High Court judge Kan Ting Chiu found that PC Connect, which had a retail outlet on the third floor of Funan Digitalife Mall, was only entitled to nominal damages as it could not offer independent proof of its losses.
And it will not be landlord CapitaMall Trust footing the bill, but the tenant on the fourth-floor, Bachmann Japanese Restaurant, which was held to be liable for the leakage. Justice Kan held that the pipe in question served the restaurant exclusively, said the judge, so it had a duty to maintain the pipe.
