Yahoo (NASDAQ:YHOO), accused last month by Singapore Press Holdings (SPH) of reproducing news content without permission, denied infringing the city-state's copyright laws and countersued the newspaper publisher, reports Bloomberg.

Yahoo claimed in its suit that Singapore Press infringed its copyrights by reproducing articles and images on a website.

The Sunnyvale, California-based Internet company said in its filing, "There is an important public interest in respect of the right of the public to be informed of current events in Singapore. Copyright law does not protect facts and information."

Yahoo! (NASDAQ:YHOO) has potential upside of 16.9% based on a current price of $15.65 and an average consensus analyst price target of $18.3.

Yahoo Denies Infringing Singapore Press Holdings’ Copyright, Countersues

Yahoo! Inc., accused by Singapore Press Holdings Ltd. (SPH) of reproducing news content without its permission, denied infringing the city-state’s copyright laws and countersued the newspaper publisher.

The articles that Singapore
Press claimed were reproduced without authorization were insubstantial and insignificant, Yahoo’s Southeast Asia unit said in a defense filed in the Singapore High Court today.

“There is an important public interest in respect of the right of the public to be informed of current events in Singapore,” the Sunnyvale, California-based Internet company said in its filing.

“Copyright law does not protect facts and information.”

The Singapore-based newspaper publisher sued Yahoo
last month, seeking unspecified damages for alleged copyright infringement of 23 articles from newspapers including the Straits Times from November 2010 to October 2011.

Yahoo claimed in its countersuit that Singapore Press infringed its copyrights by reproducing articles and images on a website.

Chin Soo Fang, a spokeswoman at Singapore Press, the city’s largest publisher, didn’t immediately respond to an e-mail or return a call to her office seeking comment.

Yahoo approached Singapore Press in April 2009 for a license to reproduce news content, and negotiations between the two companies broke down last year, according to the lawsuit.

Singapore Press deliberately kept silent until a letter from its lawyers on Nov. 4, causing Yahoo to continue with the alleged infringement for a year as it believed the publisher had no complaints, according to the Internet company
’s filing.

The case is Singapore Press Holdings Ltd. v Yahoo! Southeast Asia Ltd. S831/2011 in the Singapore High Court.

SPH is not suing Yahoo! because of any copyrights infringement. The real reason why SPH is taking lawsuit against Yahoo! is revenge. During the run-up to GE2011, the number of people reading the netizens' comments in the Yahoo! site far exceeded people who reads the election reports by the state-controlled media. It doesn't help that all the netizen's comments posted in Yahoo! were all negative against the PAP, in fact downright anti-PAP. So one negative comment bred into 10 negative comments which in turn brought another 50 negative comments against PAP and on it went. Yahoo! became of the main site of discontentment expressed against the PAP. Everyone was referring to what they read in Yahoo! at that time. The PAP believed that it lost a significant no of votes because of what were posted in Yahoo! This was repeated for the PE where again, the electorate was largely interested in what were posted in Yahoo! against Tony Tan that eventually led him to win by the narrowest of margin. So the PAP, or more accurately LKY, is on a vengence path which is very typical of him (we all know how he exacts revenge from anyone who has offended him). So read LKY for SPH.

I respect Yahoo! for having the balls to go against the old man. And we must show all our support for yahoo! in the social media in whatever we can. But sadly because the case will be tried in S'pore, we all know what the outcome will be. For forummers' info, PAP lost all its lawsuits against various parties that were tried outside S'pore.

Those of you who regularly watch Youtube videos will know: sometimes flimsy accusations of 'copyright infringement' are used to take down controversial videos.

In other words, censorship.

I would expect no less from SPH. It's chief editors have all been pro-PAP spooks. And SPH is the only publisher that ingratiatingly publishes all those memoirs/books. Presstitutes of the highest order.

As we cannot rely on SPH to report the proceedings, hopefully Yahoo and the other foreign press organisations will do the job. None of the foreign press have succeeded in the local courts but as this copyright rather then libel and slander, it will be interesting how this proceeds. Then again, a settlement might be in the works.
