Defendant and police officer Wiliardi Wizard said Tuesday police had devised a plot to arrest former chairman of the Corruption Eradication Commission (KPK) Antasari Azhar for the murder of the director of state-owned PT Putra Rajawali Banjaran, Nasruddin Zulkarnaen.

During a hearing at South Jakarta District Court, Wiliardi said investigators had prepared his dossier so they could bring Antasari to court as the defendant in the case.

“The dossier containing my testimony was actually arranged by the police. I agreed with the content of the dossier after some of the high-ranking police officers approached me,” Wiliardi said as quoted by tempointeraktif.com.

“I swear in the name of Allah the officers were there. They told me the only target in the case was Antasari,” he said.

Later, he added, investigators had shown him the dossier of another defendant, Sigid Haryo Wibisono.

On the sideline of the hearing, Antasari expressed relief that the truth was gradually being uncovered.

The police have accused Antasari of masterminding the killing of Nasruddin in March. (ewd)

By Eliswan AzlyJakarta (ANTARA News) - The chairman of the Corruption Eradication Commission (KPK) had been temporarily relieved of his routine work to enable him to concentrate on his legal process in an alleged murder case.

"The management of KPK has issued a decision to that effect," Deputy Chairman of KPK Chandra Hamzah told the press at his office here on Friday evening.

In this way, the KPK chairman's work as of Friday would be handled by turn by the four deputies, Haryono Umar, M. Yasin, Bibit Rianto and Chandra Hamzah.

The decision taken by the KPK management was in line with the statement made by Prof Adrianus Meliala, PhD, an expert in legal affairs and criminology of the University of Indonesia on Friday, who said it was much better for Antasari to be relieved of his route work temporarily.

He made the remark after the police banned Antasari from travelling and Attorney General Office (AGO) named him a suspect in the murder case for having violated article 340 of the Criminal Code.

"In the context of the alleged murder, Antasari should be seen as a figure failing to uphold neutrality if he has to concentrate on his case during the legal process," Meliala said.

Antasari - who was earlier reported to be implicated in the case - went to his office on Jl. Rasuna Said, South Jakarta, as usual.

A source with the National Police said a high-ranking police officer had been arrested in Bandung in relation to the murder case.

Nasrudin died on March 15, 2009, in a hospital from fatal wounds sustained in a shooting at him as he was leaving the Modernland Golf Course in Tangerang.

The motive for the shooting remained a mystery for more than a month, when National Police Chief Gen. Bambang Hendarso Danuri announced the police had arrested nine suspects in the murder case.

"The evidence is there. The weapon and the vehicles, consisting of a car and a motorcycle used by the attackers. Our investigation even led us to the mastermind, who is a well-known businessman," he said.

Bambang refused to divulge more details regarding the matter so that, following the announcement, there were many unconfirmed reports, including that the mastermind paid Rp 500 million (US$47,500) to the hitman and his associates; that the shooter may have been trained as a soldier in the East Timor conflict and that one of the nine suspects was a former district police chief.

The police were pursuing two people suspected of plotting the murder of Nasrudin Zulkarnaen, 45, director of state company Putra Rajawali Banjaran (PBR) in a case that may involve Corruption Eradication Commission (KPK) chairman Antasari Azhar.

In the meantime, the Attorney General's Office (AGO) confirmed that chairman of the Corruption Eradication Commission (KPK), Antasari Azhar, was a suspect in the murder of Nasrudin Zulkarnaen, director of a state firm.

AGO spokesman Jasman Pandjaitan said Friday that the office had received dossiers from the police regarding Antasari's alleged role of commissioning the murder.

"To probe Antasari's alleged involvement may involve forceful steps," he said reading out a recommendation from the police in a press conference.

Jasman said that the police was charging the suspect with article 340 of Criminal Code (KUHP) on conspiracy in a murder. Antasari was a former top prosecutor in the AGO, known to public for handling the murder case involving Tommy Soeharto, youngest son of former president Soeharto.

"The police will not need the AGO's permission to question him since he is no longer a prosecutor ever since he assummed the post as KPK chairman," he said.

He added that the AGO had expressed deep regret over the situation.

In response to Antasari's alleged involvement in the crime, President Susilo Bambang Yudhoyono expressed support to an investigation on the murder case that may implicate the key figure in the country's battle against corruption, the Corruption Eradication Commission chairman.

Presidential spokesman Andi Mallarangeng said Friday that the president said the investigation was an example of good law enforcement.

"Anyone guilty must undergo a process as regulated by the law until he or she faces trial," Andi said.

"If the law can be implemented as it should be it will mean that its supremacy is highly upheld," Andi said.

Nasrudin died at the Gatot Subroto Army Hospital in Central Jakarta on March 15, a day after a drive by shooting as he was leaving the Modernland Golf Course in Tangerang.

Commenting on the alleged involvement of Antasari in the murder, a political analyst Dr Sofyan Siregar, a roving lecturer at the Islamic University of North Sumatra, said actually this was an act of those who wanted to make Antasari trapped in a crime.

As a clean figure who has the courage to capture whoever was allegedly involved in murder indiscriminately would be facing many rivals, he said.

"In my view, this is a trick of those who don't want to see Antasari walk free. The testimony of a murderer who shot Nasrudin to death tipped that Antasari knew all about the murder was an act of fabrication," he said.

"The testimony of a murderer could not serve as evidence," Sofyan said adding that only could the material objects of the probe be accepted as reliable evidence, while the testimony should be further verified.

What is important, according to Urbaningrum, is that the Democratic Party would not be late in registering its presidential and vice presidential pair at the General Elections Commission (KPU). (*)

AGO Wades Into KPK Tapes Row
Bribery and abuse of power allegations against two members of Indonesia's Corruption of Eradication Commission originated with the National Police, Deputy Attorney General Abdul Hakim Ritonga claimed on Tuesday.

Ritonga’s statement was made in an apparent attempt to clear his name following the release on Monday of a transcript of taped telephone conversations allegedly indicating a plot to frame Chandra M Hamzah and Bibit Samad Rianto, deputy chairmen of the commission, known as the KPK. Ritonga is mentioned in the taped conversations, but not directly implicated in any obvious wrongdoing.

His statement on Tuesday provided a fresh twist in a long-running battle the KPK is engaged in with the National Police and Attorney General’s Office.

During a news conference in Jakarta, Ritonga said his first knowledge of the allegations against Chandra and Bibit came when National Police Detective Chief Comr. Gen. Susno Duadji organized a meeting of law enforcement officials to brief them on the case in mid-July.

“During the meeting, we were told that [the KPK deputies] were facing charges of abuse of power, extortion, embezzlement and other crimes,” he said. “What we had in mind before the meeting was that it was an invitation to discuss a case related to the murder of Nasrudin [Zulkarnaen]. So I rejected the case because it could not qualify as a general crime.”

At the time, Ritonga was deputy for general crimes.

“If there is any allegation that I have fabricated the case, that’s not true,” Ritonga said.

Following Susno’s investigation, the police charged Chandra and Bibit with abuse of power. They are also trying to prove the pair took bribes in exchange for letting graft suspect Anggoro Widjojo flee the country to avoid arrest.

But the entire investigation, which has captivated the nation for weeks, is in danger of collapse following the publication of a transcript on Monday of the wiretapped conversations allegedly involving another senior AGO official, Wisnu Subroto, and several men who have been questioned as witnesses in the case.

The transcript allegedly outlines an apparent plot to frame Chandra and Bibit, and Susno and Ritonga are mentioned several times. Ritonga refused to comment on the transcript.

The transcript quoted the purported voice of Wisnu, then AGO deputy for intelligence, and businessman Anggodo Widjojo, the brother of Anggoro and a witness in the case against Chandra and Bibit, discussing how witnesses should give testimony that would implicate Chandra and Bibit.

Wisnu, who retired in May, has acknowledged that he knew Anggodo and often talked with him on the telephone. But he denied having attempted to set up the KPK officials.

The KPK has confirmed the existence of taped phone conversations, but not that they were as outlined in the transcripts, which were published by local media.

National Police deputy spokesman Brig. Gen. Sulistyo Ishak on Tuesday sought to downplay the significance of Susno’s meeting as reported by Ritonga.

“It’s not strange that investigators conducted coordination or meetings with relevant authorities such as prosecutors and expert witnesses,” he said.

Susno has also refused to comment on the transcript.

Attorney General Hendarman Supandji has said he was unaware of the taped conversations. On Tuesday he expressed outrage that the AGO was under suspicion. The AGO last year was rocked by a humiliating bribery scandal involving one of its prosecutors that was uncovered by the KPK.

Court hears phone tapes

JAKARTA - POTENTIALLY explosive wiretap recordings allegedly demonstrating a high-level conspiracy to muzzle Indonesia's anti-graft agency were played in court for the first time on Tuesday.

The recordings have been presented as evidence of collusion between police, prosecutors and corruption suspects to silence anti-graft investigators, supposedly with the approval of President Susilo Bambang Yudhoyono.

In the secret recordings played in the Constitutional Court, the brother of a businessman being investigated by the KPK is heard discussing the probe with police and senior prosecutors. They talk about various scenarios to save the businessman and put the KPK investigators behind bars for accepting bribes.

One of the alleged conspirators refers to 'RI-1", a nickname for Dr Yudhoyono, as being a backer of moves to 'close down' the KPK.

Dr Yudhoyono has angrily denied any involvement in a plot against the commission and has ordered police to investigate the tapes.

But he has stopped short of defending the arrested KPK officials, Chandra Hamzah and Bibit Samad Riyanto, saying he has faith in the police and must allow the 'legal process' to run its course. -- AFP

JAKARTA — Hundreds of Indonesians gathered in the capital Jakarta on Sunday to protest perceived moves to cripple the country's once-powerful corruption watchdog.

Musicians sang songs and supporters made speeches demanding President Susilo Bambang Yudhoyono move to protect the Corruption Eradication Commission (KPK) after the release of wiretap recordings of police and prosecutors exposed an alleged high-level official conspiracy against it.

"The president must be more tough in protecting the KPK so it can do its job in fighting corruption," rally spokesman Illian Deta Arta Sari told AFP.

"We ask for the total cleanup of the criminal justice system in Indonesia. We must first get rid of corrupt officials... they're dirty brooms which shouldn't be used to sweep the house," she added.

Indonesia's top detective and the country's deputy chief prosecutor quit last Thursday after wiretap phone recordings implicated them in an alleged plot to falsely imprison two KPK investigators.

More than one million people have joined a group on social networking website Facebook supporting the two anti-graft investigators, who are still facing charges of extortion and abuse of power that the police refuse to drop.

"We back the KPK in fighting corruption. We believe the Internet has the power to unite people and help change the corruption situation in Indonesia for the better," the group's spokesman Ari Wibowo said.

The KPK has made enemies across the spectrum of Indonesian government and administration for its successful prosecutions and its far-reaching powers to wiretap suspects and probe their bank accounts.

Two members of Indonesia's police and judiciary have resigned, in the wake of allegations they were involved in a conspiracy to frame two leaders of the KPK, Indonesia's anti-corruption commission.

The resignations were announced by the deputy attorney general, Abdul Hakim Ritonga, and the chief detective Susno Duadji.

KPK Tapes Reveal Indonesia's ‘Judicial Mafia,’ Explain Munir Case Acquittal: Activists
Human rights activists are linking the presence of two names prominent in the anti-graft commission’s wiretapped conversations to the failure to get a conviction in the controversial Munir murder case, claiming the existence of a ‘judicial mafia’ in an apparent breakdown of public trust in the country’s law enforcement institutions.

Choirul Anam, of the Committee of Action and Solidarity for Munir (Kasum), on Wednesday pointed out that two of the names mentioned frequently on the tapes — those of Deputy Attorney General Abdul Hakim Ritonga and Wisnu Subroto, a retired deputy attorney general for intelligence — were prosecutors in the failed trial of Muchdi Purwopranjono. Muchdi is a powerful former spy chief charged with masterminding the murder of human rights activist Munir Said Thalib.

Choirul said the KPK scandal and Munir’s case shared similarities.

“In both cases, there are figures with huge political and economic power trying to systematically manipulate the legal process,” he said.

Munir’s widow, Suciwati, came to a similar conclusion after listening to the tapes, which were broadcast live during a Constitutional Court hearing on Tuesday.

“I see a very strong indication that the judicial mafia played a role in Munir’s case by setting it up in such a way that the prosecution’s case was deliberately weak,” Suciwati said.

The tapes described an apparent conspiracy to weaken the Corruption Eradication Commission (KPK) allegedly hatched by a network of high-ranking officials within the Attorney General’s Office and the National Police. The names of Ritonga and Wisnu are mentioned several times.

Choirul claims that Kasum’s investigations into the prosecution of Muchdi showed that Ritonga was the primary prosecutor. As the deputy attorney general for general crimes, Ritonga decided that the prosecution would only ask for a 10-year prison term for masterminding Munir’s murder, he said. In his role as the AGO’s chief of intelligence, Wisnu failed to provide the intelligence needed to build a strong case against Munir, he said.

Munir died of arsenic poisoning in September 2004 while flying from Jakarta to Amsterdam aboard a Garuda Indonesia plane. Muchdi was acquitted of the charges.

Prosecutors alleged that Muchdi had used his influence at the State Intelligence Agency (BIN) to arrange the murder to avenge his ousting from the top post of the Army’s Special Forces (Kopassus) in 1998. He reportedly believed Munir’s criticisms of the elite unit’s kidnapping of students and activists in 1997 and 1998 had cost him his career.

Suciwati said the taped telephone conversations had led her to believe that the AGO should set up a team to appeal Muchdi’s acquittal.

Separately, Sumiarsih, mother of Bernardus Realino Norma Irawan, an activist who died when soldiers fired into a pro-democracy rally in the 1998 Semanggi Tragedy, said hearing the tapes “opened my eyes into how strong the infiltration of a judicial mafia was in influencing law enforcement.”

Sumiarsih said she and the families of victims of past human rights abuses had long sought justice from AGO officials, including Ritonga and Subroto.

“It seems from the wiretapped conversations, that all those names are connected to the judicial mafia,” Sumiarsih said. “This maybe the missing link behind our failure to get justice.”

Kasum’s Choirul called for “a political decision from the president and the House of Representatives to thoroughly investigate the institutions that enforce the law.”

He added that Munir’s widow, Suciwati, had called for the same response.

The taped telephone conversations involved fugitive graft suspect Anggoro Widjojo, his brother Anggodo Widjojo, and an alleged plot to weaken the KPK and to systematically thwart its efforts to prosecute Anggoro.

According to the tapes, the plot against the KPK was hatched after the KPK targeted Anggoro for allegedly corrupt business practices at by his company, PT Masaro Radiokom. His company allegedly caused the state a total of Rp 180 billion ($18.9 million) in losses.
