NEWLY elected Hougang MP Yaw Shin Leong, 34, was involved in a road incident near Rivervale Plaza in Sengkang yesterday afternoon.

The Workers' Party organising secretary said he was alone in his car when it hit a road barricade near the Rivervale Lane junction.

He said he had dozed off momentarily before the accident, but added that no one was injured.

A police spokesman said Mr Yaw had made a police report and no injuries were reported.

A reader who was nearby sent in a photograph of the incident, which showed Mr Yaw and his wife standing next to the car. She had rushed down upon hearing news of the incident, he said.

Mr Yaw said he was on the way to his mother-in-law's house in Sengkang, after joining his supporters on a thank-you parade in Hougang yesterday morning.

He attributed his fatigue to the nine days of election campaigning, which culminated in him being elected in Hougang.

Mr Yaw won with 64.8 per cent of the votes against People's Action Party challenger Desmond Choo.

SINGAPORE - The driver who killed an elderly woman in a traffic accident, after he fell asleep at the wheel, escaped jail time after the prosecution failed in its attempt to send him to prison.

Ng Jui Chuan, 36, had knocked down an elderly couple at Thomson Road in November 2009 after dozing off while driving. He was fined S$9,500 and banned from driving for three years.

The prosecution appealed and sought a jail sentence. It had also appealed against the decision of the District Court to amend Ng's original charge, of causing death by a rash act, to negligence.

But the Court of Appeal dismissed it yesterday.

Justice Choo Han Teck said tiredness alone would not be sufficient to infer rashness.

He said that "driving when one is tired or sleepy is not an offence, let alone an offence of rashness".


But it may become so if it is proved that the tired driver knew that he was in all likelihood to fall asleep at the wheel and yet drove.

In Ng's case, "the facts did not show that was the case," said Justice Choo.

He said Ng, though tired, "genuinely believed that he could continue for at least five more minutes".

Noting that Ng was not speeding, had not committed any traffic violation, and there was no significant alcohol level in his blood, Justice Choo said the "only factor against" Ng was that he had fallen asleep.

And taking into consideration the circumstances of the case, Ng's actions "fall short of rashness", Justice Choo added.

Ng drove home on Nov 8, 2009, after not sleeping for 22 hours and after drinking two glasses of wine.

At around 6.50am, when he was about five minutes away from home, Ng's car veered left and hit Madam Mok Sow Loon, 76, and her husband Mr Wee Song Mong, 77.

Mdm Mok died on the spot, while Mr Wee suffered minor injuries.
