Datuk Seri Anwar Ibrahim's plan to win the Kajang by-election and become the Selangor menteri besar was scuttled by the Court of Appeal that overturned his acquittal for sodomy, and sentenced him to five years jail.

There was an uproar in the courtroom when the sentence was read out, overturning the High Court's earlier decision to acquit him for sodomy.

The 28-year-old Saiful, a former aide to Anwar, had accused him of sodomising him in 2008 and even swore on the Quran that he was telling the truth.

It was an unanimous decision.

Judge Datuk Balia Yusof Wahi, who led a three-man bench, delivered the court's decision in 90 minutes after hearing submissions from both parties yesterday and today.

Anwar’s defence team then sought an adjournment until next week to allow them to prepare for mitigation.

His lawyer Karpal pleaded that every opportunity should be given to his client.

"On Monday Anwar will have to be present in Parliament as the King will open the House and on Tuesday he will deliver his speech as opposition leader," Karpal said.

But Balia insisted that Karpal Singh, who is leading Anwar’s defence, must submit mitigating circumstances in an hour’s time.

This led Anwar to react angrily by standing up and shouting at the decision.

“Just do it now!” he exclaimed loudly, in apparent reference to the sentencing.

"It's all over again, they want to put me in the lock-up, that is why they want to continue with the mitigation," said Anwar.

A tearful Datuk Seri Dr Wan Azizah Wan Ismail, along with daughter Nurul Izzah Anwar, rushed to his side in an attempt to calm Anwar.

However, Shafee objected to the request. He said the appeal has not been rushed and mitigation must be done today.

"I am equally unprepared, but ready to make submission," he said.

He said he was sure Anwar would appeal to the Federal Court.

He said it was the fault of Anwat that this case had been delayed since July last year.

Karpal said Shafee was speaking with a forked tongue as he would not act in this manner if he was a lawyer representing a client.

"This is the problem of appointing a mercenary as DPP," Karpal thundered, followed by a shouting match between the two.

Karpal told Shafee to sit down as he was holding the floor.

Balia then said he would give the defence and prosecution an hour to prepare their submissions.

Karpal attempted to address the bench, but the judges just walked out.

With this verdict, Anwar's political career looks to have ended. He will be disqualified from all his political positions and will not be the PKR candidate in the Kajang by-election to be held later this month.

There was further tension in the courtroom and those in the public gallery shouted at the bench, causing the judge to adjourn proceedings for one hour.

In an immediate response, PKR strategic director Rafizi Ramli said: "The worst feeling is that I am not shocked and was prepared mentally for this round of injustice."

Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim expressed his "regret over the Court of Appeal's decision. Another dark episode in the country's judiciary institution."

Former Bersih co-chair Datuk Ambiga Sreenevasan said through her Twitter account, that she was shocked and called on Anwar to stay strong

"I can't believe this is happening!" she said.

DAP's Elizabeth Wong, who is Bukit Lanjan assemblywoman, said: "Shocking. Court of Appeals overturns High Court decision to acquit @anwaribrahim. Where is Justice?"

Batu MP Tian Chua tweeted: "Najib has declared war against Pakatan Rakyat; the people are ready for an all out uprising!"

Ahead of the decision, this afternoon police tightened security outside the court and closed the road in front of the Palace of Justice (PoJ) in Precinct 2, Putrajaya. The main compound outside the PoJ was also cordoned off with yellow crime scene tape.

Media personnel were issued passes to enter the courtroom, while access was limited for visitors and supporters. There were at least 50 media personnel waiting outside the courtroom.

Police presence was limited, with groups of 4-5 personnel posted at strategic locations, including the PoJ entrance, in the main lobby and outside the courtroom. – March 7, 2014.

IGP warns of stern action against protesters in Anwar sodomy verdict

KUALA LUMPUR: Inspector-General of Police Tan Sri Khalid Abu Bakar has warned of stern action against those involved in illegal assemblies following the decision of the Appeal Court in finding opposition leader Datuk Seri Anwar Ibrahim guilty of sodomising his former aide.

Khalid said any protests via illegal street assemblies were prohibited and police would monitor the situation nationwide and take stern action according to the law.

"I am calling on all parties to be calm about the decision made by the Appeal Court today.

"I urge all parties not to hold any gatherings to protest as it is a legal process and objections should be made in court," he told Bernama.

He was commenting on the decision of the Appeals Court today in finding Anwar guilty of sodomising his former aide, Mohd Saiful Bukhari Azlan.

Anwar was sentenced to five years jail.

"The situation is under control and I hope it will continue like that. All have been told to be patient and act according to the existing legal process," Khalid said.

He said police were ready to maintain the peace and hoped no parties would take advantage of the situation.

One local chap in our company is an UMNO youth member in his district who got some inside info and him and his kakis are planning to counter the Pakatan in street battles just like what they did in past Bersih rallies..

Expect some fireworks in KL soon..

Everyone knows Anwar's conviction is to stop him from contesting in the coming by-elections. I agree there will be fireworks soon but not sure how serious it will be.

May whatever God Anwar believes in come to his rescue. I am in tears now. I am crying for this innocent man who is being thrown into jail simply because he is leader of malaysian oppostion.

Malaysian opposition leader Anwar Ibrahim had his acquittal for sodomy overturned on Friday, in a fresh threat to the remarkable career of a charismatic politician who helped turn around the country’s once-hapless opposition.

A Court of Appeals panel upheld a government bid challenging the 2012 ruling which acquitted him on charges he sodomised a male former aide, saying a lower court had misjudged evidence.

Anwar, 66, was sentenced to five years in jail, but freed pending appeal.

Once a rising star in Malaysia’s long-ruling party until his spectacular ouster in the late 1990s, Anwar has alleged a long-running campaign by the ruling regime to destroy his political career with false charges.

He bitterly chastised the judges after the ruling.

“It is a travesty of justice. I would have thought you would have some courage,” he said to the panel.

Friday’s ruling sparked an uproar in a courtroom filled with Anwar’s opposition colleagues and supporters, as his wife and three daughters burst into tears.

Dozens of Anwar supporters demonstrated outside the appeals court in the administrative capital of Putrajaya after the announcement, chanting “Reformasi” (Reform), as a heavy police presence ringed the building.

Sodomy is illegal in Muslim-majority Malaysia and punishable by up to 20 years in jail.

Anwar plans to appeal to the Federal Court, Malaysia’s highest. If that fails, he would also be stripped of his parliament seat, effectively dumping him as leader of the opposition.

“All over again, after 15 years, they want to put me in the lockup and that is why they are rushing,” Anwar said.

A charismatic campaigner and speaker, Anwar reached the pinnacle of the powerful United Malays National Organisation (UMNO), Malaysia’s ruling party, in the 1990s.

As deputy prime minister, he was in line to take power but was felled in a 1998, power struggle with then-ruler Mahathir Mohamad.

Anwar was ousted, beaten and jailed on sodomy and corruption charges widely viewed as trumped-up.

The stunning fall from grace was widely seen both at home and abroad as politically motivated and triggered massive protests in a country where dissent is suppressed.

He spent six years in prison until his 2004 release.

The latest charges were first brought by the government after Anwar united a disparate opposition and led it to what was then its best-ever showing in 2008 polls.

The opposition alliance did even better last year, shockingly winning the popular vote in general elections, though failing to gain control of parliament due to decades of gerrymandering by UMNO.

Anwar has called the drawn-out sodomy trial and subsequent appeal an attempt by a fearful ruling regime to halt the opposition’s advance.

He was acquitted in January 2012, but the three-man appeals bench said the lower court failed to properly handle evidence.

“This trial was all about knocking Anwar Ibrahim out of politics and the government was prepared to do whatever it took to make that happen,” said Phil Robertson, deputy Asia director for Human Rights Watch, said in a statement.

The government of Prime Minister Najib Razak has previously denied such allegations.

The ruling triggered condemnation on social media by supporters of Anwar’s party, many of whom called for street protests.

The timing of the long-delayed appeal decision has raised eyebrows, coming just as Anwar plans to contest a by-election in the key central state of Selangor surrounding the capital on March 23.

He was expected to win and subsequently be made boss of the state, Malaysia’s richest, in a bid to further boost his and the opposition’s clout.

But the conviction disqualifies him from contesting.
