No one is saying that the kid did not do anything wrong. And no one is saying the victim should be forgotten. But the police reaction has to fit the crime. You don't bring out the entire Police STAR team and send them to arrest a driver accused of drunken driver. Just like you don't send 5 adult officers to bring in one kid. Which part of this are you too stupid to understand. the over reaction by the Police and the intimidation factor contributed to the boy killing himself. did he force the victim down, pull off her clothes and raped her? I am presuming here when you all questioned why so many needed, why five not two police officers went to the school, you all are not questioning the police efficiency but rather your concern was whether the boy had been intimidated by the five police and that was why he committed suicide. Apparently this part was talked about in the parliament session and also already answered according to the news report. The answer is although five police officers went to the school, only ONE officer spoke to the boy after he was identified by the school official based on CCTV screenshot. Then he was brought back to the station by three officers.

If Shamu is so certain of his allegations, he should waive parliamentary privilege and dare those he accuse to sue him.

Mr Shanmugam highlighted how The Online Citizen had spread falsehoods with their report on the case by publishing around 20 articles as "part of a smear campaign" to undermine public trust.

In Parliament on Tuesday, Home Affairs and Law Minister K Shanmugam described The Online Citizen (TOC)’s investigation into the death of teenager, Benjamin Lim, as a “planned, orchestrated campaign using falsehoods”. (Link to Ministerial statement)

We would like to respond to some of the points highlighted by the Minister.

“Confidentiality”

First, the Minister said Benjamin’s family wanted privacy. He said that out of respect for the family, his ministry had refrained from commenting on the case until now. They also wanted to protect the alleged victim.

TOC spoke to Benjamin’s father, Mr Lim, after the parliamentary session today (1 March). This is what he told us:

“The confidentiality that I want is for our family, for our identity to be kept confidential to better protect my two school going children. Whether the media report on the case, we have no question except that we urge the reports must reflect the truth”

Police attired in shirts with the words “Police”

The Minister took particular issue with an article published by TOC on 5 February this year.

Titled “Student said plainclothes officers at school wore t-shirts with “police” at its back.”, the piece contradicted a police statement asserting that the officers who went to Benjamin’s school were in plain clothes.

The article was written after we spoke with a Ms Mary Anne Pereira. She had posted a comment on the Singapore Police Force (SPF)’s Facebook (FB) page.

We did not just take Ms Mary Anne Pereira’s post from the SPF FB page. We made the additional effort to reach out to Ms Pereira to verify what she said through messaging her on FB.

Ms Pereira told us that her son, who is attending Benjamin’s school, had seen men with the word “POLICE” on the back of their t-shirts on the day Benjamin was taken away. We reported what she told us, and made clear that the information was provided by a student at Benjamin’s school. We also said that Ms Pereira informed us she was aware that the school was affiliated to a community-based police subdivision, and that she wasn’t certain if some members of that subdivision might have been at the school at the time. Prior to publishing the article, we reached out to the police, Mr Shanmugum, and other officials for comment. However, we did not receive any reply.

We are thus puzzled as to why Mr Shanmugum would label the article “dishonest”. We understand that Ms Pereira has since retracted her statement, but at the time of publication, there was no indication that she had made a mistake.

Until the Parliamentary session today, no official from either the Home Affairs or Law Ministry attempted to clarify the matter with TOC. Neither did the police or any government official instruct us to take down the article.

We would have run any updates, facts or clarifications the Home Affairs or Law Ministry would have provided us with.

“Orchestrated Campaign” by TOC

The Minister said today that the overall narrative and impression conveyed by TOC’s articles are that:

The police were lying;
The police intimidated Benjamin
The police put pressure on Benjamin to confess to a crime that he did not commit.

In all, TOC published a total of 25 articles related to Benjamin’s case and discussion on police procedures. Only four were written in-house. The rest were letters and opinion pieces contributed by members of the public. Benjamin’s story triggered a strong reaction among our readers. This is evident in the number of submissions we received following the first article.

TOC prides itself on being an open platform. We welcome contributions and have very little control over what the public choose to write about. In Benjamin’s case, questions were raised, and people wanted answers. Their reactions were spontaneous. It was hardly an “orchestrated campaign”.

Had the police, Home Affairs or Law Ministries, or anyone from the government written to TOC or responded to our requests for comment, we would have been happy to present their views too. Mr Shanmugum has chosen to characterise our efforts at reaching out as “tactics” to get the police to comment on Benjamin’s case. This is not correct. We believe in giving all sides a chance to speak. Soliciting answers to pressing questions isn’t a “tactic”. It is merely journalism.

Finally, we would like to point out that “inaccuracies” are not the same as “falsehoods”. Given the dearth of information available to us, it is natural that some of our reports were not fully accurate. It would have been clear from our articles that the story was still developing as we were yet to be in possession of the full facts, and we were doing our best to do so with the information we had. We are happy to correct any mistakes we might have made in our articles. However, the word ”falsehoods” implies a deliberate attempt to mislead. TOC rejects any such suggestion.

Shamu tries to deflect by accusing the fifth estate of spouting untruth. Well, the fifth estate didn't pluck those perspective on of thin air. They interviewed witnesses. Is Shamu going to apologize for his defamatory statements?

So, the cops supposedly offered drinks and food to Ben and he declined. Well, it is their words. Who knows the truth?
If the cops really cared about Ben's well-being during detention, they could have left the food and drink there.

Shamu claimed that CCTV captured the molestation incident. So, Ben is guilty. Is the police the judge or is there a court that decides guilt? Is this a trial by CCTV?

I already said so clearly here I am presuming the question is not on police efficiency and yet all the rubbish comments on that. And the fact is the boy was spoken to by ONE officer about the alleged crime in school, not five. Brought back to the station by three officers, and interviewed in the police station by one officer.

How and where do you draw the line in which to decide whether to investigate a reported offence? Is it by age, height, weight, amount of body hair? What if a 14 year old by suffers from progeria? Should he then be investigated, charged and jailed as a paedophile because he looks much older than he is?

Being 14 simply means that it is a mitigating factor in any decision to lay charges and if so and if found guilty, will rightfully be used as a mitigating factor in deciding the type of punishment.

Being 14 does not mean you cannot be investigated for an offence.

Without any evidence, the other opportunist has claimed that the kid was "intimidated" into killing himself. For you, it is because "the kid was deeply remorseful". For some, it's because of school camp, etc. All different claims and speculations made out as incontrovertible facts. A common thread amongst all though is the cheap two bit opportunism in using the tragic death of a 14 year boy to rail against the PAP.

With such opportunistic mindsets and mentality, the question that must be asked is what makes you chaps morally superior to the PAP that you dislike and constantly rail against?

In laying out the timeline of events in Parliament, Mr Shanmugam spoke of how sensitive reports like these could affect investigations and public sentiment.

"Allegations, implications which are false, practically leading people to conclude that Benjamin committed suicide, as a result."

"It is sad to see this level of dishonesty and politicising of this matter. Where the police are wrong, we must and will take action. But we should not allow deliberate, dishonest attacks," he added.

Shamu is a chicken because he dare not repeat his defamatory remarks without parliamentary privilege.

It is not politicizing ...the fifth estate is doing its job. It is time the government get use to the reality that there is a role in a democracy for the fifth estate. The fifth estate is asking the right questions to hold the government accountable.

Without the reporting of the fifth estate, this incident would have been swept under the rug.

Kudos to the online fifth estate.

Did they conduct an ID parade for the victim to identify the culprit?
The third parties that identify Benjamin Lim, were they present at the scene as witnesses of the incident?
Why wasn't the CCTV footage shown to the public?

The issue is how the SPF handle this incident. Five officers to arrest in a teenager in school? Why five officers?
Could the SPF not arrest the kid at home? Why not?

Shamu now claims the boy is guilty because there is a CCTV recording. Do police or a minister decide guilt or it is the court?
