My take is that police, IO, DPP, Judge were all taken in by her theatretric performances and story telling skills and thus all awarded lenient sentences.

These theatretric skills were seen in the way she even used baby as props to create a public scene from her kitchen service yard to agitate and distract her husband who was only focusing on reading her handphone messages for the first time after he had managed to get the passcode from her. It is doubtful if he had made threat to the babies life but Vivian nontheless used the baby as leverage to conceal the truth enclosed in her handphone messages from her hubby's discovery.

Vivian also capitalised upon her hubby loss of control with her distractions by using a knife to induce her to return with the baby back to her room.

The judge can reduce the charge if the facts warrant and he has reasonable grounds for the decision. That's why he is the judge. DPP on the other hand should just lay the charge as culpable homicide not amounting to murder. If the judge reduces the charge, DPP should appeal to get a second opinion. Judges are not perfect. Their opinions may be wrong also.

Just like the guy who squeezed the neck of his own father who later died, the judge felt that pre-meditation was not proven and reduced the charge to that of a rash act. Could the prosecution have known better not to 'over kill' in framing their charge, maybe.
