SINGAPORE: A man who failed in his lawsuit against the Singapore General Hospital (SGH) and one of its orthopaedic surgeons was ordered to pay each of the defendants S$270,000 in legal costs on Thursday (May 14).

Mr Andrew Chua must also pay fees for disbursements and an assessor, whom the High Court specially appointed to hear the case.

Mr Chua, 54, had undergone a spine surgery performed by Dr Yue Wai Mun in 2007 after suffering an acute slipped disc that left him paralysed. When his condition did not improve after the operation, he filed a suit in October 2012 against Dr Yue and the hospital, claiming negligence.

Among other things, he claimed that Dr Yue was wrong to have operated on him from the back and had failed to order an MRI scan immediately after the surgery. Mr Chua alleged that these factors impeded his recovery.

High Court Judge Woo Bih Li dismissed the suit and said that the “many shifts” in Mr Chua’s case throughout the trial had “damaged his claim beyond repair”. In a written judgment released last week, the judge also criticised two expert witnesses called by Mr Chua, describing their testimonies as illogical and unconvincing.

“Andrew appears convinced that his condition would have improved if not for the negligence of Dr Yue. Ironically...it may well be that if it were not for Dr Yue’s surgery, Andrew would not even have improved to his present condition,” said the judge.

Dr Yue’s lawyer Lek Siang Pheng said the judge’s cost assessment was in line with the range they had requested.

TODAY understands that this is the first time the High Court had appointed an assessor — Dr Yu Chun Sing, a senior consultant from Tan Tock Seng Hospital’s Department of Orthopaedic Surgery — to hear a medical-related case.

A PART-TIME law firm assistant who sought $1 million from the Singapore General Hospital (SGH) and one of its surgeons, after an operation there failed to reverse his paraplegia, now has to pay two sets of legal costs after the High Court dismissed his case. Mr Andrew Chua, 54, underwent the operation in 2007 after a slipped disc pressing on his spinal cord left him paralysed from the waist down. When his condition did not improve afterwards, he filed a lawsuit in October 2012, claiming negligence. He claimed that orthopaedic surgeon Yue Wai Mun was wrong to have operated on him from the back and did not tell him he could have also been operated on from the front. He also said Dr Yue failed to order an MRI scan after the operation.

In a 71-page written judgment released on Monday, High Court Judge Woo Bih Li questioned why Mr Chua had continued to sue both the hospital and Dr Yue when a claim against either would have sufficed. I hope Andrew Chua gets bankrupted for making such a frivolous lawsuit. I bet he is hoping he can win a million bucks and that would take care of him for life. He's an ungrateful bastard. If not for SGH's care, his condition would not have improved after his slipped disc problems.

hahhaha. really wonderful good news. this fat asshole is just a legal assistant and not a lawyer and so fark up arrogant like alot of sinkies, think just because they complain and sue , they would win but alas. heard from inside sources that he actually became better after surgery but thought he could nit pick on small little discrepencies and try his luck. served him right it back fires terribly. even his own lawyer would hide the fact that he has no case and gives him false hope. now got to settle his own lawyers fees, the plaintiff costs and waste of the surgeon's time in courts and their lawyer fees. in life esp in business, don't try to act big and sue. now lan lan got to pay easily almost $1m in costs. hahaha . screwed up low class sinkie mentality

it's very difficult to sue a doctor and win

unless it is a clear case of medical negligence

nothing to do with high or low class mentality

if you have a solid case against the doctor

the medical insurance company will just pay up

and you become a millionaire....go and give yourself a treat!!!
