SINGAPORE - A teenager sexually abused his younger sister as he begrudged his parents for leaving him and his sister in the care of his grandparents while they went overseas to study.


Yesterday, the 18-year-old student was sentenced to reformative training. He was 16 at the time and the victim was 10. Neither can be named for legal reasons.


District Judge Mathew Joseph, who took three other charges into consideration, found the case "deeply disturbing". He said the accused abused his position of trust and, instead of minding and guiding his younger sister, he became her "tormentor".


The court heard that the Malaysia-born boy got home on Sept 26, 2013, and sat next to his sister, who was ill and watching television. He apologised to her for having torn a box of hers but she did not say anything to him. He then molested and sexually abused her. After the incident, he told her not to tell anyone about it.


The offence came to light on Oct 1 that year when a school counsellor asked her about her home environment.


Deputy Public Prosecutor Gabriel Choong said: "The accused had committed the offence both out of sexual curiosity and out of vengeance against his family.


"The accused has a poor relationship with his parents and begrudges them for leaving him in the care of his grandparents while they went to the United States to study."

Man jailed for taking video of 15-year-old in changing room

A 15-year-old shopper was planning to show a new sari to her sister when she took a video of herself in a clothing store's changing room.


But the video revealed more - that a camera was watching her as she undressed.


Yesterday, for intruding on the privacy of the shopper, 34-year-old Mohamed Yousuf Abuthahir was sentenced to a month in jail, backdated to Jan 15.


On the night of Jan 9, when the girl was in the changing room of Fashion Palace in Buffalo Road, where he worked, he placed his mobile phone beneath the changing room door with its camera facing her.


According to court documents, it was around 8pm when the victim went to the second level of the shop. The business relationship manager was the only employee working on that floor then, and attended to her.




She went into the changing room to try on a sari and took a video of herself, planning to show it to her sister before deciding if she would buy it.


Later that night, when reviewing the footage, she noticed a white mobile phone in the gap between the bottom of the changing room door and the floor.


Recalling that the male employee was the only person outside the changing room, she lodged a police report the following day .


Closed circuit camera footage showed the man walking to the changing room with a white mobile phone in hand around 8.20pm.


He later admitted taking the video.


The video had footage of the victim changing clothes and, at one point, her upper body was covered by only her bra.

He would sneak up on couples getting intimate at the stairwells of Housing and Development Board blocks, film them, and then abuse his authority as a full-time Police National Serviceman to extort from them.


On one such instance in 2014, Muhammad Shazwan Sapuwan, 23, got sexually aroused and raped a 16-year-old girl in front of her boyfriend.


Today (Feb 1), he was sentenced to 18 years’ jail and 15 strokes of the cane for one count each of rape, sexual assault by penetration, outrage of modesty, and extortion. Five other charges were taken into consideration.


In sentencing Shazwan, Judicial Commissioner Foo Chee Hock said his acts warranted a deterrent punishment to reflect society’s “abhorrence of such grievous offences”.


A High Court heard that on the afternoon of Oct 24, 2014, Shazwan trailed a couple to a block of flats at Teck Whye Lane, where he took photographs of their sexual acts, from one storey above where they were.


When the couple were done and were tidying themselves, Shazwan — dressed in a Jurong Police Division polo T-shirt and blue police pants — approached them, flashed his warrant card and asked for their particulars. Shazwan told them they had committed an offence of “public nudity”, the court heard.


Fearful that her parents would find out about the tryst, the girl, who was then 16 years old and who cannot be named to protect her identity, begged Shazwan to let them go.


Shazwan asked what he would gain by that, adding that he was a sergeant who had worked in the police force for three years and did not want to lose his job.


After one-and-a-half hours of negotiations, Shazwan said he would only delete the earlier clip of the couple’s tryst captured on the “system” on one condition: They would have to repeat their sexual acts so he could record them on his mobile phone.


Shazwan explained that he wanted to record them on his mobile phone so that he would have leverage to ask them for money, if he lost his job.


Although the 18-year-old boyfriend initially resisted, the couple eventually complied out of fear and because of Shazwan’s incessant pressure.


In the midst of recording their acts, Shazwan touched the female victim’s hand and asked her boyfriend if he would be “mad” if he were to touch her. Fearful that Shazwan would tell on them to the authorities, the couple decided to agree with all his demands. Shazwan then sexually assaulted her.


When he was done, Shazwan told the couple he would leave first and call the couple “when there were no more police officers around”.


Two days later, Shazwan sent the male victim a text message to ask for “help”, claiming he had lost his job. He demanded S$40, which the male victim paid up, because he feared the video clip of the tryst would be circulated.


The following day, the female victim confided in her friends about the incident. They encouraged her to report the matter.


According to a victim impact statement tendered to the court, the victim felt humiliated and ashamed by the episode and started to shun social gatherings and male counterparts. She also had thoughts of committing suicide.


The court also heard that the girl’s mother had to accompany her to sleep as she was fearful of being alone at night.


Pressing for a deterrent and retributive sentence, Deputy Public Prosecutor Sellakumaran Sellamuthoo said Shazwan not only abused his status of authority as a police officer, his “brazen” behaviour had also tarnished the reputation of the police force.


“Instead of upholding the law to protect life and property, the accused had lawlessly and brazenly abused his authority ... to act to the detriment of those whose interests he was supposed to safeguard,” said the DPP.


His offences were premeditated, the prosecution also charged, citing how he had previously targeted two other couples using the same modus operandi. According to court documents, a total of S$1,960 was extorted from multiple victims.

The third time he carried out his modus operandi, Muhammad Shazwan Sapuwan, 21, went one step further - he raped a 16-year-old girl he had "caught" in intimate acts with her 18-year-old boyfriend.
On Monday (Feb 1), Shazwan, now 23, was jailed 18 years and ordered to be caned 15 strokes after he pleaded guilty to rape, oral sex, outrage of modesty and extortion. Five other charges for extortion, cheating and sexual assault were taken into consideration.
The court heard that on Oct 24, 2014, Shazwan followed the couple and used his phone to take pictures of them having oral sex.
He then approached them, identifying himself as a police officer. At the time, he was wearing a Jurong Police Division polo T-shirt, his blue police trousers and a lanyard that displayed his police warrant card.


Shazwan asked for their particulars and threatened to report them for public nudity. He told the couple that he would "submit" their names as he did not want to lose his job.
After an hour of talks, he suggested that they repeat their intimate acts so that he can record them. He told them that if he were to lose his job, he would use the video recording to threaten them for money.
The girl, who did not want her parents to find out about the acts, convinced her boyfriend to comply.
While the couple were performing sexual acts, Shazwan touched her breast and forced her to perform oral sex on him.
He then told the boyfriend to have sex with the girl but the teenager refused. Shazwan then raped the girl.
After leaving the scene, Shazwan communicated with the boyfriend on WhatsApp and demanded $40 by the next morning. The boyfriend eventually transferred the money to him.
Three days later, the girl started crying in front of her friends in school and told them what had happened. Her friends managed to find Shazwan's identity on Facebook and encouraged her to make a police report.

Then a Special Constable Corporal, the 21-year-old wore his police warrant card to frighten the teenage couple after he caught and photographed them having sex on a staircase landing at a Housing Board block.


Threatening to take them to a police station, he told the couple he would let them go only if they let him record a video of the then 16-year-old girl performing oral sex on her boyfriend, also 16.


Even though the frightened couple complied, Shazwan proceeded to rape the girl while the boy looked on helplessly.


Yesterday, Shazwan, now 23, was sentenced to jail for 18 years and 15 strokes of the cane after pleading guilty to one count each of rape, sexual assault by penetration, outrage of modesty and extortion.


A second sexual assault by penetration charge involving the girl, one count of cheating and three other extortion charges were taken into consideration.


The court heard that Shazwan had other victims.


On separate occasions in 2014, he snuck up on two couples behaving intimately at HDB staircases and recorded them on video.


After introducing himself as a police officer, he cheated one of his victims out of $200 in August that year and extorted cash totalling $1,720 from another the following month.


The court heard that on Oct 24, 2014, Shazwan tailed the 16-year-old couple to a staircase landing and photographed them having sex.


Deputy Public Prosecutor (DPP) Sellakumaran Sellamuthoo said the girl had met her boyfriend after school at around 1.45pm that day and they went to a block of flats in the north-western part of Singapore.


They went to a staircase landing on the seventh storey where they got intimate and the girl performed oral sex on the boy.


Shazwan, who had followed the pair, spied on them from the eighth storey. He snapped two photographs of the couple.


When they were done, Shazwan came forward. He wore a lanyard displaying his police warrant card.


DPP Sellakumaran said he was also wearing a Jurong Police Division Headquarters polo T-shirt and a pair of blue police pants.


Shazwan took down the teenagers' particulars and told them they had committed an offence of "public nudity".


When the girl told him she did not want her parents to find out about the incident, he replied he would help the pair, but at the risk of losing his job. He then engaged them for about an hour for a solution.


As a bargain, Shazwan suggested filming them having sex. The boy was against the idea, but Shazwan insisted it was their only option. Out of fear, the couple eventually gave in.


While filming the teenagers, Shazwan decided to join in and forced the girl to perform oral sex on him.


He then raped her.


Shazwan left the scene once he was done, but told the couple to stay put.


At around 5pm, he called the boy to tell him they could go home.


But he was not done.


Two days later, Shazwan contacted the boy and asked for $40. He threatened him with the sexually explicit videos.


The teenager complied and transferred the money over in two transactions.


Three days after her rape, the girl met her friends at school and started crying as she could not control herself any more.


DPP Sellakumaran said: "She disclosed the incident to her friends. Her friends managed to find the accused's identity through his Facebook profile and they encouraged her to make a police report.


"Later that day, the victim disclosed the matter to her family who then accompanied her to make a police report."


Shazwan was arrested hours later.


DPP Sellakumaran urged Judicial Commissioner (JC) Foo Chee Hock to sentence him to 18 years' jail with between 12 and 15 strokes of the cane.


He said: "Instead of upholding the law to protect life and property, the accused had lawlessly and brazenly abused his authority as a police officer to act to the detriment of those whose interests he was supposed to safeguard."


Before handing down the sentence, JC Foo said the sentence must be a deterrent one to "reflect society's abhorrence" of such offences.


Responding to queries from The New Paper, the Singapore Police Force (SPF) said: "Officers of SPF, including national service officers, are expected to uphold the law and set a good example by maintaining high standards of discipline and integrity.


"Those who commit offences will be charged in court and dealt with in accordance with the law."


For rape, Shazwan could have been jailed up to 20 years and fined or caned.


For extortion, he could have been jailed up to seven years and caned.
What can an officer with a warrant card do?


Police officers with warrant cards can ask members of the public they approach for their identification.


Former police officers The New Paper spoke to said the officers can also search them for items like dangerous weapons.


Mr Davy Chan, who was a policeman between 1967 and 1979, said that the officer can touch areas such as the person's waist or thighs.


He added: "But note that only a female officer can touch a woman.


"Officers are also not allowed to tell the people they approach to strip."


Mr Joseph Tan, who served in the police force from 1985 to 1992, said police officers tend to approach people whom they think appear suspicious.


Members of the public then have to cooperate with the officers.


Mr Tan, who founded the Crime Library, a voluntary group that helps track missing people, said: "If somebody does not have his ID with him, the officer may even accompany him or her home to obtain it.


"The officer can then exercise discretion on what to do next - whether to give a stern warning, let the person go or conduct an arrest if any offences were detected."

A Singapore Institute of Management student who recruited two girls to be sexually exploited was jailed for six years and three months and fined $30,000 yesterday, the first person to be prosecuted under the Prevention of Human Trafficking Act.


Muhammad Khairulanwar Rohmat, 25, admitted to four of 18 charges - three under the Act for recruiting a child for sexual exploitation and receiving earnings from a trafficked victim, and one under the Penal Code for sexual penetration of a minor.


Khairulanwar, who was represented by Mr Ferlin Jayatissa, had other charges taken into consideration during sentencing.


Under the Act, if the victim is below the age of 18, the perpetrator is considered to have trafficked him or her even if he used no coercive means to do so. It is enough that one recruits, conveys or harbours a child with the intention of exploiting the child.


The maximum punishment under the Act, which came into force in March last year, is a $100,000 fine, 10 years' jail and six strokes of the cane.


The month after the Act was enacted, Khairulanwar offered a modelling job to a 15-year-old girl, provided she was willing to perform "extra" duties, including having sex with her customers. She rejected his offer, said Deputy Public Prosecutor Chee Min Peng, who was with DPP Amanda Chong.


But she met him at the Starbucks cafe in Centrepoint two days later, when he told her he had a modelling job for her. Identifying himself as "Khai", he briefed her on how much she would be paid and told her he would need to assess her body without clothes on. At that point, she agreed to the price as well as to provide sexual services.


She then followed him to a male toilet at Cuppage Plaza, where he took photographs of her in the nude and sexually abused her.


He continued to send her texts after that meeting to convince her to take on prostitution jobs.


His other victim, now 17, met him thinking he was a client, at the Five Tapaz bar in Cuppage Terrace.


She had answered an advertisement, posted by Khairulanwar under the pseudonym Mrdotdotdot, for a job offering "fast cash... in nightlife environment, drinking and entertaining customers".


But she refused his request for sex and excused herself to use the toilet when she became afraid.


Minutes later, posing as Mrdotdotdot, Khairulanwar called and persuaded her to return to say goodbye to the client.


When she did so, the client, "Khai", took her to the toilet where she performed a sexual act on him.


After that night, he persisted in pressuring her to prostitute herself. He would pose as Mrdotdotdot to intimidate her and Khai as an empathetic confidant.


Refusing to have anything more to do with Mrdotdotdot, whom she found rude, she turned to Khai, who offered her a "better" job.


Khai gave her alcohol to "train" her to drink and had sex with her, which he filmed, in a hotel.


From then on, he began to arrange customers for her. At least once, she gave him $50 out of the $450 she had received from a customer.


DPP Chee said Khairulanwar received a total of $5,730 from earnings by her and other prostitutes.


In his brief grounds of decision, District Judge Mathew Joseph said human trafficking is an abhorrent crime that degrades common humanity. It is a modern form of slavery involving forced labour, organ trafficking and sexual exploitation.


He agreed with the prosecution that there were aggravating factors. In a clear pattern of moral corruption, Khairulanwar exploited his victims' desire for work to persuade them to sell their bodies.


He was cunning and deceitful in posing as different people to trick the second victim, and devious in applying pressure on both, whom the judge labelled as "little lost children", to engage in sexual acts with him before introducing customers to them. "This was reprehensible as it was a double exploitation of a vulnerable child," he said.

SINGAPORE - A deliveryman, who had unprotected sex with a 15-year-old girl, wanted to hand her "abortion pills'' when he found out she was pregnant.


But before Nuzul Shamil Kassim, 24, could do so, he was arrested by the police. She underwent an abortion on her own accord.


On Friday (Feb 19), Shamil was jailed for 20 months after he pleaded guilty to three counts of underage sex with a minor at his Jalan Tenteram flat in May and July last year.


Seven other charges including one of committing an indecent act with her were taken into consideration during his sentencing.


Deputy Public Prosecutor Li Yihong told the court that the pair met through a mutual friend some time in April last year.


They exchanged contact numbers and went out with a group of mutual friends on a number of occasions.


In the first week of May, she asked him to be her "boyfriend'' but he did not agree straightaway and only did so on May 10.


Shamil later told police that he did so because he "pitied'' her. He did not wish to go public with the "relationship" and they behaved like they were ordinary friends.


Some time between May 11 and 22, he invited her to his home and he introduced her as his "girlfriend'' to his sister.


When it got late, the girl decided to stay over at Shamil's home out of convenience.


She slept on the same mattress as him, together with his younger sister and the latter's boyfriend.


While everyone was asleep, he removed her trousers and his as well while both of them were underneath a blanket. She initially tried to stop him as she was afraid others would see them but he assured her that they would not.


He had unprotected sex with her.


DPP Li said after this, she began going over to his home about once or twice a week. He initiated sex with her each time and on at least one occasion, he made her perform oral sex on him.


Shamil broke up with her on July 8. He had stated that this was because he only "liked her a bit''.


When she found out she was pregnant the following month, she told him. He told her to go for an abortion. He enlisted the help of his sister to buy "abortion pills'' but he was arrested before he could hand over the pills to her.


DPP Li said it was aggravating that Shamil had committed 10 offences over a short span of time. She also highlighted the trauma the victim had to go through with an unwanted pregnancy and how little Shamil was concerned about her welfare.


In this case, she said there was a degree of exploitation which should be a more pressing factor.


The maximum penalty for the offence is 10 years' jail and a fine.

A 33-year-old safety coordinator went on trial in the High Court yesterday for raping and molesting his biological mother at their home.

The bespectacled, clean-cut man, who faces one count each of rape, molestation and aggravated molestation, pleaded not guilty to the three charges.

The alleged offences were committed at about 2.30am on Oct 4, 2013, in the family's one-bedroom flat.

Besides allegedly raping his 56-year-old mother, the man is accused of restraining her as he molested her.

He cannot be named as a court order bars the publication of any information which could lead to the identification of the woman.

Opening the prosecution's case, Deputy Public Prosecutor Sellakumaran told the court that the man, the second of three sons, lived with his mother and stepfather in the flat.

In the early hours of Oct 4, 2013, the victim was alone at home sleeping when her son returned.

During the trial, the court will hear testimony of how the accused "molested and raped his own mother despite her pleas for him to stop", the DPP said.

He told the court that, after the alleged attack, the victim left the flat at 6am - the earliest available opportunity - and made her way to the home of one of her other two sons.

Along the way, she called the accused on one of her mobile phones and used the other one to record their conversation about what had transpired in the flat earlier that morning.

The audio recording will be played during the trial for the court to hear the victim's distress and how she was struggling to make sense of the accused's actions, the DPP said.

The prosecution will present evidence from 22 witnesses, including the victim's extended family, who will testify that she was visibly distraught and distressed when they met her hours after the alleged sexual assault.

Doctors who examined the victim will also take the stand.

The first witness to testify yesterday was a DNA analyst from the Health Sciences Authority who examined the victim's blouse, although two samples found on it were too weak for confirmatory tests.

The courtroom was then cleared for the victim to testify. She will return to the stand when the trial continues on Thursday.

The man, first charged in 2013, was originally scheduled to go on trial in November last year.

But the trial was postponed so he could decide if he wanted prominent lawyers Harry Elias and Chelva Rajah to defend him under the Law Society's Criminal Legal Aid Scheme.

He had previously changed two sets of lawyers.

A team led by Senior Counsel Elias is currently representing him.

Rape carries a sentence of up to 20 years' jail, and caning or a fine.

Aggravated molestation carries a punishment of between two and 10 years' jail and caning; molestation carries up to two years' jail, with caning or a fine, or both.

A woman, whose husband raped her teenage niece, told the girl not to tell the doctor that she had consumed bleach because she was distraught over the sex attack.

This was to prevent the husband's crime from coming to light, a District Court heard yesterday.

The 47-year-old woman - the girl's paternal aunt - was sentenced to six months in jail after pleading guilty to perverting the course of justice.

Another charge of failing to report to the police when she had reason to believe her husband had committed rape was considered during her sentencing.

Her 55-year-old husband is now serving a 20-year jail term for raping the girl and other offences.

Deputy Public Prosecutor Michael Quilindo said the woman was asleep in the master bedroom of the flat in Woodlands on the afternoon of Dec 20, 2012, when her husband raped the then-14-year-old girl in the living room.

Distraught over the sexual assault, the teenager drank a solution of water, bleach and soap powder and began vomiting.

The woman - who is not named so as not to identify her niece - heard her being violently sick and found out from her husband what had happened.

As the girl was very distressed, the woman realised that her niece had not consented to sex.

The man dissuaded the woman from taking the girl to hospital, saying it would result in a police report.

The woman took the girl to a private clinic and told her not to tell the doctor what she drank.

A few days later, she gave her niece $50, claiming that it had been given to her by a relative. She asked for another chance to "protect her".

However, the offences came to light in January 2013, when the girl's school counsellor queried her on her lengthy absence from school.

Pleading for leniency, the woman's lawyer Rajan Supramaniam said his client regretted her foolishness and extended her sincere apologies to the victim and her family.

DPP Sharmila Sripathy-Shanaz said the adult who ought to have protected the girl chose instead to silence her.

If the deception had continued, the victim would have continued living with her tormentor.

"Victims of familial sexual abuse invariably feel additional pressure from family members not to expose the rapist, out of a misguided reaction to preserve the unity of the family," she added.

District Judge Crystal Ong said this was a very serious offence of rape. It took place within the family, which made it even harder to detect, and allowed the accused to abuse her relationship with the victim to obtain her silence.

The maximum punishment for the offence is seven years in jail and a fine.
 
A 45-year-old construction worker who molested a 27-year-old woman on an MRT train in August was on Friday (Sept 9) jailed for four weeks.
Murugaiyan Kaviarasu pleaded guilty to one charge of outrage of modesty.
A district court heard that the victim boarded the train at Yew Tee MRT station at about 4.40pm on Aug 13.
One stop later, at Choa Chu Kang MRT station, Kaviarasu, an Indian national, boarded the train and sat to the right of the victim, though the train cabin was fairly empty.
He then leaned towards the victim, such that his left shoulder touched her right shoulder.
The victim moved away from him, but that did not deter Kaviarasu, who moved closer towards her.
He placed his left arm by his side and leaned towards her again, before using the back of his left hand to brush against her right thigh several times.
The victim stared at Kaviarasu, who then placed his hands on his haversack on his lap.
Shortly after, the victim heard a female passenger sitting opposite her remark that the molester was moving his hand towards her again.
The victim stared at Kaviarasu again and he placed his hands back on his haversack.
As the train was approaching Jurong East MRT station, the molester again placed his left arm by his side and tried to touch the victim's thigh but did not manage to do so.
Kaviarasu then alighted at Jurong East MRT station, but the victim grabbed his haversack and prevented him from leaving the train platform. She called the police.
Kaviarasu repeatedly said "sorry" to the victim.
In mitigation, the construction worker told the court that he had been working in Singapore for eight years with a clean record.
He said he had a few drinks at a party before taking the train, and was too intoxicated to remember his actions. He added that he is the sole breadwinner of his family, with two children and elderly parents to care for.
Kaviarasu's sentence was backdated to the date of his remand on Aug 15.
For using criminal force to outrage the modesty of a person, he could have been jailed for two years and fined and caned.

SINGAPORE — A 35-year-old man has been arrested for allegedly molesting a 17-year-old girl in a lift along Bedok Reservoir Road on Saturday night (Sept 10).

The police said the victim filed a report at about 10.23pm that night. After reviewing CCTV footage, polce arrested the suspect at his home in the same estate within six hours of the report.

The suspect will be charged in court on Monday with the offence of Aggravated Outrage of Modesty under Section 354A (1) of the Penal Code, Chapter 224. If convicted, he faces a jail term of between two and ten years with caning.
