NUS student may be charged with posting obscene material online

SINGAPORE: There is a possibility that a National University of Singapore (NUS) student may be charged with posting obscene material on the internet.

This is according to lawyers Channel NewsAsia spoke to.

ASEAN scholar Alvin Tan Jye Yee had posted sexually explicit videos and pictures of him and his girlfriend online.

Mr Tan put the obscene material on his blog, which has since been deactivated.

However, the videos and images have been copied and circulated elsewhere.

Under Singapore legislation, it is an offence to make and distribute obscene films. It is also illegal to publish obscene images.

The posting of the obscene videos and pictures has generated a lot of chatter online, with various forums and blogs carrying a myriad of opinions on the couple's actions. Many have ridiculed the sharing of the videos and images.

When it comes to whether the obscene postings have indeed contravened Singapore's laws, or whether there is a case for prosecution, lawyers Channel NewsAsia spoke to said the situation may be a little tricky, depending on where the visuals and postings were made.

Josephus Tan, senior associate at Patrick Tan LLC, said: "The material question is where the offences were being committed and in this case it seems to be Malaysia. I think Malaysia actually shares an almost identical Penal Code to ours, so the person can actually be charged for a Penal Code offence back in Malaysia, or even under their so-called Malaysian Films Censorship Act."

In a statement, the National University of Singapore (NUS) said the student has been served a notice of Board of Discipline (BOD) inquiry, and the board will look into the matter and take appropriate disciplinary actions.

NUS said the student concerned is with the NUS Faculty of Law and is on an ASEAN Undergraduate Scholarship.

A spokesman of NUS said that Tan is currently on a Leave of Absence and is not receiving scholarship funds. He has also been advised to take down the offensive posts.

NUS said it does not condone posting of offensive content online by any member of the NUS community.

All NUS students are expected to conduct themselves in a responsible manner and should not be associated with offensive behaviour.

Any student found in breach of the university's Code of Student Conduct will be disciplined.

NUS said it adopts a rigorous process in the selection of scholarship recipients and scholars are selected based on their academic achievements and personal accomplishments.

The university takes a serious view of the conduct of the student concerned, but reiterates that "this is not a reflection of all our scholars, most of whom are accomplished students making a meaningful contribution to the NUS community".

PETALING JAYA, Malaysia: A Malaysian scholar in Singapore created cyber furore after he posted nude erotic pictures of himself and his girlfriend in his blog called Sumptuous Erotica.

Alvin Tan Jye Yee, 24, a National University of Singapore (NUS) law student, and his 23-year-old girlfriend Vivian Lee, also a Malaysian, had uploaded photos and videos of themselves in suggestive posts as well as having sex.

The blog has since been deactivated after both Tan and Lee came under heavy fire over their photos and videos, which have been deemed obscene.

However, both do not regret their actions.

The couple is said to be currently back in Malaysia and Tan has plans to go back to NUS in January to finish his law degree.

Tan had received an Asean scholarship in 2004 and attended Xinmin Secondary School and Raffles Junior College before entering NUS on an Asean undergraduate scholarship.

Tan and Lee had apparently met on Facebook and started their erotic blog after initially uploading their photos there.

“One day, we were fooling around and my girlfriend had the idea of taking nude photos.

“After taking more and more photos, we started to want some sort of recognition for our work so we uploaded them on Facebook but we blurred out the critical parts,” he said when interviewed by Yahoo! Singapore.

He added that they started the blog in September when their photos in Facebook were continuously being flagged and taken down by site administrators.

Tan also told Yahoo! Singapore that both he and Lee have been approached to endorse sex toys and lingerie by companies in Singapore.

The Singapore Straits Times reported that Tan might get into trouble when he returned to Singapore.

Quoting lawyer Bryan Tan of Keystone Law Corp, the daily said Tan might be hauled up for breaching the Films Act for producing and uploading the raunchy videos.

The lawyer also said Tan might have breached NUS rules and code of student conduct.

A NUS spokesman said it could not disclose if Tan was a student because the information was confidential.

The Straits Times also quoted Tan as saying: “What can (NUS) do? Terminate my scholarship or expel me? I can't say I will be fine with it, but if it happens, I can accept it.''

Meanwhile, Guang Ming Daily reported that Lee was unperturbed by the controversy she and Tan had created.

She said she was not worried the matter would upset her family and or about what her parents would think.

Lee said she and Tan did not care what others thought about them and would continue with their “activity” as they both enjoyed it.

Controversial blogger and NUS law scholar Alvin Tan has updated the YouTube channel he co-owns with his girlfriend Vivian Lee.

Fresh from the controversy, the pair said that they wanted to address questions they have received from fans and netizens since explicit pictures and videos of them caused public furore earlier this week.

"We're still smiling. Obviously things between us are still fine," Tan, 24, said.

The pair have since shut down their sex blog, although they insist that it was not a decision they wanted to make.

Appearing shy at the beginning of the video, Vivian, 23, said: "We actually shut down the blog because of family pressure."

The couple said that they succumbed when family and friends placed pressure on them to remove blog and postings.

However, this does not mean that they will stop recording and taking pictures of themselves in the nude or having sex.

"Yes, we will continue doing what we love doing," Tan said. Nevertheless, he added that they will not continue to make their sexual videos available to the public at this point of time.

The couple encouraged people to sign up at their blog to receive updates on their content.

Despite the public outcry they have caused, Alvin said that his parents are more concerned for his well-being rather than what he did.

Vivian, on the other hand, is not so lucky. "It is more of what you call a 'face' thing," she said.

Alvin added at this point that Lee's parents were giving her "hell".

SINGAPORE: An ASEAN scholar at the National University of Singapore (NUS) said the university had summoned him to a disciplinary hearing on October 31.

Mr Alvin Tan, who is from Malaysia, reportedly told this to the media.

The NUS had earlier served a notice of Board of Discipline (BOD) inquiry to Mr Tan for posting sexually explicit videos and photos of himself and his girlfriend on their blog.

While the blog has been deactivated, Mr Tan and his girlfriend have released a new video on YouTube on October 17, maintaining their stance.

"What do we have to apologise for? For hurting your soft sensitive feelings? For what? For I don't know, breaching some moral code that you hold dearly to yourself but I don't necessarily hold them myself? So we will not make a public apology," he said.

Meanwhile, Malaysian authorities are still deciding on whether or not to take action against Mr Tan.

News of his blog has now been circulating in Malaysia.

Mr Rais Yatim, Malaysia's Minister for Information, Communication and Culture, said: "Jurisdictionally, this case originates from Singapore, therefore we would rather wait for the proper authorities in Singapore to pursue it. As far as we are concerned, the website has not been accessible of late, and therefore there is no real commotion or real problem arising from legal premise or other premises."

Malaysia will leave Singapore to deal with sex blog controversy

Malaysia’s Information, Com*munications and Culture Minister Dr Rais Yatim says his government will leave it to Singapore authorities to handle the recent sex blog controversy involving a ASEAN scholar studying law at the National University of Singapore (NUS), Alvin Tan Jye Yee and his lover Vivian Lee, reported The Star newspaper.

However, he said the Malaysian government would be monitoring the situation.

The couple in their early 20s from Malaysia, showed off their sex acts on their blog which has since been taken down. Many of the images and videos the couple had shared on their blog were obscene and distasteful, such as a photo of a soiled, bloody sanitary pad in response to someone who asked if they have sex when Lee is having her period.

The newspaper quoted the minister as saying: “We have legal redress under Sec*tion 233 and 263 of the Commu*nications and Multimedia Act."

“But we would rather not use that until and unless we get the results of what the Singaporean authorities are pursuing first.”

He urged Malaysians to show that they do not condone the couple’s actions.

Tan and Lee might have taken their sex blog offline but they say they will make a return with their content which they have labelled as being "art". They posted a video response recently to address various queries.

SINGAPORE - Sex blogger Alvin Tan apologised to the National University of Singapore (NUS) for bringing "disrepute" to the university.

The Straits Times quoted him as telling the NUS disciplinary hearing over his blog that while he was sorry for bringing disrepute to the institution, what he did was done in his "own personal time as a private individual and not an NUS student."

"What I did was a victimless crime," the Straits Times website quoted him as saying. "Nobody was really harmed or hurt in the process."

Tan, 24, emerged from the NUS' University Hall at about 3.50pm on Wednesday after the 90-minute hearing.

He looked calm and openly spoke to the media who greeted him.

Tan said that there was no outcome yet from the hearing, which was conducted by five members of the university's board.

"They told me I will hear from them within seven days. The atmosphere at the hearing was serious," he said.

Earlier, the law student arrived at NUS at about 2.20pm without his girlfriend, Vivian Lee, 23.

Tan, an Asean scholarship holder, was casually clad in a red shirt, jeans and a colourful beanie which he wore in one of his videos.

SINGAPORE: The National University of Singapore (NUS) has meted out disciplinary action against a law student who posted offensive material online.

Alvin Tan Jye Yee posted explicit videos and pictures of himself and his girlfriend on his blog in October, which eventually found its way into local news headlines.

The NUS Board of Discipline had "concluded that Alvin's inappropriate conduct was detrimental to the reputation and dignity of the university".

He has been notified of the decision.

NUS did not specify the nature of the action, when contacted by Channel NewsAsia.

A spokesperson said all matters relating to NUS disciplinary proceedings are confidential.
