision to the Court of Appeal immediately, particularly in light of the fact that Sam had previously been found not guilty of the offence she was charged with.
“In the event leave is allowed by the Court of Appeal, Sam can apply for a stay of execution of her sentence and be released on bail pending the appeal,” he said.

He added that the magistrate had previously made various findings of fact resulting in the acquittals, which under normal circumstances would not be interfered with on appeal, unless found to be perverse.
“Although the High Court has the power to reverse the findings of the magistrate, this is normally not done as appellate courts are usually slow to disturb the findings of fact of a lower court.
“Whether the learned High Court judge had committed any error in justifying leave to appeal to the Court of Appeal remains to be seen, after a careful study of his grounds of judgment.”
He said the DAP’s legal bureau was prepared to provide legal assistance to Sam and her legal team in the filing and hearing of the application for leave to the Court of Appeal.

Earlier today, Sam’s lawyer had asked for a stay of execution to appeal the decision at the Court of Appeal, but High Court judge Abu Bakar Katar (photo above) rejected this and instructed Sam to begin her sentence today.
Her lawyer, Faizal Mokhtar, had told FMT that they hoped to file an appeal at the Court of Appeal by tomorrow.

Sam, who had been charged with causing the death of eight cyclists at Jalan Lingkaran Dalam in Johor Bahru at 3.20am on Feb 18, 2017, was acquitted and discharged by the magistrates’ court on Oct 28, 2019 at the end of the prosecution’s case without her defence being called.

However, on Feb 18, 2021, the Johor Bahru High Court ordered Sam to enter her defence after allowing an appeal by the prosecution. On Oct 10, 2021, the Johor Bahru magistrates’ court again acquitted and discharged her.

The prosecution then appealed again at the High Court.

Matland Court really prata. I think this Fucktard Judge is pandering to the the feelings of the Malays instead of being impartial. Probably some political pressure too since the dead parasites were all Bumis. But the problem is even many Malays said she's innocent and these dare devil parasites were the ones at fault. The previous Judge who ruled in her favour was spot on in her judgement. I feel for this young lady. Actually she deserved some sort of recognition for mowing down these society pests. Before the accident, many young Mats were becoming road pests with their illegally modified bicycles until even the Traffic Police couldn't control them.

She's going to jail for sure. A chink woman kills 8 muud kids in mudland? No way she's getting acquitted at the end of the trial. There will be appeals after appeals until she goes to jail for a very very long time.
