But nowadays very common for people to have cross nationality names. I have sinkie friends who call themselves Kimura, Yumiko, Giggs Tan. Stupid people.

Taiwan's judiciary system has been coated by colors like their politics and you can fall off your chair at how ridiculous verdicts from different re-trials can be as dramatic as flipping pan cakes. Japan had attempted to invade Taiwan several times since the 15th century, but was unsuccessful as the Taiwanese aborigines put up fierce resistance.

When Taiwan was formally given to Japan by the Qing dynasty government, Japan did not need to invade or occupy the island. Mainland China treated Taiwan like shit anyway. So there was not much Taiwanese animosity to Japanese rule, unlike the Chinese in Singapore/Malaya during WW2.

And Japan had developed Taiwan a lot during those 50 years. Today, the education system, culture, transport system, even entertainment variety shows of Taiwan greatly resemble Japan's.

Perjury relates to court proceedings or a testimony in a judicial settings. Telling lies or giving false statment to the Police is not perjury. Accused person giving false statements are never charged for giving statements if not most people will end up with 2 charges - one for the original offence and the second for giving false statement which is not case. Accused persons are more likely to give false statement to avoid culpability and its a natural human reaction as a result of self preservation. The law and the court recognises that. No accused is also going to be charged in court for telling lies (perjury) in court as he will try and save himself. The court will just find his testimony untruthful and find against him.

The only time the Police will charge someone for false statement is when informants or complaints making false allegations intending to cause harm to innocent parties.

Injury of this nature cannot be settled or compounded. There is no country in the world that allows such a thing. Common sense will tell you that it will only benefit the rich. There will be mayhem in the streets with rich kids getting away with absolute abuse.

眼看Makiyo等人將面臨重刑，而且連律師都不願意接案；但究竟這起Ma幫風波到底還有沒有轉圜的空間呢？NOWnews《今日新聞網》特別專訪「天一法律事務所」律師林紹源，來替關心Ma幫風波的社會大眾作分析。

Ma幫生機　「最短時間內」拿錢和解

林紹源律師認為，Ma幫的最後生機，就是在「最短的間內」，趕快拿一筆錢和被害林姓計程車司機「達成和解」，否則時間越拖，對Makiyo等人越不利；因為，就目前媒體的報導看來，林姓計程車司機應該還未達「重傷害」程度，只要完成和解，Makiyo等人就可以全身而退，不必負擔刑責。

因為，「普通傷害罪」是告訴乃論之罪，只要被害人願意原諒加害人，是可以「撤銷告訴」的； 但「重傷害罪」是屬於非告訴乃論之罪，國家有追訴權力，不論被害人是否原諒，檢察官都會對加害人「提起公訴」。

所以，Makiyo 和友寄隆輝必須要在被害司機，尚未達到「重傷程度」時，趕快達成和解；只要一旦達成「和解」，就算在和解後被害司機的傷勢立即轉為重傷程度，也不會影響先前所達成的和解效力，才能避免重刑。

丫子、湘瑩　恐難全身而退

至於丫子和湘瑩的偽證部分，林紹源律師表示，由於「偽證罪」屬7年以下有期徒刑，依法不得易科罰金。而且由於偽證罪所保護的法益是「國家法益」，目的是確保偵訊、審判的真實性；因此，一旦在偵訊或審判程序中，有不實的論述出現，就會構成「偽證」犯行。要想全身而退，恐怕不容易。

但他也指出，目前要將傷害降到最低的辦法只有一個，就是在審判終結前，趕緊承認說謊；因為，刑法第172條規定，對於虛偽陳述或誣告，只要在裁判或懲戒處分確定前，自白坦承作偽證的話，依法都可以減輕或免除其刑。
