[Bloomberg] -- A Chinese court sentenced a Canadian man to death in a drug trial. This is the second such judgment since the arrest of Huawei executives caused the dispute between the two countries. Canadian citizen Fan Wei was one of 11 people sentenced in the manufacture and sale of methamphetamine on Tuesday. The court ruled that he and another defendant, Wu Zi, had a "organization and command role" and sentenced the two to death and confiscated all personal property. Five other people, including four Mexican citizens, were sentenced to two years’ imprisonment and life imprisonment. Death delays are generally able to be commuted later. The other four were sentenced to fixed-term imprisonment. In January this year, China sentenced another Canadian citizen, Robert Schellenberg, to death for drug trafficking. In the previous month, the Chinese also arrested former Canadian diplomat Michael Kovrig and businessman Michael Spavor in the national security investigation. All three cases occurred after Canada’s December 1st arrest of Huawei’s Chief Financial Officer Meng Xizhou in response to an extradition request from the United States. China has also begun to reject canola from Canada. Tuesday’s ruling was not officially linked to any of the above events, but it exacerbated tensions between the two countries. Canadian Foreign Minister Fang Huilan told reporters in Ottawa that the latest verdict was "cruel" and "inhuman", saying that Canada opposed the death penalty in principle. She also previously called for the commutation of Schellenberg and the release of Kovrig and Spavor. The Jiangmen City Court of Guangdong Province found that Fan Wei and other defendants set up a drug-making factory in the province in 2012 to produce 63,834 grams of methamphetamine (ice) and 366 grams of dimethylamylamine. 【本報綜合報道】近年香港及內地加強掃毒,內地再有加拿大毒販被判死刑。廣東省江門市中級人民法院周二就一宗特大跨國製售毒品案,一審公開宣判。十一名被告中,兩名主犯被判死刑,當中包括一名加拿大籍男子。

兩主犯指揮製毒 罪行極重

法院審理查明,二○一二年加籍被告范威,以及伍子平等人合謀製造及販賣毒品,並糾集九名美國籍、墨西哥籍及中國籍被告參與。范威等人在台山設立製毒窩點,共販賣及製造冰毒約六十四公斤。法院認為范威和伍子平在團夥中領導及指揮,且製造、販賣的毒品數量特別巨大,罪行極其嚴重,故判處二人死刑,沒收個人全部財產。

涉糾集美墨及中國籍毒販

而美國籍的被告馬克、墨西哥籍的里昂、佩德羅、奧斯卡及凱瑞特等人均參與製毒販毒,亦屬主犯,分別被判處死刑、緩期兩年執行,以及無期徒刑。其餘被告曾顯樑、李榮富、廖健銘、劉志敏等人,在案中起次要作用,被判處有期徒刑。審判長宣判後稱,各被告如不服判決,可在接到判決書翌日起十日內,向廣東省高級人民法院提出上訴。

這是今年第二次有加拿大人在中國因涉毒案而被判死刑。加拿大卅六歲男子謝倫伯格,此前被控走私毒品到大連,一六年一審判囚十五年,惟遼寧省高級法院裁定一審判刑太輕,去年十二月將案件重審。今年一月大連市中級人民法院重審判謝倫伯格死刑,案件目前上訴中。

[Comprehensive report of this newspaper] In recent years, Hong Kong and the Mainland have stepped up their anti-drugs, and Canadian drug dealers in the Mainland have been sentenced to death. The Intermediate People's Court of Jiangmen City, Guangdong Province, publicly pronounced a first-instance trial on a case of a large-scale transnational drug sales law on Tuesday. Of the eleven accused, two principal offenders were sentenced to death, including a Canadian man.

The two principals commanded the production of drugs, and the crimes were extremely serious.

The court found that in 2012, the defendant Fan Wei and Wu Zongping colluded to manufacture and sell drugs, and involved nine American, Mexican and Chinese defendants. Fan Wei and others set up a drug-making den in Taishan, selling and manufacturing about 60 kilograms of ice. The court held that Fan Wei and Wu Ziping were leading and commanding in the gang, and the amount of drugs manufactured and sold was extremely large, and the crime was extremely serious. Therefore, the two were sentenced to death and all personal property was confiscated.

Involved in the collection of US and Mexican drug dealers

The US defendant Mark, the Mexican-born Lyon, Pedro, Oscar and Karrett were all involved in drug trafficking and drug trafficking. They were also the principal offenders, respectively, sentenced to death, suspended for two years, and life imprisonment. The remaining defendants, Zeng Xianliang, Li Rongfu, Liao Jianming, Liu Zhimin, etc., played a secondary role in the case and were sentenced to fixed-term imprisonment. The presiding judge said that if the defendants refused to accept the judgment, they could appeal to the Guangdong Higher People's Court within 10 days of the date of receipt of the judgment.

This is the second time this year that a Canadian has been sentenced to death for drug-related cases in China. The six-year-old man of Germany, Schellenberger, was accused of smuggling drugs to Dalian and sentenced him to 15 years in prison for sixteen years. However, the High Court of Liaoning Province ruled that the sentence was too light and the case was re-examined last December. In January this year, the Dalian Intermediate People's Court retrialed Schellenberger's death sentence, and the case is currently on appeal.
