【星島日報報道】(星島日報報道)華為公司副董事長孟晚舟在加拿大被捕之後,中加關係急轉直下。繼中國逮捕三名加拿大公民後,昨日一名涉嫌企圖走私高達二百二十公斤冰毒的加拿大籍毒販謝倫伯格在大連接受二審。遼寧省高院認為,嫌犯一審判決入獄十五年,量刑過輕「明顯不當」,要求重審。根據中國《刑法》,該加拿大男子有可能面臨死刑。
據新加坡《聯合早報》報道,檢方指被告人羅伯特•勞埃德•謝倫伯格(ROBERT LLOYD SCHELLENBERG)在二〇一四年十一月十九日抵達大連,按照另一名毒販的指示,分裝一批在大連貨倉的二百二十公斤冰毒,並準備把毒品放入輪胎走私運往澳洲。警方接到報案後在貨倉搜出三百多袋塑料顆粒,其中十五袋為白色晶狀物品。
本案由大連市中級人民法院於二〇一六年三月十五日一審,於今年十一月二十日宣告一審判決,認定被告人走私毒品未遂,判處有期徒刑十五年,並處沒收個人財產人民幣十五萬元人民幣,驅逐出境。宣判後,被告提出上訴。其辯護律師表示,走私毒品證據不充分,並要求法官改判驅逐出境。
該案從案發到一審,中國官方原本一直低調進行,沒有任何媒體報道,只有加拿大駐華使館派員到庭旁聽。直到今年十二月一日,華為副董事長孟晚舟在加拿大被捕之後,上周突然有大連官方媒體報道,有一名加拿大毒販即將公開二審,且所涉及毒品數量巨大。
昨日下午二時,本案二審開庭,各界群眾、部分中外媒體記者五十餘人旁聽了庭審。遼寧省高院昨日晚間發布消息,遼寧省檢察檢察員提出,被告人羅伯特「極有可能參與了有組織的國際販毒活動」,「在走私毒品犯罪過程中起重要作用」,一審法院認定其為從犯和「犯罪未遂」並從輕處罰明顯不當,建議發回重新審判。
根據中國《刑法》以及和最高人民法院量刑解釋,走私、運輸、販賣海洛因或甲基苯丙胺(冰毒)五十克以上,或是參與有組織的國際販毒活動的,處以十五年以上有期徒刑、無期徒刑或者死刑,並處沒收財產。二〇〇七年,一名英國人在烏魯木齊機場入境時被查獲攜帶約四千克海洛因,兩年後被中國法院判處死刑。

Following the arrest of three Canadian citizens in China, a Canadian drug dealer Schellenberger who was suspected of attempting to smuggle up to 220 kilograms of ice was inaugurated in Dalian. The Liaoning Provincial Higher People's Court held that the suspect was sentenced to 15 years in prison for the first instance, and the sentence was too lightly "obviously improper" and required retrial. According to the Chinese Criminal Law, the Canadian man may face the death penalty.

According to Singapore’s Lianhe Zaobao, the prosecution said that the defendant, Robert LLOYD SCHELLENBERG, arrived in Dalian on November 19, 2014, according to another drug dealer’s instructions. Packed a batch of 220 kilograms of ice poison in Dalian warehouse, and prepared to put drugs into the tires and smuggle them to Australia. After receiving the report, the police found more than 300 bags of plastic granules in the warehouse, of which 15 bags were white crystal objects.

The case was firstly tried by the Dalian Intermediate People's Court on March 15th, 2016. On November 20 this year, the first-instance judgment was announced. The defendant was found guilty of smuggling drugs and sentenced to 15 years in prison and confiscated. The property was RMB 150,000 and was deported. After the verdict was pronounced, the defendant filed an appeal. His defense lawyers said that the evidence of smuggling drugs was inadequate and that the judges were forced to change their deportation.

The case was sent from the case to the first instance. The Chinese government had always been low-key. There was no media report. Only the Canadian Embassy in China sent a staff to the court. Until December 1 this year, after Huawei’s Vice Chairman Meng Zhouzhou was arrested in Canada, there was a sudden report from Dalian’s official media last week that a Canadian drug dealer was about to open the second instance and the amount of drugs involved was huge.

At 2 pm yesterday, the second trial of the case was held. More than 50 people from all walks of life and some Chinese and foreign media reporters attended the trial. The Liaoning Provincial High Court issued a news yesterday evening. The Liaoning Provincial Procuratorate Prosecutor stated that the defendant Robert "is very likely to participate in organized international drug trafficking activities" and "an important role in the process of smuggling drug crimes." It is recommended that the accomplice and the "criminal attempt" and the light punishment be obviously improper, and it is recommended to send it back to the trial.

According to the Chinese Criminal Law and the sentence interpretation of the Supreme People's Court, smuggling, transporting, selling or selling heroin or methamphetamine (ice) more than 50 grams, or participating in organized international drug trafficking activities, 15 years of imprisonment, Life imprisonment or death penalty, and confiscation of property. In 2007, an Englishman was found to have carried about four kilograms of heroin when he entered the airport at Urumqi. He was sentenced to death by the Chinese court two years later.
