Lawyer accused of misconduct

THE HIGH Court overturned the decision of a Law Society inquiry committee which cleared a lawyer over allegations of misconduct and ordered the society to look again into the complaints lodged against Mr Andre Arul by a former client. The body of lawyers was also ordered to pay 50 per cent of costs to Top Ten Entertainment, which had accused Mr Arul of disobeying its instructions. In the latest proceedings on Thursday, the society was given permission to appeal against the decision to make it pay costs. In 2006, Top Ten's managing director Peter Bader complained to the Law Society that Mr Arul had failed to comply with his instructions on several occasions. The inquiry committee found no wrongdoing except for a failure to give adequate notice to Top Ten for a transfer of money from the client's account. For this, Mr Arul was fined $500. Mr Bader then took the matter to the High Court which asked the Law Society to re-look at the complaints. A disciplinary tribunal has been appointed but no date has been set for it to review the matter.
