A man convicted of killing Sydney heart surgeon Victor Chang is on a flight back to Malaysia.
Dr Chang was gunned down on a footpath at Mosman in Sydney's north in a failed extortion attempt in 1991.
One of the two men convicted over the death, Phillip Choon Tee Lim, was due for release in November after serving an 18-year minimum sentence.
But after a submission from the New South Wales Government, the Parole Authority ruled he should stay in jail for another year because he would not have to serve the conditions of his parole once he returned to Malaysia.
The Supreme Court on Monday quashed the decision.
Lim was released from Parramatta jail and taken to Sydney Airport to prepare for his deportation.
It is understood the 50-year-old was deported on a flight that left for Kuala Lumpur about 9:25pm (AEDT).
