I don't think UNCLOS was designed to supercede or override pre-existing conditions. There are provisions for negotiations between members, such as traditional fishing rights and. Otherwise, China will not join UNCLOS.
Besides, China and Vietnam claim sovereignty over the territories, which UNCLOS has no jurisdiction over.
