KUALA LUMPUR (REUTERS) - Police on Saturday (May 12) raided a deluxe Kuala Lumpur apartment block at which relatives of ousted Prime Minister Najib Razak had been staying as they searched for sensitive documents the new government fears may be taken out of the country, two senior police officers said.

The swoop came as Malaysia's new Prime Minister, Mahathir Mohamad, said he had stopped his predecessor from leaving the country because of suspected wrongdoing in connection with a multi-billion-dollar scandal at state fund 1MDB.

Police said they were acting after a complaint that a government vehicle had delivered dozens of boxes made to carry designer handbags and other items to the apartment for Datuk Seri Najib's wife, Rosmah Mansor.

Public disgust over alleged corruption was widely seen as one of the reasons behind the unexpected defeat of Mr Najib's long-ruling Barisan Nasional coalition in Wednesday's general election.

Mr Najib has consistently denied any wrongdoing.

A spokesman for Mr Najib could not be immediately reached for comment. Reuters was unable to reach Mr Najib himself, his wife, or other family members and close associates on Saturday night.

Reuters saw about 20 police officers enter the marble-floored lobby of the Pavilion Residences apartment block in the Malaysian capital, just as Tun Dr Mahathir was holding a news conference to announce key members of his Cabinet.

They were aided by at least a dozen other plainclothes law-enforcement officers. Security personnel from the building - which is owned by Desmond Lim, a wealthy Malaysian businessman and supporter of Mr Najib - were cooperative.
"We are looking for government documents that may have been illegally taken," said a senior police officer, who requested anonymity as he was not authorised to talk to the media.

"The government are worried they could be sensitive and important, and could be taken out of the country."

He declined to say whether any documents had been found and described the operation as "ongoing".

According to the police, members of Mr Najib's family had been staying at the apartments, but they declined to name them.

ORANGE BOXES
The police action followed a complaint lodged by two leaders of the youth wing of Dr Mahathir's political party, Bersatu.

The police report of the complaint, reviewed by Reuters, alleges that vans emblazoned with the logo of the department of the Prime Minister and Cabinet delivered boxes for 50 Birkin handbags to Pavilion Residences on Thursday evening.

The report alleged that the boxes showed the name of the consignee as Rosmah Mansor.

Two photos provided with the report and reviewed by Reuters showed a van with the department's logo and a shopping trolley filled with orange boxes. The location, the date and the contents of the boxes - including whether there were any of the handbags inside - could not be ascertained from the photos.

The Birkin handbags concerned would cost US$200,000 (S$260,000) each, the complaint said.

The senior police officer only confirmed "family members" of Mr Najib had stayed in the apartment complex when Reuters asked if Datin Seri Rosmah had stayed there.

Another officer involved in the operation described the persons of interest as "VVIPs", or very, very important persons.

Both police officers said investigators were not primarily interested in the luxury items but were chasing documents that could be vital for investigations into Mr Najib's administration.

ANNOUNCED OVERSEAS TRIP
Kuala Lumpur's police chief and an official police spokeswoman did not respond to requests for comment.

Mr Najib said earlier on Saturday that he was going abroad for a week to rest, but just minutes later the Department of Immigration announced that he and his wife had been barred from leaving the country.

Dr Mahathir, who was sworn in as prime minister on Thursday, has vowed to probe the loss of billions of dollars from state fund 1Malaysia Development Berhad (1MDB), which was founded by Mr Najib.

US Department of Justice documents allege that US$681 million from 1MDB was transferred to the personal account of a person identified as Malaysian Official One, which US and Malaysian sources have confirmed was Mr Najib.

Mr Najib has said the deposit was a donation by an unnamed member of the Saudi royal family which had been largely returned.

Dr M downsizes cabinet

Prime Minister Dr Mahathir Mohamad announced that the cabinet size will be reduced from 35 to a maximum of 30 ministers.

He also moved to shore up investor confidence ahead of markets opening.

Daim Zainuddin, who leads the Council of Eminent Persons, gave his assurance to the people that the abolition of the goods and services tax and reinstating fuel subsidies will not adversely affect the economy.

He also stressed that Putrajaya will not increase its debt further.

The Council of Eminent Persons will also set up a special task force on 1MDB.

Former inspector-general of police Khalid Abu Bakar said he was ready to be investigated on the 1MDB matter.

Bersatu president Muhyiddin Yassin, who is also the home minister-designate, instructed newly-minted Johor Menteri Besar Osman Sapian to correct his refusal to recognise the state opposition.

PKR's reservations on cabinet discussion

PKR representatives were absent during the discussion on cabinet appointments.

PKR deputy president Mohamed Azmin Ali said it was not a boycott as the party merely wanted PKR de facto leader Anwar Ibrahim to be involved in the talks.

Anwar, in a meeting with Mahathir at Cheras Rehabilitation Hospital, relayed PKR's concerns and the need to be inclusive in negotiations.

PKR vice-president Rafizi Ramli denied the report by Sin Chew Daily that he spoke out about the cabinet appointments because he wanted to be finance minister, stating that he had made it clear that he did not want any government position.

Former minister Rais Yatim warned that Harapan may become a second BN if it accepted defections from from the former ruling coalition.

Cops keep eye on Najib's house

Police have cordoned off the entrance to former prime minister Najib Abdul Razak's house.

The police also also denied raiding apartments linked to Najib, stating that they had merely checked on CCTV footages.

Gerakan Youth deputy chief Andy Yong said he was not defending Najib but stressed that he should not be arbitrarily blacklisted by the Immigration Department.

AirAsia group chief executive officer Tony Fernandes apologised for buckling under pressure when he was forced to campaign for BN in the last general election.

AirAsia X chairperson Rafidah Aziz said Fernandes had refused her resignation despite the then BN government becoming upset with her criticisim of the government.

The Malaysian Aviation Commission (Mavcom) said it will commence an investigation into Fernandes' claimed that the commission ordered him to cancel extra flights he introduced for the 14th general election.

Finance minister-designate Lim Guan Eng said politically-motivated graft charges against Harapan politicians will be reviewed.

While the media might have thought Dr Mahathir Mohamad would have taken the Sunday off after a blistering campaign, culminating in a resounding victory in the 14th general election on Wednesday, and forming the government thereafter, he would have none of that.

In fact, he is working at a feverish pace putting things in place.

The last four days were packed with back-to-back meetings and discussions with various people including Pakatan Harapan (made up of PKR, Bersatu, DAP and Amanah) leaders. Then there was the much-awaited ceremony at Istana Negara where Mahathir was officially sworn in as the nation’s seventh prime minister on Thursday.

He even managed to squeeze in a visit to the Cheras Rehabilitation Hospital in Kuala Lumpur to meet up with PKR de facto leader Anwar Ibrahim who is recuperating after surgery.

Despite his busy schedule, Mahathir, who is the oldest elected leader at 92 years, saw it fit to hold an “information session’ at his residence with the official media.

He had called for Bernama, the national news agency, and RTM to meet him at his Seri Kembangan residence.

The session, he said, was necessary because he wasn’t able to speak at length about the new government’s aspirations earlier as he was constantly answering questions from the local and foreign media at previous events.

Wearing a grey bush jacket outfit, his trademark attire that he frequently donned during the 22 years he was at the helm for the first time from 1981 to 2003, Mahathir seemed at ease and in good spirits. Seated next to him was his wife Dr Siti Hasmah Ali.

The Harapan chairperson talked about the new leadership and the need to come up with an anti-corruption policy.

He also answered questions about the administrative system, civil servants, the Harapan manifesto and what the leadership hoped to achieve in the first 100 days.

The one-hour interview also saw him talking about the country’s economy, the oil and gas sector and the goods and services tax.

The prime minister also touched on the government’s openness in dealing with news reports, the importance of local expertise to spur the country’s economy and the need for a study on economic performance, including the country’s total debt.

The session ended with a photo session with the prime minister, his wife and the media personnel present.

Being Mother’s Day yesterday, reporters also took the opportunity to record a Mother’s Day speech from Siti Hasmah.

She reminded children to spend time with their mothers as that was a way of showing their love and strengthening the relationship.

Abdul Razak Baginda, a close associate of former premier Najib Abdul Razak, has denied talk of having fled the country.

The political analyst also said he is not concerned about being targeted by the new Pakatan Harapan government over the Scorpene scandal and Altantuya Shaariibuu murder.

"I have never fled. These are all unfounded rumours.

"There was a trial (over the murder of Mongolian national Altantuya) and I was in remand in prison for close to two years till the conclusion of the lengthy trial. I was prosecuted.

"Prime Minister Dr Mahathir Mohammed has said the government will adhere to the rule of law and any issue of re-trial has to be in accordance with the law based on evidence and not rumours or allegations," he told Malaysiakini.

Earlier today, former Federal Court judge Gopal Sri Ram had called for a fresh probe into the Scorpene case and purported kickbacks in the purchase of the submarines.

He also noted the related allegations including the Altantuya murder.

The Scorpene case concerns Malaysia's purchase of two Scorpene-class submarines for around €1 billion from France's Direction des Constructions Navales (DCN) in 2002, which allegedly involved kickbacks.

At the time of the Scorpene deal, Najib was defence minister and deputy prime minister.

Razak admitted to receiving around €30 million (RM137 million) from French company Thales for lobbying work, but denied using it to bribe Malaysian officials.

Last August, it was reported that French human rights lawyer William Bourdon confirmed Abdul Razak had been indicted in Paris over alleged kickbacks in the sale of submarines to Malaysia.

The sale had went largely unnoticed until 2006, when Altantuya's murder raised questions about the deal.

Altantuya, who had reportedly helped in the negotiations that led to the purchase of the submarines, was also the jilted lover of Abdul Razak.

Abdul Razak was charged with abetment for her murder though he was later acquitted.

Former police special operations personnel chief inspector Azilah Hadri and corporal Sirul Azhar Umar, who had also served as Najib's bodyguards, were found guilty of murdering Altantuya in January 2015 and sentenced to death.

However, Sirul had fled to Australia when the pair was acquitted prior to the Federal Court overturning the decision.

Sirul is being held an immigration centre and Australian law prevents those facing the death penalty in their home countries to be sent back.

TV3 ordered to pay Anwar RM1.1m for defamation

The High Court in Kuala Lumpur today ordered Sistem Televisyen Malaysia (TV3) to pay a total of RM1.1 million to PKR de facto leader Anwar Ibrahim.

Justice Ahmad Zaidee Ibrahim found that TV3 had defamed Anwar in a 2013 Buletin Utama report that alleged he was the mastermind behind the Lahad Datu incursion.

"The court grants RM600,000 for general, and aggravated and exemplary damages of RM250,000 each," he said.

Zaidee also ordered TV3 to pay RM40,000 in costs.

The judge said the nature of the report is defamatory as the editor, Kamarudin Mape admitted in court that he did not verify with Anwar, and the judge described this as irresponsible journalism.

He said that TV3 being adamant in its report, without verifying, despite Utusan Malaysia having expressed regret to Anwar over its own report which formed the basis for the television report, has resulted in the court to consider aggravated and exemplary damages to be awarded.

Justice Ahmad Zaidi said there was also malice in banners placed in the television report.

Anwar was represented by Ambiga Sreenevasan and Shahid Adli Kamarudin while Lim Qi Si appeared for TV3.

It was reported that Utusan had retracted its front page report in 2016 and expressed regret over its publication which was used as a basis for TV3's Buletin Utama news.

Anwar had filed the suit against Utusan Malaysia publisher Utusan Melayu Sdn Bhd, and TV3, in 2013, which claimed he was the mastermind behind the Lahad Datu incursion.

Zunar travel ban lifted, but court challenge will continue

After almost two years of being grounded in Malaysia, political cartoonist Zunar is now free to travel abroad after he was taken off the Immigration Department's blacklist.

However, the cartoonist, whose real name is Zulkiflee SM Anwar Ulhaque, said he will continue his legal suit against the Immigration Department, and the previous federal government, over his prior ban.

"Although the travel ban on me has been lifted, I will continue to take legal suit against the old government so that this will not happen again to me as well as other political cartoonists in Malaysia in the future," he told Malaysiakini.

Zulkiflee has been barred from travelling outside Malaysia since June 2016 following an exhibition of his cartoons in Geneve, Switzerland. He was accused of tarnishing the country's image by taking part in the exhibit.

He had filed a challenge on the ban with the High Court in Kuala Lumpur, but his application was dismissed on Nov 2017. He has since filed an appeal with the Federal Court.

Meanwhile, Zunar said the news that he was taken off the immigration blacklist this morning caught him by surprise.

"I was surprised by the good news and didn't expect it to be so quick after the new government came in," he said.

However, he has no plans to travel abroad yet, but does want to continue exhibiting his works in Europe and other countries, as well give talks at universities.

When asked about the future of political cartoonists in Malaysia, Zunar hoped that the new government will give more freedom of speech and space to criticise those in power.

"In the past political cartoonists feared the government so not a lot of people drew...I hope the new government will give more freedom of speech and space to political cartoonists to criticize the government.

"By space, I mean space like galleries, because when there is such space, more young people will want to be political cartoonists," he said.

Besides the prior travel ban, Zunar has had various books published by him seized by the government and his local exhibitions disrupted.

He has also been slapped with nine sedition charges over tweets criticising the judiciary over to the conviction of PKR de facto leader Anwar Ibrahim in March 2015.

Amanah supreme council member Mohamed Hanipa Maidin has urged Chief Justice Md Raus Sharif to tender his resignation.

The Sepang MP said he should do this before he is fired or made to face a tribunal.

“As we know, his appointment was full of controversy involving the Federal Constitution – our highest law of the land.

“In my view, he is only fit to be the chief justice for the BN era, not the Pakatan Harapan era,” he added.

Mohamed Hanipa said Harapan would reform the judiciary and does not see how the present chief justice would be able to serve in such an environment.

Previously, Amanah, Prime Minister Dr Mahathir Mohamad, and the Malaysian Bar had filed separate challenges against the appointment of Raus and Court of Appeal president Justice Zulkefli Ahmad Makinudin, who had exceeded the 66 years and six months compulsory retirement age.

Raus was scheduled for mandatory retirement, according to Article 125 (1) of the Federal Constitution, on Aug 4, last year.

However, he was on that day appointed as an additional judge before the Yang di-Pertuan Agong Sultan Muhammad V, on the advice of the previous chief justice, and was made chief justice thereafter.

The challenges were made on the grounds that Raus' appointment as an additional judge and his appointment as chief justice under Article 124 (4) of the Federal Constitution was unconstitutional, and thus invalid.

Soon after winning the 14th general election, Mahathir had said that heads would roll in certain agencies and bodies.

His chief target was attorney-general Mohamed Apandi Ali, whom he accused of concealing evidence on the 1MDB scandal.

Mahathir also said there is no AG at the moment, but Apandi had clocked in for work, as usual, this morning.

Apandi had denied the allegation of being complicit in a cover-up of the 1MDB scandal.

This morning, MACC chief commissioner Dzulkifli Ahmad tendered his resignation after Mahathir accused the commission of ignoring widespread corruption and indicated a reshuffle.
