Victim 'had sex with stranger after rape'

Defence: This is unlikely if she had been sexually abused by half-brother

14 May 2013

A couple of days after she was allegedly raped by her half-brother, an intellectually disabled teenager, 18, had sex with a stranger she met at a park.

The High Court heard this yesterday as the trial of the 39-year-old half-brother began.

The man had pleaded guilty last year to raping and sodomising his half-sister at his one-room flat over a period of two nights in March 2010.

But he withdrew his plea in February, claiming that he was innocent, and he admitted to the charges only to “save his wife”.

The parties in the case cannot be named to avoid identifying the alleged victim.

The accused and the girl have the same mother. In 2006, she moved in with another half-brother.

In March 2010, she was sent to stay with the accused following an argument with her other half- brother and his wife.

The prosecution’s case is that over the next two nights, the accused violently sexually assaulted her. The girl later fled the flat and told her stepfather that she had been raped.

Yesterday, two psychiatrists from the Institute of Mental Health took the stand – Dr Rajesh Jacob, who had assessed the girl’s intelligence, and Dr Alvin Liew, who had interviewed the accused after his arrest.

Dr Jacob said the girl could give basic details such as time and place and do simple calculations but had difficulty answering long questions, and had limited proficiency in English.

He said she became emotional when talking about the alleged rape, so he did not probe further. She also told him she had no prior sexual experience

Defence counsel S.K. Kumar then told the psychiatrist that the girl had an abortion in 2009.

He also told Dr Jacob that one or two days after the alleged rape, she had sex in a hotel with a stranger who approached her. The lawyer suggested that she would not have done this if she had been sexually abused.

Dr Jacob said: “It is highly unlikely for a person to have sex one or two days after a traumatic event.”

Alleged rape victim wanted to 'repent' for previous sexual encounters: Teacher

A housewife, who gave religious lessons to an alleged rape victim, said the intellectually disabled teen wanted to "repent" for her previous sexual encounters.

The 51-year-old, who cannot be named as it could lead to the victim's identity, said she started giving the teen lessons two months before her alleged rape. The housewife took the stand on Wednesday on the third day of an ongoing trial.

Then 18-years-old, the victim was allegedly raped by her 39-year-old half-brother over two nights in March 2010 when she was staying in his one-room flat. But, it emerged in court on Monday that she had sex in a hotel with a stranger who approached her just one or two days after the alleged rape. Her teacher told the High Court on Wednesday that she was "shocked" to learn of this adding: "I thought she was repentant (of her previous sexual encounters)".

She added that she offered to teach the victim after meeting her in January 2010. The girl had told her and her husband that she had engaged in sex with men before and had gone through an abortion. On Monday, defence lawyer S.K. Kumar had suggested that the victim would not have done this if she had been sexually abused. Yet under questioning by Deputy Public Prosecutor S. Sellakumaran, a psychiatrist had told the court that a person with low intelligence is more easily induced into agreeing to sex if offered money or food.

Wife of alleged rapist claims husband framed by siblings

May 15, 2013 - 12:57am

By: Elizabeth Law

When the dishwasher, 31, was repeatedly questioned about the inconsistencies in her statements, she claimed the police had forced her into signing them.

She also claimed police threatened to throw her in jail and have the Ministry of Social and Family Development take her son away if she refused to comply.

She broke down in court and wailed loudly into her hands before suddenly lashing out: "I love my husband, release him now! He has been framed by his own siblings."

She continued shouting, even screaming hysterically, for about five minutes while her husband banged on the glass panel of the dock, coaxing her to calm down.

The 39-year-old man is accused of raping and sodomising his intellectually disabled half-sister and forcing his wife to watch and participate in some of the acts.

Rape trial of mentally disabled teen: Accused mother's boyfriend takes the stand

Published on May 16, 2013
By Ian Poh

A crane operator, who was considered a "father" by an alleged rape victim, said the accused's wife had helped to remove the victim's jeans during the alleged rape.

Giving testimony in the High Court on Thursday on the fourth day of an ongoing trial, the crane operator, who is the boyfriend of the victim's mother, said this was what the 21-year-old had told him after the incidents that took place in March 2010.

The girl, who is intellectually disabled and 18 at the time of the alleged incident, had also told him that instead of stopping her husband, the accused's wife "encouraged" the rape to happen.

"When she (the victim) said this to me, she was crying and in fear," the crane operator said. He added that he had known the victim since birth and would send her to primary school when she was young. He cannot be named as this could lead to the victim's identification.

Man in rape case 'was framed by younger brother'

Published on May 16, 2013
By Selina Lum

THE man on trial for allegedly raping his teenage half-sister was framed by another family member, the defence claimed on Wednesday.

Lawyer S. K. Kumar said the 39-year-old had fallen victim to a plot hatched by his younger brother - who sent the intellectually disabled girl to the flat where the 2010 attack is said to have taken place.

He claimed the younger sibling had kept all of the proceeds from the sale of their late father's property.

Fearing that the eldest would start pestering him for his inheritance, the younger brother then allegedly came up with a plan to get him put in prison.

Lawyer tells accused's brother: You planned this to put him away

May 16, 2013 - 1:04am

By: Elizabeth Law

When his mother died in 2006, he offered to take in his two younger step-siblings.

One of them, a girl, was intellectually disabled. Over the next few years, she got up to a series of mischief, including getting pregnant and running away from home.

The pregnancy was terminated some time in late-2009.

But the final straw came in March 2010, where the girl, then 19, said she wanted to quit her job.

Out of desperation, he sent her to his older brother's home to stay for a few weeks.

Between March 12 and 14, 2010, the girl was allegedly raped by her step-brother. His wife was also said to be involved in the sex abuse.

Rape trial of mentally disabled teen: Sister-in-law takes the stand

Published on May 17, 2013
By Ian Poh

20130517.162553_sph_st_attackgirl.jpg

The sister-in-law of the teen who was allegedly raped by her half-brother, said that the teen had the habit of leaving home without saying where she was going or who she would be with and not return for days.

The victim, who is intellectually disabled, moved in with her sister-in-law, a restaurant manager and her husband. The manager's husband is the accused's younger brother and also the victim's half-brother.

Giving her testimony in the High Court on Friday and on the fifth day of an ongoing trial, the restaurant manager, speaking in both Mandarin and English, testified that the victim had disagreements with her husband and did not like his "controlling" of manner.

"On some occasions, my husband could not stand her and would chase her out of the house. A few days later she would come back because she had run out of money," the restaurant manager said.

The husband said on Wednesday that he took the victim to his older brother's one-room flat in March 2010 because he thought the accused was stricter and better able to control her. This was where the alleged rape took place over the next two nights.
