Yes u are right,,,the reason why is cos all these wives of pappie dogs like u need to be always constantly in the good books of the pappies. If not your wealth etc will disappear overnight. SINGAPORE - Husbands who force themselves on their wives will not get immunity from being prosecuted for rape, under a recommendation tabled by a committee tasked to review the Penal Code.

The committee, convened by the Ministry of Home Affairs and Ministry of Law in 2016, called for a "full, unqualified repeal of marital immunity for rape" aimed at providing all women, married or unmarried, protection from sexual abuse.

In a letter to Law and Home Affairs Minister K. Shanmugam, dated Aug 31, the Penal Code Review Committee, led by Minister in the Prime Minister's Office Indranee Rajah and Senior Parliamentary Secretary for Home Affairs and Health Amrin Amin, said that its extensive review involved modernising the Penal Code, as "many of the reasons underpinning the previous state of the law are rooted in societal norms which we believe no longer exist in Singapore society".

After two years of discussions, the committee submitted its report to the Government on Aug 31 this year, recommending a full repeal of the marital immunity for rape, along with other recommendations including decriminalising attempted suicide and enhancing the punishment for offences against vulnerable persons, such as the mentally disabled as well as maids and minors aged below 14.

Mr Shanmugam said: "The Penal Code has gone through a series of amendments over the years. Obviously, as society changes, the nature of the offences change, you keep changing. Intentions are the same, you want to update. This time, I think, it is taking into account all these changes, it's taking a step back and looking at it comprehensively and trying to fit them all together."

Up till 2007, Singapore did not recognise marital rape - that a husband could rape his wife. That year, the law was amended to recognise marital rape under certain circumstances which signalled a breakdown in the marriage, such as if the husband and wife were living apart under an interim judgment of divorce or written separation agreement, if divorce proceedings had begun, or if the wife had commenced proceedings to or had already obtained a personal protection order against her husband.

The repeal would provide equal access to protection for sexually abused wives and ensure consistency with other sexual offences.

At present, husbands cannot invoke marital immunity for the outrage of modesty, also known as molest, which can carry a penalty of up to two years' jail, or a fine or caning. This includes inappropriate touching on a bus, for example.

The penalty increases to up to 10 years' jail, with caning for cases of aggravated outrage of modesty. These involve additional elements such as threatening to cause hurt or restraining or putting the victim in fear, such as restraining her in a lift against her will.

Yet, husbands have marital immunity for rape.

The maximum penalty for rape is 20 years' imprisonment, as well as fine or caning.

Said Mr Shanmugam: "The changes they are recommending, I have talked about some of them in the last two years as to what we would like to see as well. Women, for example, I have thought it odd that we still have immunity for husbands who rape their wives. A women's body is her own. And even if she is your wife, she is entitled to say no. And no means no. So that, they are proposing to repeal the immunity. "

There has been a marked global shift towards criminalising marital rape. The United Nations (UN) General Assembly declared marital rape a human rights violation in 1993. Currently, more than 100 countries do not grant marital immunity for rape, including the United Kingdom, South Korea and Thailand.

In 2009, local advocacy group No To Rape called for a repeal of marital rape immunity in an online petition which garnered more than 3,600 signatures.

In 2011, local non-government organisations such as the Association of Women for Action and Research (Aware) called for the repeal of marital immunity in their submissions to the UN Committee on the Convention on the Elimination of Discrimination against Women, for Singapore's fourth periodic report.

Aware's executive director Ms Corinna Lim welcomed the recommendation. "A long overdue, full and unqualified repeal of marital immunity for rape would be a momentous step forward for women's rights," she said.

"The repeal would be powerful signal that the state does not condone any form of violence against women, including within marriage."

SINGAPORE: It will be challenging to prove a lack of consent in cases of marital rape, criminal lawyers said, pointing to the intimacy associated with marriage and the fluid nature of consent.

As part of sweeping changes to the penal code, a review committee had on Sunday (Sep 9) proposed abolishing marital immunity for rape, garnering praise from women's rights groups and members of the legal community.

But Mr Ramesh Tiwary, a criminal lawyer who runs a solo practice, told Channel NewsAsia that proving rape in a marriage adds "certain complications to what exactly is consensual, and how clear must that consent be".

“If you had a continuing and lengthy relationship like a marriage, I think you’ll have greater complications (than in other types of relationships),” he said. “Are you supposed to get consent from your wife every time?”

Hilborne Law managing director Rajan Supramaniam said lack of consent in a marriage is difficult to prove because of the "sexual intimacy" within the relationship.

"Whatever transpired is very private between them and that makes it difficult to find the truth," he added.

Another concern, the lawyers said, is the retracting of consent following a "trigger factor" like a heated argument.

"The wife might put up with a certain behaviour, but when something else happens, she might raise it as an offence," Mr Tiwary said.

Mr Sunil Sudheesan, who heads the criminal department at Quahe Woo and Palmer, said it "has always been tricky" to determine if sex between parties in a relationship was consensual.

"Because it’s anybody's say as to whether there was consent or not if there are no injuries," he added, stating that lawyers would usually look for "objective identifiers" like the use of force.

PROVING MARITAL RAPE

Ms Corinna Lim, executive director of the Association of Women for Action and Research (AWARE), acknowledged the difficulty of proving rape in cases involving partners who share an intimate relationship due to a "much heavier focus on consent".

However, she said that marital rape cases could present a different set of corroborating evidence, which includes a history of domestic violence.

"Timely medical examination, witness testimony, eyewitnesses before or after the assault, secondary witnesses and possible admission by perpetrator on texts can all help to secure conviction like any other sexual assault case," she added.

"Just because it is difficult to prove, we cannot ignore a crime."

Still, Ms Lim said cases of marital rape might go unreported because of the "deep misconceptions and stigma" that continue to surround any kind of sexual violence.

"Many also still harbour outdated gender roles and expectations, believing that a husband is 'owed' sex from his wife," she added.

Furthermore, marital rape victims might choose not to speak up "for the sake of their children and to keep their family intact", said Singapore Council of Women's Organisations 1st vice-president Junie Foo.

"Shifting mindsets will take time and education," she said. "The better way is to seek help early and protect themselves."

CURRENT LAW

And then there's the issue of legislation.

Family therapist Evonne Lek said some of her patients are reluctant to report marital rape as "they do not believe that the law will be on their side".

"If I suspect domestic violence, I often have to ask specific questions like whether they were forced to have sex," she said. "Then I will have to educate them that when they are forced to have sex, even though they are married, it is considered rape."

Currently, a man can still be convicted of raping his wife in certain circumstances, including when the couple had been living apart, or if the wife had applied for a divorce, separation or personal protection order (PPO) before the alleged offence.

Family lawyer Rajan Chettiar said one in 10 cases he's handled involved women saying they've had their husbands force sexual intercourse on them.

"This is usually raised by the female client when she wishes to file for divorce," he said. "We will use this fact as an example of the husband’s unreasonable behaviour towards the wife, which is a reason to file for divorce under the Women’s Charter."

Straits Law Practice director Ahmad Nizam Abbas, who handles matrimonial and divorce cases, said he has heard similar accounts, adding that he would bring up the option of a PPO "as their safety is critical".

But if marital immunity for rape is fully abolished, things might change.

Mr Chettiar said he would then advise clients to make a police report and "ask the police to press charges against their husbands".

"At the same time, I wonder how many wives will come forward to make such charges against their husbands," he added.

"They will be worried about how this will affect their marriage, how their husband will behave towards them in the future and how this will affect their relationship with their children and their extended families."

Mr Ahmad said there would also be other consequences, including the loss of a source of income. "The impact on the children will be a very important consideration in their decision to speak up or not," he added.

MOVING FORWARD

Nevertheless, AWARE's Ms Lim said the repeal of marital immunity for rape should come with "nationwide public education on sexual violence to dispel traditional gender roles and victim-blaming myths".

"For example, this can be done by implementing age-appropriate consent and gender equality education in schools in order to promote healthier, more equal relationships and sexual relations," she added.

As for the law, the criminal lawyer Mr Tiwary said things "can get pretty complicated".

"I have no doubts that the judges will be well-placed to consider these facts, but their job will become more difficult," he added. "This whole area of consent will have to be re-looked at."

In actual fact for most couples unless you are rohingya or the equivalent, the sex would already be stale after courtship (sex everywhere), even lesser sex after marriage (not all are marksmen and gets a good shot in to conceive a baby immediately), and the least sex (when the kid grows from one to six year old, most of the time too tired to have it, and if have 2 to 5 mins top..ppl die from 12 min 2.4km ippt run lei and admit it who at this stage doesn't want to steal eat)..Don't see how rape comes in and where is the evidence? Marital rape should be under spousal abuse not a law by itself and should apply to both sexes..of course sir John tan is the alpha here!

KUALA LUMPUR: The Malaysian government has no plans to make marital rape a crime because it is difficult to prove such cases in court, said Deputy Minister in the Prime Minister’s Department Mohamed Hanipa Maidin on Tuesday (Oct 30).
If brought to court, such cases often result in the accused being discharged instead of convicted, he added.

“That is why, the government, taking into account all factors, feels it is not the time yet to make marital rape a crime.
“However, if there are cases involving domestic violence, Section 375A of the Penal Code is applied to protect the rights of women,” he said in parliament in response to a question from Petaling Jaya Member of Parliament Maria Chin Abdullah.
According to a Malay Mail report, Hanipa said when rape involves a spouse, there is "inherent doubt" and any benefit of the doubt in criminal cases must be given to the accused.
“We can turn (marital) rape into a crime to protect the women, but what use is it to have a criminal section when the possibility of conviction is very small?” he said in parliament.
