【法官婚外情】想與女助理父女戀 法官辯兩情相悅

已婚的台北高等行政法院前法官陳鴻斌糾纏女助理案，判決書今公告，已婚、60多歲的陳鴻斌坦承邀單身、約30歲的女助理牽手散步，但辯稱這是兩情相悅的雙方互動，並指案發當天，女助理為省30元停車費，熟門熟路帶他開車走逆向至政大堤防，且女助理被他親了以後，沒有奪門而出，他送女助理回家時，女助理還說明天見，陳鴻斌認為，雙方是有感情存在的，後來已昇華為祝福，要求職務法庭輕判此案，獲撤銷免除法官職務處分，僅罰薪1年約250萬元。
陳鴻斌向職務法庭坦承，2012年11月間起，數次在辦公室與女助理牽手或擁抱，及相約於同年12月19日晚間碰面，陳男說，是女助理建議共赴政治大學堤防牽手散步，他有在汽車後座親女助理，但並未違反女助理意願，是出於兩情相悅的雙方互動，並未以職務脅迫女助理。
此外，陳鴻斌還說，當晚去的政大堤防須逆向行駛才能進入，非熟門熟路者，無法找到入口，加上案發處晚間燈光昏暗，人跡較少，女助理如果是基於隔天的續聘會議等因素才接受其邀約，也就不真心對待他，或只是應付討好他，女助理應自會以女生自身安全為重，而不是優先考量為他省下30元停車費。
陳鴻斌認為，若女助理要應付他的邀約，可讓由校門口進入校園停車，在燈光明亮，人跡較多之校園內活動即可，也就不會因燈光昏暗，人跡較少之情境，造成他誤會，陳男認為，女當時內心應不只是討好而已，是有感情成分存在的，至於女助理說是為續聘而討好他，陳男說，這純屬事後說詞，不足採信。

至於擋住門，暫時不讓女助理離去，陳男說，是因辦公室擺設與女助理日後案件卷宗資料放置及進出動線有關，屬公務內容，他話還沒講完，女助理卻已要離開，他並非壓門，而是扶著、護著門，他不可能讓女助理不能出去。至於是否順手用指頭碰一下門，已不記得，陳男說，他在將所有事情講完後，女助理就自行離開，對於女助理說，當時被擋門，她大聲說，「我要出去，請讓我出去」的講法並不是事實。
