Drivers! Did you know that you cannot claim damages from drunk drivers if you get hit by them?

Netizens are discussing a recent drunk-driving accident and many are furious about the supposed "injustice" of the situation.

A car was recently waiting at a traffic light when he was hit by a drunk driver in another car. The victim attempted to claim damages coming up to $70,000 from the culprit's insurer, but was denied as the culprit was drunk.

Unknown to many, a driver's insurance becomes voided if he gets into an accident while drunk. This has many implications, for example, victims hit by the drunk driver can no longer claim damages from the culprit's insurer.
Some suggest a possible solution - Claim damages but say that the driver wasn't drunk.

i am one of the victim of drunk driver...damn..my case still dragging .Coming to 4 years.

But how was the bill for the repair settled 4 years ago? Did you have to fork out first?
 
Wow, 70K damages to vehicle - plus COE hor. Car must be totally damaged lah.
 
Then if accident with no licensed driver? Stolen vehicle etc? Insurance pay or not?
 
This is how I understand so far..

If you are bystander and got hit by a drunk driver. Too bad. You can only sue him after paying your lawyer.
If you are on 3rd party insurance motorcycle insurance. Ditto.

If you bought comprehensive insurance for your car. You can claim from your insurance company.
But you have to sue the drunk driver for medical and hospitalization insurance.

Moral of the story? Dun go out.
